Libel Tourism by Avi Bell,Avinoam Sharon Pdf

When an armed force holds territory beyond the borders of its own nation, "occupation" is the term that most readily comes to mind. It may be difficult to think of a more felicitous term to describe the factual situation. But not all the broad spectrum of factual situations that we commonly think of as "occupation" fall within the limited scope of the term "occupation" as defined in international law. Not every situation we refer to as "occupation" is subject to the international legal regime that regulates occupation and imposes obligations upon the occupier.

Cross-Border Infringement of Personality Rights via the Internet by Symeon C. Symeonides Pdf

Conflicts of laws arising from injuries to rights of personality—such as defamation or invasion of privacy—have always been difficult, if only because they implicate conflicting societal values about the rights of freedom of speech and access to information, on the one hand, and protection of reputation and privacy, on the other hand. The ubiquity of the internet has dramatically increased the frequency and intensity of these conflicts. This book explores the ways in which various Western countries have addressed these conflicts, but also advances new, practical ideas about how these conflicts should be resolved. These ideas are part of an international model law unanimously adopted by a Resolution of the Institut de droit international, which addresses jurisdiction, choice of law, and recognition and enforcement of foreign judgments. The book provides extensive article-by-article commentary, which explains the philosophy and intended operation of the Resolution.

Defamation, Libel Tourism and the SPEECH Act of 2010 by Harry Melkonian Pdf

This book discusses the ostensible reasons for this legislation and examines the law in light of traditional principles of extending recognition to foreign judgments as an essential aspect of comity among nations. In order to properly evaluate the SPEECH Act and its likely implications, this study critically examines the ongoing degradation of First Amendment speech protections in the US and the developing English common law defamation privileges and reaches some startling conclusions. In this first critical study of the SPEECH Act, Harry Melkonian not only examines the specifics and likely application of this legislation as well as the underlying phenomenon of Libel Tourism but also provides a radically new perspective on the incipient convergence of US First Amendment and English common law freedom of speech and defamation principles. Uniquely, the book approaches the concept of convergence from the viewpoint of both doctrinal law and free speech theory and amalgamates the results through application of the traditional law of comity among nations. Defamation, Libel Tourism and the SPEECH Act of 2010 is an essential book for everyone involved with international legal aspects of the media including publishers, broadcasters, as well as legal professionals and academics.

Defamation and the Right to Freedom of Speech by Mariette Jones Pdf

In an effort to balance the protection of reputation and the right to free speech, the UK Parliament attempted to fundamentally transform English libel law through the Defamation Act 2013. This book evaluates the success of this attempt by means of a comparative analysis of relevant law in the United States of America (US), Germany, and the European Court of Human Rights. It examines the reasons that it was deemed necessary to reform the common law of defamation in England and Wales, the changes wrought by the act, and the case law it has engendered. As defamation often occurs internationally, the book also takes a broad comparative look at the way in which other relevant jurisdictions attempt to balance reputational protection and free speech. The natural starting point is the US where freedom of expression is strongly protected by the US Constitution. From there the focus shifts to Germany where both competing legal interests are likewise given constitutional protection. The European Court of Human Rights’ jurisprudence is also examined because of its highly developed balancing approach and its general reflection of European legal thinking. Recent high-profile defamation cases such as those concerning the actors Johnny Depp and Amber Heard, decided in the UK as well as the US, form interesting and informative case studies. The final section of the work rates the libel reform attempted in the UK against its own benchmarks, provides suggestions about the way in which it is developing, and concludes that valuable lessons can still be learnt from the comparator jurisdictions. The book will be essential reading for those working in the areas of human rights law and media law.

The SAGE International Encyclopedia of Mass Media and Society by Debra L. Merskin Pdf

The SAGE International Encyclopedia of Mass Media and Society discusses media around the world in their varied forms—newspapers, magazines, radio, television, film, books, music, websites, social media, mobile media—and describes the role of each in both mirroring and shaping society. This encyclopedia provides a thorough overview of media within social and cultural contexts, exploring the development of the mediated communication industry, mediated communication regulations, and societal interactions and effects. This reference work will look at issues such as free expression and government regulation of media; how people choose what media to watch, listen to, and read; and how the influence of those who control media organizations may be changing as new media empower previously unheard voices. The role of media in society will be explored from international, multidisciplinary perspectives via approximately 700 articles drawing on research from communication and media studies, sociology, anthropology, social psychology, politics, and business.

Draft Defamation Bill by Great Britain: Ministry of Justice Pdf

This consultation paper sets out the Government's proposals for reform of the law on defamation, aiming to achieve balance between protection of freedom of speech and the protection of reputation. The Government wants to ensure that the threat of libel proceedings is not used to frustrate robust scientific and academic debate, or to impede responsible investigative journalism and the valuable work undertaken by nongovernmental organisations. Issues included in the draft Bill are as follows: a new requirement that a statement must have caused substantial harm in order for it to be defamatory; a new statutory defence of responsible publication on matters of public interest; a statutory defence of truth (replacing the current common law defence of justification); a statutory defence of honest opinion (replacing the current common law defence of fair/honest comment); provisions updating and extending the circumstances in which the defences of absolute and qualified privilege are available; introduction of a single publication rule to prevent an action being brought in relation to publication of the same material by the same publisher after a one year limitation period has passed; action to address libel tourism by ensuring a court will not accept jurisdiction unless satisfied that England and Wales is clearly the most appropriate place to bring an action against someone who is not domiciled in the UK or an EU Member State; removal of the presumption in favour of jury trial, so that the judge would have a discretion to order jury trial where it is in the interests of justice.

Perspectives on Declaratory Relief by Kanaga Dharmananda,Anthony Papamatheos Pdf

In Sankey v Whitlam (1978) 142 CLR 1 at 25, Gibbs ACJ remarked that: "The power to make declaratory orders has proved to be a valuable addition to the armoury of the law."Declaratory proceedings are practical and remain one of the most popular remedies in both civil, commercial and public law litigation. In the past few years, the declaration was the remedy sought in a number of high profile cases, including the constitutional challenge to the Workchoices legislation, the AWB privilege claims, the Channel 7 litigation and as to the status of certain proofs of debt in the Sons of Gwalia insolvency. But despite its regular and broad practical application, no Australian work on the subject has been published since 1984.This book is a collection of papers by eminent Australian jurists on the law of, and major issues involved in obtaining, declaratory relief. They address major questions about declaratory relief, including the jurisdiction and power to award the remedy, its development, historical origins and the discretion vested in a court hearing an action for declaratory relief. It also addresses practical aspects such as the form or terms of the declaration to be ordered and provides some precedents. All royalties from this work are being directed towards the Indigenous Legal Scholarship program at the University of Western Australia, Law School.
