Presumption of Death Act 2013 by Great Britain Pdf

Under the law of England and Wales the disappearance of a person does not affect the ownership or control of their property and affairs. In such circumstances it may be difficult or impossible for those left behind to obtain a death certificate if they believe the missing person must be dead. Without a death certificate, the missing person will for legal purposes generally be assumed to be alive. This Act will introduce into the law of England and Wales a new court based procedure enabling those left behind to obtain a declaration from the High Court that the missing person is to be deemed to have died. If the High Court has jurisdiction and the application is properly made by a person entitled to make it, the court will make the declaration if it is satisfied that the missing person has died or has not been known to be alive for a period of at least seven years. The court will send a copy of the declaration to the Registrar General for England and Wales when it can no longer be the subject of an appeal. The declaration will be conclusive as to the presumed death and effective for all purposes and against all persons. The missing person's property will pass to others in the same way as if the missing person had died and been certified dead in the normal way and his or her marriage or civil partnership will end as a marriage or civil partnership ends on death.

Missing Persons by Karen Shalev Greene,Llian Alys Pdf

A missing person is an individual whose whereabouts are unknown and where there is some concern for his or her wellbeing. In the UK, around 250,000 people are reported missing every year, with the majority being children under the age of 18. Despite the fact that missing persons are a social phenomenon which encompasses vast areas of interest, relatively little is known about those who go missing, what happens to them while they are missing, and what can be done to prevent these incidents from occurring. This groundbreaking book brings together for the first time ideas and expertise across this vast subject area into one interconnected publication. It explores the subjects of missing children, missing adults, the investigative process of missing person cases, and the families of missing persons. Those with no prior knowledge or professionals with focused knowledge in some areas will be able to expand their understanding of a variety of topics relevant to this field through detailed chapters which advance our understanding of this complex phenomenon, discuss what is unknown, and suggest the best and most important steps forward to further advance our knowledge.

Law at the Frontiers of Biomedicine by Shaun D Pattinson Pdf

How should judges and legislators address challenges arising at the frontiers of biomedicine? What if it became possible to edit the DNA of embryos for enhanced traits, gestate a fetus in an artificial womb, self-modify brain implants to provide new skills or bring a frozen human back to life? This book presents an innovative legal theory and applies it to future developments in biomedicine. This legal theory reconceptualises the role of legal officials in terms of moral principle and contextual constraints: 'contextual legal idealism'. It is applied by asking how a political leader or appeal court judge could address technological developments for which the current law of England and Wales would be ill-equipped to respond. The book's central thesis is that the regulation of human conduct requires moral reasoning directed to the context in which it operates. The link between abstract theory and practical application is articulated using future developments within four areas of biomedicine. Developments in heritable genome editing and cybernetic biohacking are addressed using Explanatory Notes to hypothetical UK Parliamentary Bills. Developments in ectogestation and cryonic reanimation are addressed using hypothetical appeal court judgments. The book will be of great interest to scholars and students of medical/health law, criminal law, bioethics, biolaw, legal theory and moral philosophy.
