Laws of Transgression offers multiple perspectives on the story of Daniel Paul Schreber (1842–1911), a chamber president of the German Supreme Court who was institutionalized after claiming God had communicated with him, desiring to make him into a woman. Schreber was not only a successful judge, but was also to become the author of one of the most commented upon texts in psychiatric literature, Memoirs of My Nervous Illness. Published in 1903, this remarkable work documented Schreber’s visions, desires, jurisprudence, and theology. Far from ending the judge’s legal investments, it manifested an intensification of engagement with the law in the attempt to prove that becoming a woman did not deprive the judge of legal competence. Schreber’s experience of bodily change and his account of interior life has been the subject of more than a century of psychoanalytic and medical scrutiny. With the contemporary trans turn, interest in the judge’s desire to become a woman has intensified. Gregg organizes his discussion around the notion of transgression, which Blanchot himself took over from Georges Bataille--most palpably in his interpretation of the myth of Orpheus--as a paradigm capable of accounting for the relationships that exist in the textual economies formed by author, work, and reader. It compares how people in the two worlds came to terms with the proscriptions of sodomy, idolatry, and usury. When historians speak of the gap between premodern practice and the legal theory of the time, they tend to ignore the myriad of justifications that filled this gap. The similarities outweigh the differences in the ways people came to terms with the various rules of divine law. Tramps, lazy, cheaters. Expressions like these were widely used by several masters in view of the multiple forms of transgressions committed by slaves. This type of (dis) qualification gained an even stronger contour in properties controlled by religious orders, which tried to impose moralizing measures on the enslaved population. In this book, the reader will come across a peculiar form of management, highly centralized and commanded by one of the most important religious corporations in Brazil: the Order of Saint Benedict. The Institutional Paternalism built by this institution throughout the 18th and 19th centuries was able to stimulate, among the enslaved, the yearning for freedom and autonomy, 'prizes' granted only to those who fit the Benedictines' moral expectation, based on obedience, discipline and punishment. The "incorrigible" should be sold while the "meek" would be rewarded. The monks then became large slaveholders, recognized nationally as great managers. However behind this success, they had to learn to deal with the stubborn resistance of those who refused to peacefully surrender their bodies and minds, resulting in negotiations and concessions that caused disturbances, moments of instability and internal disputes.
