Turkey’s accession to the European Union is undoubtedly one of the Union’s most contested potential enlargements. The narrative that dominates the debate surrounding this issue primarily relates to problems such as a lack of respect for fundamental human rights in Turkey, the Kurdish question and the continuing stalemate concerning northern Cyprus. This book looks at these issues, but also proposes that a review of Turkey’s experience with the EU in its numerous incarnations suggests that these concerns may mask a deeper disquiet. Whilst there are several questions that Turkey must address, particularly in the area of human rights guarantees, the concerns which raise debates regarding Turkish membership are not issues that are unique to Turkey. Turkey’s EU experience also raises fundamental questions about religion and the EU project that have greater implication than simply Turkish accession. Through the lens of the Turkish example, this book addresses these broader questions, such as the nature of European ‘identity’, Europe’s Christian past, the limits of pluralism and the fundamental question of religion in the European public sphere. Is it possible to identify the 'essence' of Ottoman kingship? And if so, what were the core motivating principles that governed the dynasty over its 600 year lifespan and how continuous and consistent were they? Following the death of the dynasty's eponymous founder Osman in 1324, 35 successors held the throne. Despite the wide range of character traits, dispositions and personal preferences, they led the expansion, stagnation and eventual collapse of the empire. Rhoades Murphey offers an alternative way of understanding the soul of the empire as reflected in its key ruling institution: the sultanate. For much of the period of centralized Ottoman rule between ca. 1450 and 1850 each of the dynasty's successive rulers developed and used the state bureaucratic apparatus to achieve their ruling priorities, based around the palace and court culture and rituals of sovereignty as well as the sultan's role as the head of the central state administrative apparatus. Sovereignty was attached to the person of the sultan who moved (with his court) both often and for prolonged stays away from his principal residence. In the period between 1360 and 1453 there were dual capitals at Bursa and Edirne (Adrianople) and even after 1453 several Ottoman sultans showed a preference for Edirne over Istanbul. Even Sultan Suleyman the Magnificent - held by the Ottomans, western contemporaries and modern analysts alike to be the pinnacle and paragon of Ottoman kingship - spent far more time away from his residence at the Topkapi Palace than in it. This book explores the growing complexity of the empire as it absorbed cultural influences and imperial legacies from a wide diversity of sources each in turn engendering a further interpretation of existing notions of kingship and definitions of the role and function of the ruler.

Do Member States of the EU have a free hand in drafting Accession Treaties, or are there legal constraints on their primary law-making powers in this regard? That is the main question this book addresses. It argues that such constraints do exist, and seeks to identify them, thereby providing a number of insights into the nature of the EU’s legal order. The point of departure as well as the main focus of the study is the proposed permanent safeguard clause (PSC) on the free movement of persons in the Negotiating Framework for Turkey. Legal provisions, rules, principles and norms that might constrain Member States in this regard are identified with reference to the PSC. The book examines constraints on Member States stemming from three sources of EU law: Association Law, based on the existing legal framework built on the EEC-Turkey Association Agreement (Part I); EU Enlargement Law, comprised of past practice and existing EU rules on enlargement (Part II); and the foundations of EU Constitutional Law (Part III), which constrain Member States whenever they act within the scope of Union law both as primary and secondary lawmakers. Part III reveals what the Court of Justice of the EU considers to be the essence or the ‘very foundations’ of the Union’s legal order, which it protects against encroachment. This is similar to what some constitutional courts do to protect the ‘inner unity’ or ‘basic structure’ of their constitutions. The findings of this book can be applied to the accession of any candidate state. It also sheds light on important implications for future treaty amendments, and for identifying possible limits to differentiated integration.
