Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to the law applied to cases involving cross border issues in Sweden. It offers every lawyer dealing with questions of conflict of laws much-needed access to these conflict rules, presented clearly and concisely by a local expert. Beginning with a general introduction, the monograph goes on to discuss the choice of law technique, sources of private international law, and the relevant connection with other laws. Then follows clear description and analysis of the rules of choice of law on natural and legal persons, contractual and non-contractual obligations, movable and immovable property, intangible property rights, company law, family law (marriage, cohabitation, registered partnerships, matrimonial property, maintenance, child law), and succession law (including testamentary dispositions). The presentation concludes with an overview of relevant civil procedure, examining lex fori and issues of national and international jurisdiction, acceptability and enforcement of foreign judgements, and international arbitration. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling cases in Sweden. Academics and researchers, as well as judges, notaries public, marriage registrars, youth welfare officers, teachers, students, and local and public authorities will welcome this very useful guide, and will appreciate its value in the study of private international law from a comparative perspective.

Divorce in Europe by R. Chester Pdf

Those who have sought information on the extent of divorce in the modern world will know that the most accessible sources lie in international yearbooks, (1) and that from these it is possible to make certain broad comparisons of a historical or geographical kind. For anyone country, for instance, changes in the divorce rate can be traced, or comparative rates for any number of countries at any given time can be examined. Similarly, it is possible to discover differences and similarities in divorce trends on an international basis, either for individual nations or for region al or cultural clusters. Typically, however, such sources cannot be used for detailed or sophisticated comparisons because of the limit ed volume of data, and of the nature of the statistics presented. To detect detailed differences in divorce-propensity by time or place, for instance, ideally requires cohort data, information on the number of marriages dissolved by divorce within one, two---x years among every 1,000 or 10,000 of marriages contracted in a given year. Such data do not appear in the international statistical summaries, which often do not even use the next best kind of measure, namely divorces per 1,000 or 10,000 existing marriages. Often the figures given are those for divorces per thousand of tot a I population, and these are of little comparative value because of variations in popu lation structure.

Comparative in both approach and framework, Family Law, Sex and Society provides a critical exposition of key areas in family law, exploring their evolution and development within their historical, cultural, political and legal context. Cross-referencing to English law throughout, this comparative textbook pays particular attention to the transformation of marriage; the development of divorce laws; matrimonial property; the legal recognition of unmarried heterosexual and same-sex cohabitants; the universal adoption of the best interests standard for children in domestic and international legislation; and the impact of the Human Rights Act 1998 on family law in a variety of jurisdictions. Divided into different sections, Family Law, Sex and Society includes coverage of: a jurisdictional and historical survey of some of the main themes in Family Law, as well as consideration of the evolution of the Western family the English law relating to divorce, marital property and children and a comparison with the equivalent law in the civil law jurisdictions of France and Germany family law developments in other common law countries such as Australia and New Zealand, selected American jurisdictions, parts of Africa and some Far Eastern countries; and hybrid jurisdictions like Japan and Russia an analysis of the law relating to unmarried cohabitation and domestic partnerships in civil law jurisdictions such as France, Germany and Sweden in comparison to Anglo-American law a comparative analysis of the laws relating to domestic violence.
