Malgré l'importance grandissante de l'argent dans la vie politique, le financement des partis en France n'a fait l'objet d'une réglementation spéciale qu'à partir de 1988, au moment où étaient révélées les premières " affaires ". Cette loi a ensuite été modifiée, notamment en 1990, 1993 et 1995. Le financement des partis repose essentiellement sur l'aide de l'État, plus de 73 millions d'euros par an, depuis que les dons des personnes morales ont été interdits. D'autres grandes démocraties (Allemagne, États-Unis, Grande-Bretagne) continuent d'admettre ce type de financement même après les récentes réformes réalisées dans ces pays, souvent à la suite de scandales retentissants. L'Union européenne admet également les dons des personnes morales aux partis européens. La législation française oblige les partis à transmettre chaque année à une autorité administrative indépendante, la Commission nationale des comptes de campagne et des financements politiques, leur comptabilité certifiée par deux commissaires aux comptes. À défaut, ils ne peuvent ni bénéficier des fonds publics ni financer la campagne de leurs candidats. Le statut et les pouvoirs de la Commission, qui est également responsable du contrôle des comptes de campagne des candidats aux principales élections, ont été renforcés en 2003 mais des améliorations s'avèrent encore nécessaires. En outre, le cadre juridique général ainsi que la définition des partis peuvent également être revus.
