Music Borrowing and Copyright Law by Enrico Bonadio,Chen Wei Zhu Pdf

This ground-breaking book examines the multifaceted dynamics between copyright law and music borrowing within a rich diversity of music genres from across the world. It evaluates how copyright laws under different generic conventions may influence, or are influenced by, time-honoured creative borrowing practices. Leading experts from around the world scrutinise a carefully selected range of musical genres, including pop, hip-hop, jazz, blues, electronic and dance music, as well as a diversity of region-specific genres, such as Jamaican music, River Plate Tango, Irish folk music, Hungarian folk music, Flamenco, Indian traditional music, Australian indigenous music, Maori music and many others. This genre-conscious analysis builds on a theoretical section in which musicologists and lawyers offer their insights into fundamental issues concerning music genre categorisation, the typology of music borrowing and copyright law's ontological struggle with musical borrowing in theory and practice. The chapters are threaded together by a central theme, ie, that the cumulative nature of music creativity is the result of collective bargaining processes among many 'musicking' parties that have socially constructed creative music authorship under a rich mix of generic conventions.

Steal This Music by Joanna Teresa Demers Pdf

Is music property? Under what circumstances can music be stolen? Such questions lie at the heart of Joanna Demers’s timely look at how overzealous intellectual property (IP) litigation both stifles and stimulates musical creativity. A musicologist, industry consultant, and musician, Demers dissects works that have brought IP issues into the mainstream culture, such as DJ Danger Mouse’s “Grey Album” and Mike Batt’s homage-gone-wrong to John Cage’s silent composition “4’33.” Demers also discusses such artists as Ice Cube, DJ Spooky, and John Oswald, whose creativity is sparked by their defiant circumvention of licensing and copyright issues. Demers is concerned about the fate of transformative appropriation—the creative process by which artists and composers borrow from, and respond to, other musical works. In the United States, only two elements of music are eligible for copyright protection: the master recording and the composition (lyrics and melody) itself. Harmony, rhythm, timbre, and other qualities that make a piece distinctive are virtually unregulated. This two-tiered system had long facilitated transformative appropriation while prohibiting blatant forms of theft. The advent of digital file sharing and the specter of global piracy changed everything, says Demers. Now, record labels and publishers are broadening the scope of IP “infringement” to include allusive borrowing in all forms: sampling, celebrity impersonation—even Girl Scout campfire sing-alongs. Paying exorbitant licensing fees or risking even harsher penalties for unauthorized borrowing have become the only options for some musicians. Others, however, creatively sidestep not only the law but also the very infrastructure of the music industry. Moving easily between techno and classical, between corporate boardrooms and basement recording studios, Demers gives us new ways to look at the tension between IP law, musical meaning and appropriation, and artistic freedom.

Concepts of Music and Copyright by Andreas Rahmatian Pdf

Copyright specialists have often focused on the exploitation of copyright of music and on infringement, but not on the question of how copyright conceptualises music. This highly topical volume brings together specialists in music, musicology and copyright law, providing a genuinely interdisciplinary research approach. It compares and contrasts the concepts of copyright law with those of music and musical performance. Several tensions emerge between the ideas of music as a living art and of the musical work as a basis for copyright protection. The expert contributors discuss the notions of the musical work, performance, originality, authorship in music and in copyright, and co-ownership from the disciplinary perspectives of music, musicology and copyright law. The book also examines the role of the Musicians’ Union in the evolution of performers’ rights in UK copyright law, and, in an empirical study, the transaction costs theory for notice-and-takedown regimes in relation to songs uploaded on YouTube. This unique study offers an interdisciplinary perspective for academics, policymakers and legal practitioners seeking a state-of-the-art understanding of music and copyright law.

The Present and Future of Music Law by Ann Harrison,Tony Rigg Pdf

The music business is a multifaceted, transnational industry that operates within complex and rapidly changing political, economic, cultural and technological contexts. The mode and manner of how music is created, obtained, consumed and exploited is evolving rapidly. It is based on relationships that can be both complimentary and at times confrontational, and around roles that interact, overlap and sometimes merge, reflecting the competing and coinciding interests of creative artists and music industry professionals. It falls to music law and legal practice to provide the underpinning framework to enable these complex relationships to flourish, to provide a means to resolve disputes, and to facilitate commerce in a challenging and dynamic business environment. The Present and Future of Music Law presents thirteen case studies written by experts in their fields, examining a range of key topics at the points where music law and the post-digital music industry intersect, offering a timely exploration of the current landscape and insights into the future shape of the interface between music business and music law.

A Manual of Musical Copyright Law by Edward Cutler Pdf

Excerpt from A Manual of Musical Copyright Law: For the Use of Music-Publishers and Artists, and of the Legal Profession A treatise on musical copyright, combining the results of a refined musical training with those of a legal one, is, the author believes, without precedent, or nearly so; the fact that his antecedents enable him to realise this combination was brought to his notice by several influential musical publishers and induced him to commit his practical experiences to paper. It was pointed out that one who is exclusively a lawyer wants the personal contact with the publishing trade, which is necessary for explaining and adjusting the legal rights and obligations of composers, executants and publishers of music, both as between themselves and as between either of those three classes and the public. Such an one may easily overlook, or not quite grapple with, an infinity of subtle points likely to arise in business. He is not practically familiar with those niceties of trade which are only acquired by a series of personal dealings with music publishers, British and foreign, during many years. Not having the habit of closely analysing and dissecting melodic phrases, and relying merely on an untutored ear, he overlooks details of importance, with the result that he sees resemblances where the whole phrase, studied in its entirety, shows that none really exist; again, there are cases where the cultured musician would scent out an origin, common both to a supposed piratical copy of a given theme and to the theme itself; and the family likeness may be sufficiently definite to take away the right to complain of an infringement, but the mere lawyer, in such cases, might be misled into advising an action by the close similarity between the original phrase and the copy. Open Networks, Closed Regimes by Shanthi Kalathil,Taylor C. Boas Pdf

As the Internet diffuses across the globe, many have come to believe that the technology poses an insurmountable threat to authoritarian rule. Grounded in the Internet's early libertarian culture and predicated on anecdotes pulled from diverse political climates, this conventional wisdom has informed the views of policymakers, business leaders, and media pundits alike. Yet few studies have sought to systematically analyze the exact ways in which Internet use may lay the basis for political change. In O pen Networks, Closed Regimes, the authors take a comprehensive look at how a broad range of societal and political actors in eight authoritarian and semi-authoritarian countries employ the Internet. Based on methodical assessment of evidence from these cases—China, Cuba, Singapore, Vietnam, Burma, the United Arab Emirates, Saudi Arabia, and Egypt—the study contends that the Internet is not necessarily a threat to authoritarian regimes.
