Processing personal data under Art. 6.1.f GDPR by Mario Egbe Mpame Pdf

Essay from the year 2019 in the subject Law - Data protection, grade: N/A, , language: English, abstract: The goal of this article, as stipulated by its title, is to bring this complex notion to the understanding of every privacy stakeholder. The protection of personal data has been a major preoccupation of the European legislators in recent years. Apart from data protection being a fundamental Human Right, it is worth noting that almost all the other fundamental Human Rights rely on personal data. For instance, if a person’s personal data such as name, address, bank details and location falls into wrong hands as a result inappropriate data protection policies, the damages may range from financial losses to bodily harm-thus affecting the individual’s right to property, life et cetera. It is for these reasons that the General Data Protection Regulation lays down conditions under which personal data must be processed, grants a list of rights to data subjects and fixes very heavy fines that await defaulters. Among the lawful grounds for processing personal data, is the legitimate interest pursued by the controller. This ground is mostly used by online marketing companies. Considering that the GDPR gives no clear definition of "legitimate interest", this article provides a clear understanding of such interest, the circumstances under which it may arise, as well as a balancing exercise and guiding factors that would help in understanding whether the legitimate interest pursued by the controller actually overrides the fundamental rights and freedoms of the data subject-a precondition for processing personal data under such grounds.

The EU General Data Protection Regulation (GDPR) by Christopher Kuner Pdf

This new book provides an article-by-article commentary on the new EU General Data Protection Regulation. Adopted in April 2016 and applicable from May 2018, the GDPR is the centrepiece of the recent reform of the EU regulatory framework for protection of personal data. It replaces the 1995 EU Data Protection Directive and has become the most significant piece of data protection legislation anywhere in the world. The book is edited by three leading authorities and written by a team of expert specialists in the field from around the EU and representing different sectors (including academia, the EU institutions, data protection authorities, and the private sector), thus providing a pan-European analysis of the GDPR. It examines each article of the GDPR in sequential order and explains how its provisions work, thus allowing the reader to easily and quickly elucidate the meaning of individual articles. An introductory chapter provides an overview of the background to the GDPR and its place in the greater structure of EU law and human rights law. Account is also taken of closely linked legal instruments, such as the Directive on Data Protection and Law Enforcement that was adopted concurrently with the GDPR, and of the ongoing work on the proposed new E-Privacy Regulation.

Money Law, Capital, and the Changing Identity of the European Union by Gabriella Gimigliano,Valentino Cattelan Pdf

This book addresses 3 questions: is money a way to create a European Union identity? If so, which type of identity is this? And in what ways is the EU identity changing? The book brings together experts from a variety of backgrounds and academic approaches to analyse the law of money and payments on the one side, and the law of capital and investments on the other. The book is divided into 2 parts. Part I covers scriptural, electronic, and digital money. It analyses the European framework for payment services users, explores limits and challenges of the Banking Union, and looks at the project for a digital euro. Part II investigates the policy and regulatory drivers of the EU's changing identity, from the early modern roots of the European law of money and capital to the regulatory strategy set in the Capital Markets Union and the role conferred on venture capital; from the fintech-based developments of payment systems to the newly-established fiscal and monetary policies in the post-COVID phase. The book will be of interest to researchers, academics and policy makers in the fields of law and regulation, as well as political economy and political sciences.

China and Europe on the New Silk Road by Marijk van der Wende,William C. Kirby,Nian Cai Liu,Simon Marginson Pdf

The global order, based on international governance and multilateral trade mechanisms in the aftermath of the Second World War, is changing rapidly and creating waves of uncertainty. This is especially true in higher education, a field increasingly built on international cooperation and the free movement of students, academics, knowledge, and ideas. Meanwhile, China has announced its plans for a "New Silk Road" (NSR) and is developing its higher education and research systems at speed. In this book an international and interdisciplinary group of scholars from Europe, China, the USA, Russia, and Australia investigate how academic mobility and cooperation is taking shape along the New Silk Road and what difference it will make, if any, in the global higher education landscape. Opening chapters present the global context for the NSR, the development of Chinese universities along international models, and the history and outcomes of EU-China cooperation. The flows and patterns in academic cooperation along the NSR as they shape and have been shaped by China's universities are then explored in more detail. The conditions for Sino-foreign cooperation are discussed next, with an analysis of regulatory frameworks for cooperation, recognition, data, and privacy. Comparative work follows on the cultural traditions and academic values, similarities, and differences between Sinic and Anglo-American political and educational cultures, and their implications for the governance and mission of higher education, the role of critical scholarship, and the state and standing of the humanities in China. The book concludes with a focus on the "Idea of a University"; the values underpinning its mission, shape, and purpose, reflecting on the implications of China's rapid higher education development for the geo-politics of higher education itself.
