Drawing on extensive research from Australia, this book examines the experiences of sexual offence victims who submit a victim impact statement. Victim impact statements are used in sentencing to outline the harm caused to victims. There has been little research on the impact statement experiences of sexual offence victims. This book fills this gap, examining the perspectives of six adult female victims and 15 justice professionals in Australia. This is supplemented by analysis of 100 sentencing remarks, revealing how courts use such statements in practice. This book examines victims’ experiences of preparing and submitting statements, justice professionals’ experiences of working with victims to submit statements, and the judicial use of impact statements in sentencing. It identifies an overarching lack of clarity around the purpose of impact statements, which affects the information that can be included and the way they can be used by the court. It consequently explore issues associated with balancing the expressive and instrumental purposes of such statements, and the challenges in communication between professionals and victims of crime. The findings highlight several issues with the operation of impact statement regimes. Based on these findings, the book makes recommendations to clarify such regimes, to improve communication between justice professionals and victims of crime, and to enhance the therapeutic goals of such statements. Between 1867 and 2000, the Canadian government sent over 150,000 Aboriginal children to residential schools across the country. Government officials and missionaries agreed that in order to “civilize and Christianize” Aboriginal children, it was necessary to separate them from their parents and their home communities. For children, life in these schools was lonely and alien. Discipline was harsh, and daily life was highly regimented. Aboriginal languages and cultures were denigrated and suppressed. Education and technical training too often gave way to the drudgery of doing the chores necessary to make the schools self-sustaining. Child neglect was institutionalized, and the lack of supervision created situations where students were prey to sexual and physical abusers. Legal action by the schools’ former students led to the creation of the Truth and Reconciliation Commission of Canada in 2008. The product of over six years of research, the Commission’s final report outlines the history and legacy of the schools, and charts a pathway towards reconciliation. Canada’s Residential Schools: The Legacy describes what Canada must do to overcome the schools’ tragic legacy and move towards reconciliation with the country’s first peoples. For over 125 years Aboriginal children suffered abuse and neglect in residential schools run by the Canadian government and by churches. They were taken from their families and communities and confined in large, frightening institutions where they were cut off from their culture and punished for speaking their own language. Infectious diseases claimed the lives of many students and those who survived lived in harsh and alienating conditions. There was little compassion and little education in most of Canada’s residential schools. Although Canada has formally apologized for the residential school system and has compensated its Survivors, the damaging legacy of the schools continues to this day. This volume examines the long shadow that the residential schools have cast over the lives of Aboriginal Canadians who are more likely to live in poverty, more likely to be in ill health and die sooner, more likely to have their children taken from them, and more likely to be imprisoned than other Canadians. The disappearance of many Indigenous languages and the erosion of cultural traditions and languages also have their roots in residential schools.

It is easy to underestimate how little was known about crimes and victims before the findings of the National Crime Victimization Survey (NCVS) became common wisdom. In the late 1960s, knowledge of crimes and their victims came largely from reports filed by local police agencies as part of the Federal Bureau of Investigation's (FBI) Uniform Crime Reporting (UCR) system, as well as from studies of the files held by individual police departments. Criminologists understood that there existed a "dark figure" of crime consisting of events not reported to the police. However, over the course of the last decade, the effectiveness of the NCVS has been undermined by the demands of conducting an increasingly expensive survey in an effectively flat-line budgetary environment. Surveying Victims: Options for Conducting the National Crime Victimization Survey, reviews the programs of the Bureau of Justice Statistics (BJS.) Specifically, it explores alternative options for conducting the NCVS, which is the largest BJS program. This book describes various design possibilities and their implications relative to three basic goals; flexibility, in terms of both content and analysis; utility for gathering information on crimes that are not well reported to police; and small-domain estimation, including providing information on states or localities. This book finds that, as currently configured and funded, the NCVS is not achieving and cannot achieve BJS's mandated goal to "collect and analyze data that will serve as a continuous indication of the incidence and attributes of crime." Accordingly, Surveying Victims recommends that BJS be afforded the budgetary resources necessary to generate accurate measure of victimization.
