Legal frameworks for sustainable aquaculture by Food and Agriculture Organization of the United Nations Pdf

Aquaculture, the farming in water of aquatic animals and aquatic plants, has seen extraordinary growth over recent years in terms of production levels and as regards its share of production of aquatic animals and algae. Although the most recent figures show a slight slowdown in the rate of growth of the sector (FAO, 2022), aquaculture is still seen to have tremendous potential. Many developing countries have high aspirations for rapid aquaculture development in order to feed their fast-growing populations and to increase export earnings. The aim of this study is to identify the essential elements of a legal framework for sustainable aquaculture. For the fact is that in many countries the growth of aquaculture appears to have outpaced the development of the legislation and legal frameworks to govern aquaculture. This study is intended both to act as a guide to the complexity of legal frameworks for aquaculture and also to serve as the background or resource document for the Aquaculture Legal Assessment and Revision Tool (ALART).

Aquaculture Law and Policy by Nigel Bankes,Irene Dahl,David L. VanderZwaag Pdf

With aquaculture operations fast expanding around the world, the adequacy of aquaculture-related laws and policies has become a hot topic. This much-needed book provides a three-part guide to the complex regulatory landscape. The expert contributors first review the international legal dimensions, including chapters on law of the sea, trade, and access and benefit sharing. Part Two offers regional perspectives, discussing the EU and regional fisheries management organizations. The final part contains eleven case studies exploring how leading aquaculture producing countries have been putting sustainability principles into practice.

Towards Sustainable Fisheries Law by Gerd Winter Pdf

With the growing scarcity of fish resources, instruments of fisheries management become crucial. This publication suggests a legal approach to this isssue, and focuses on six case studies: Indonesia, Kenya, Namibia, Brazil, Mexico and the EU. The case studies are preceded by an analysis of the international law requirements concerning fisheries management, with a focus on fisheries in Exclusive Economic Zones. The final part of the book summarises the case studies and develops a proposal for a 'legal clinic' for fisheries management.

Promotion of Sustainable Commercial Aquaculture in Sub-Saharan Africa: Legal, regulatory and institutional framework by Neil B. Ridler,Nathanaël Hishamunda,David R. Percy Pdf

This study considers the elements of a legal framework designed to promote a sustainable commercial aquaculture. These relate to: a secure right to property and clean water; avoidance of unnecessary costs; and a licence system, including a system for environmental impact assessments and enforcement of codes of practice. Environmental supervision should extend to: controls over the use of exotic species and products from modern biotechnology. These include genetically modified organisms, disease control and health management, and to any water quality concerns created by the proposed project. The study analyses the aquaculture industries of Madagascar, Malawi, Mozambique, Nigeria and Zambia against these criteria. Improvements in legislation applicable to the individual countries, but which require consideration by all sub-Saharan countries are then suggested.

Aquaculture Legal Assessment and Revision Tool by Food and Agriculture Organization of the United Nations Pdf

While the aquaculture sector has seen extraordinary global growth over recent years, it also faces a number of important challenges. Although aquaculture may reduce pressure on wild fish stocks, the fact remains that the sector can also have a range of negative environmental impacts. At the same time, a degraded environment, in particular poor water quality, can adversely affect the health of aquatic animals and plants used in aquaculture and therefore the economic sustainability of the sector. Moreover, if appropriate bio-security measures, in the sense of measures to protect aquatic animal health, aquatic plant health and human health, are not in place (or are not implemented), the sector can be subject to devastating disease outbreaks. It follows that the legal framework for aquaculture should support the development of the sector while at the same time promoting its long term environmental, social and economic sustainability. This requires a balancing act. Overly burdensome legislation may discourage or otherwise hinder investment. At the same time, insufficient regulation may encourage indiscriminate and substandard operations that lead to uncontrollable disease outbreaks, irreparable environmental damage and the economic failure of aquaculture operations with ensuing social costs. Unlike capture fishing, which is regulated largely if not exclusively on the basis of a fisheries law, the legal framework for aquaculture is invariably diverse and complex. Some aspects of aquaculture are addressed in legislation that has aquaculture as its specific or primary focus, such as a chapter in a fisheries law or a stand-alone aquaculture law (described in this document as ‘aquaculture legislation’).

