Every State has an obligation to prevent terrorist attacks emanating from its territory. This proposition stems from various multilateral agreements and UN Security Council resolutions. This study exhaustively addresses the scope of this obligation of prevention and the legal consequences flowing from its violation, so as to provide greater clarity on governments' counterterrorism duties and to enhance State accountability for preventable wrongs. It defines the contents and contours of the obligation while placing critical emphasis on the mechanics of State responsibility. Whether obscured by new technologies like the Internet, the sophisticated cellular structure of some terrorist organisations or convoluted political realities, the level of governmental involvement in terrorist activities is no longer readily discernible in every instance. Furthermore, the prospect of governments waging surrogate warfare through proxies also poses intractable challenges to the mechanism of attribution in the context of State responsibility. This monograph sets out the shortcomings of the extant scheme of State responsibility while identifying a paradigm shift towards more indirect modes of accountability under international law, a trend corroborated by recent State and institutional practice. Drawing on varied legal and theoretical influences, the study devises and prescriptively argues for the implementation of a strict liability-inspired model grounded in the logic of indirect responsibility with a view to enhancing State compliance with counterterrorism obligations. Moroccan Other-Archives investigates how histories of exclusion and silencing are written and rewritten in a postcolonial context that lacks organized and accessible archives. The book draws on cultural production concerning the “years of lead”—a period of authoritarianism and political violence between Morocco’s independence in 1956 and the death of King Hassan II in 1999—to examine the transformative roles memory and trauma play in reconstructing stories of three historically marginalized groups in Moroccan history: Berbers/Imazighen, Jews, and political prisoners. The book shows how Moroccan cultural production has become an other-archive: a set of textual, sonic, embodied, and visual sites that recover real or reimagined voices of these formerly suppressed and silenced constituencies of Moroccan society. Combining theoretical discussions with close reading of literary works, the book reenvisions both archives and the nation in postcolonial Morocco. By producing other-archives, Moroccan cultural creators transform the losses state violence inflicted on society during the years of lead into a source of civic engagement and historiographical agency, enabling the writing of histories about those Moroccans who have been excluded from official documentation and state-sanctioned histories. Focusing on the EPRDF regime over a period of three decades up to 2019, the book explores civic activism in Ethiopia, presenting diverse examples of how citizens have (re)shaped the country. The scale at which violent racial pasts have been incorporated into South African national historical narratives is lacking in the U.S. Desegregating the Past considers why this is the case, tracking the production and display of historical representations of racial pasts at museums in both countries and what it reveals about underlying social anxieties, unsettled emotions, and aspirations surrounding contemporary social fault lines around race. Robyn Autry consults museum archives, conducts interviews with staff, and recounts the public and private battles fought over the creation and content of history museums. Despite vast differences in the development of South African and U.S. society, Autry finds a common set of ideological, political, economic, and institutional dilemmas arising out of the selective reconstruction of the past.
