If the captain were certain that he delivered all the bars that were shipped, and the stevadore' s foreman at the port of shipment could testify to the number of the bars shipped being the same as the number delivered, Mr. CORNER could not legally have been held liable for one shilling, notwithstanding the incorrect tally of the Mate. The tenor of the evidence before Mr. YARDLEY was in favour of the mate, in point of law, and led to the conclusion that the sum paid by Mr. Comma was the voluntary assumption of a debt, of the existence of which the court had no evidence; or, as Mr. YARDLEY said, the satisfaction of a demand which the shipowner was neither legally nor equitably bound to pay.