Implementing the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) through national fisheries legal frameworks by Nakamura, J.N., Kuemlangan, B. Pdf

In recent years, an increasing number of commercially exploited and managed aquatic species, including sharks and rays, have been listed in the Appendices to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). The listing of some species in CITES Appendix II has necessitated attention from the fisheries sector of States on how listing would impact on the management of the relevant fisheries. This sourcebook and the research process involved in its development highlighted the opportunity to implement CITES through national fisheries legal frameworks. Indeed, in certain cases, doing so can prove to be vital in giving practical effect to CITES while simultaneously enhancing fisheries management regimes and ensuring that all activities along the fisheries value chain, especially the international trade in CITES-listed aquatic species, are legal, traceable and sustainable. The study recognizes that communities operating within the CITES regime and in the fisheries sectors have their own particular areas of work. However, they should cooperate and coordinate their work where they share the common high-level objectives of ensuring responsible, legal and sustainable utilization of resources, including species, biodiversity and ecosystems, and implementing the relevant Sustainable Development Goals. This sourcebook was first published in 2020, designated as a "super year" for nature and biodiversity. The second edition of this sourcebook was developed to take into account and reflect the outcomes of the 19th meeting of the Conference of the Parties to CITES, in 2022. The sourcebook is a timely and useful contribution to fisheries management as it seeks to provide support in: (i) raising awareness of CITES; (ii) enhancing comprehension of the CITES regime and its relationship with the fisheries sector; and (iii) where a deliberate decision is made by a country to implement CITES through its national fisheries legal frameworks, providing guidance on what to do and how to do it.

Aquaculture Law and Policy by David L. VanderZwaag,Gloria Chao Pdf

The aquaculture industry is fast expanding around the globe and causing major environmental and social disruptions. The volume is about getting a 'good governance' grip on this important industry. The book highlights the numerous law and policy issues that must be addressed in the search for effective regulation of aquaculture. Those issues include among others: the equitable and fair assignment of property rights; the design of effective dispute resolution mechanisms; clarification of what maritime laws apply to aquaculture; adoption of a proper taxation system for aquaculture; resolution of aboriginal offshore title and rights claims; recognition of international trade law restrictions such as labeling limitations and food safety requirements; and determination of whether genetically modified fish should be allowed and if so under what controls. This book will appeal to a broad range of audiences: undergraduate and postgraduate students, academic researchers, policy makers, NGOs, practicing lawyers and industry representatives.

Sustainable Fisheries Management and International Law by Abdullah-Al Arif Pdf

This book presents a comprehensive analysis of the legal and policy frameworks for marine fisheries management and examines the efficiency of the institutions responsible for the formulation, implementation and enforcement of marine fisheries laws and policies in Bangladesh. Sustainable management of marine fisheries is a complex, multi-dimensional and multi-stakeholder process that entails sustainable use of marine living resources and conservation of marine biodiversity. Offering a critical analysis to these frameworks that play a crucial role in the conservation and management of fish stocks in areas within and beyond national jurisdiction, this book examines inadequacies and implementation gaps in the legislative, policy and institutional frameworks that contribute to the unsustainable exploitation of marine fish stocks in Bangladesh. It recommends law and policy reform for conservation and sustainable management of marine fisheries in Bangladesh and the Bay of Bengal.

Aquaculture zoning, site selection and area management under the ecosystem approach to aquaculture by Food and Agriculture Organization of the United Nations Pdf

The ecosystem approach to aquaculture provides the conceptual guideline to spatial planning and management. This publication describes the three major steps in spatial planning and management, namely, zoning, site selection and design of an aquaculture management area, or AMA. The rationale for and objectives of each step, the ways (methodologies) to implement it, and the means (tools) that are available to enable a methodology are described in a stepwise fashion. Recommendations to practitioner s and policy-makers are provided. A separate policy brief accompanies this paper. The benefits from spatial planning and management are numerous and include higher productivity and returns for investors, and more effective mitigation of environmental, economic and social risks, the details of which are provided in this paper. This publication is organized in two parts. Part one is the “Guidance”; it is the main body of the document and describes the processes and steps for spatial planning, incl uding aquaculture zoning, site selection and area management. Part two of the publication includes six annexes that present key topics, including: (i) binding and non-legally binding international instruments, which set the context for sustainable national aquaculture; (ii) biosecurity zoning; (iii) aquaculture certification and zonal management; (iv) an overview of key tools and models that can be used to facilitate and inform the spatial planning process; (v) case studies from ten countries – Brazil, Chile, China, Indonesia, Mexico, Oman, the Philippines, Turkey, Uganda and the United Kingdom of Great Britain and Northern Ireland; and (vi) a workshop report. The country case studies illustrate key aspects of the implementation of spatial planning and management at the national level, but mostly within local contexts.
