Sea mines have been important in naval warfare throughout history and continue to be so today. They have caused major damage to naval forces, slowed or stopped naval actions and commercial shipping, and forced the alteration of strategic and tactical plans. The threat posed by sea mines continues, and is increasing, in today's world of inexpensive advanced electronics, nanotechnology, and multiple potential enemies, some of which are difficult to identify. This report assesses the Department of the Navy's capabilities for conducting naval mining and countermining sea operations.

Mine Warfare at Sea by Howard Levie Pdf

A study of the history of mine warfare at sea from the earliest days to the present time, this work should be of interest to military lawyers and to all those concerned with the conduct and control of warfare. At the technical level, it is intended for laymen. While there is a chapter dealing with many technical matters relating to both mine warfare at sea and mine countermeasures, the sole purpose of that chapter is to give the non-technician, whether naval officer or civilian, a basic understanding of various categories of sea mines and their accessories and of mine countermeasure gear.

The Oxford Handbook of International Law in Armed Conflict by Andrew Clapham,Paola Gaeta,Tom Haeck,Alice Priddy Pdf

Over the past ten years the content and application of international law in armed conflict has changed dramatically. This Oxford Handbook provides an authoritative and comprehensive study of the role of international law in armed conflict and engages in a broad analysis of international humanitarian law, human rights law, refugee law, international criminal law, environmental law, and the law on the use of force. With an international group of expert contributors, the Handbook has a global, multi-disciplinary perspective on the place of law in war. The Handbook consists of 32 chapters in seven parts. Part I provides the historical background of international law in armed conflict and sets out its contemporary challenges. Part II considers the relevant sources of international law. Part III describes the different legal regimes: land warfare, air warfare, maritime warfare, the law of occupation, the law applicable to peace operations, and the law of neutrality. Part IV introduces crucial concepts in humanitarian law: the use of weapons, proportionality, the principle of distinction, and internal armed conflict. Part V looks at rights issues: life, torture, fair trials, the environment, economic, social and cultural rights, the protection of cultural property, and the human rights of members of the armed forces. Part VI covers key issues in times of conflict: the use of force, terrorism, unlawful combatants, mercenaries, forced migration, and issues of gender. Part VII deals with accountability for war crimes, the responsibility of non-state actors, compensation before national courts, and, finally, transitional justice.

The Handbook of the International Law of Military Operations by Terry D. Gill,Dieter Fleck Pdf

The past decades have seen a remarkable development of military operations both within the United Nations collective security system and in other international settings. While traditional forms of military operations have been maintained and further developed, there have also been substantive developments, responding to new challenges for international security, the specific requirements of international and multinational cooperation, and legal regulation. Treaty law, customary law, and best practice relevant for military operations derive from various branches of international law which have to be applied in context. Cooperation between States and International Organizations has brought about a progressive development of applicable rules, and a requirement for legal control both at the national and international level. At the same time, the correct application of legal rules and best practice has become one of the benchmarks for the assessmentof military operations and failure to meet appropriate standards can have significant military and political, as well as legal, implications. This makes the identification and correct application of these rules of crucial importance in the planning and conduct of all types of military operations. Theabsence of an all-encompassing set of regulations and the need to find specific solutions for tasks characterized by an interdependence of efforts have made a reassessment of this important part of international law both a timely and topical task. Renowned international lawyers have joined together in this project to offer their insight in the relevant principles and provisions. They address important rules for enforcement, peace enforcement, and peace operations, as well as for other militaryoperations conducted within the context of self-defence and other possible legal bases for the use of force.
