Public Procurement Reform and Governance in Africa by S.N. Nyeck Pdf

This book presents an interdisciplinary exploration of the governance of public procurement reform in Africa. Through a bottom-up approach to case studies and comparative analyses, scholars, practitioners, and social activists write about the organizational mechanisms and implementation gaps in public procurement governance in light of the general premises of national reform. Reforming the ways in which government purchases works, goods, and services from the private sector is one of the most sweeping policy reform undertaken in Africa in the past decade. Despite the transnational scope of policy change, very little is known about the mechanisms of public procurement governance at the subnational level. The argument in this volume is that policy reforms that mitigate contractual hazards along the three-dimensional “law-politics-business matrix” are more likely to bring about meaningful institutional transformation and broader social accountability. Key to substantive transformation of public procurement is the revitalization and professionalization of the public sector to meet the opportunities and challenges of development by contract.

Public Procurement, Corruption and the Crisis of Governance in Africa by Nirmala Dorasamy,Omololu Fagbadebo Pdf

This book establishes a nexus between corruption in public procurement and the prevailing crisis of governance in Africa. The African continent is characterised by the growing concern for the deteriorating human security. In the midst of these woes, African political leaders are known for their stupendous wealth and riches through expropriation of national resources for personal benefits. This growing inequality in the continent has become a major driver for a series of violent and criminal activities, which have added to the worsening governance crisis. Thus, the abuse of public power for advancing private gain constitutes an impediment to effective public service delivery, thereby engendering a crisis of governance. The consequence of this is not limited to the socio-economic growth and welfare of citizens, but it often also jeopardizes the democratic credentials and objectives of the state.

Public Procurement in South Africa by Mr. Alejandro Simone,Vybhavi Balasundharam Pdf

The 2015 Supply Chain Management Review lays out a sound agenda for procurement reform. The ongoing work on a new procurement bill and regulations are an important opportunity to spearhead procurement reform and step-up implementation. Several important reform aspects worth prioritizing are the simplification and standardization of aprocurement procedures, the standardization of transparency requirements through the adoption of the Open Contracting Data Standards, transitioning to a new e-procurement system that is linked to the government’s integrated financial management information system (IFMIS) and other systems, making preferential procurement more cost effective and goal oriented, and strengthening staff capacity to carry out procurement. Opportunities to centralize procurement should be further explored to leverage and develop limited capacity.

International Handbook of Public Procurement by Khi V. Thai Pdf

Since the 1990s, government at all levels is under increasing pressure to do more with less. However, despite the U.S. government spending about 15 to 20 percent of its GDP on contracts for goods and services, there is a paucity of reference books for public procurement officials and very few textbooks for courses on the subject. Filling this void, the International Handbook of Public Procurement provides the knowledge necessary to understand how procurement works and how to improve the cost-effectiveness of procurement systems. Taking a multidisciplinary approach, the book focuses on the managerial, economic, political, and legal aspects of this topic. It begins with a conceptual framework and highlights various reforms occurring in certain countries. By examining these improvements, readers are able to apply this knowledge to their own strategies. The next section presents selected cases that illustrate the public procurement process, examining systems in various nations including Germany, China, South Africa, Cambodia, Uganda, and Estonia. The book also discusses the rise of electronic procurement systems (E-procurement) and reviews the benefits of these efficient systems. Other topics presented in this comprehensive volume include practical discussions on contract negotiations, bidding, price strategies and cost analysis, and an insightful chapter on the market’s response to contract award announcements. A virtual encyclopedia from numerous international experts, this book was assembled by Khi V. Thai, Professor at Florida Atlantic University and Editor of the Journal of Public Procurement. Dr. Thai has provided technical assistance in the area of public procurement to governments across the world. Empowering those on all sides of the issue, this volume dispenses advice valuable to government officials and contractors, as well as providing a comprehensive text for public administration students.

Prevention of corruption at workplace. A nexus of good governance and effective procurement by David Rewayi Mpunwa Pdf

Academic Paper from the year 2020 in the subject Sociology - Work, Profession, Education, Organisation, , language: English, abstract: The desideratum of this discourse was to unpack the nexus of good governance, effective procurement and prevention of corruption at workplace. Money can corrupt the virtuous. Efficient public procurement is key to enhancing state portfolio in infrastructure, health, education and other public services, making it central to state efforts to enhance living standard. Efficient public procurement has a nexus with good governance. The questionnaire method was considered appropriate to collect and analyse data from the respondents. Different questionnaire and interviews were administered to every respondent. Collusion and corruption are distinct challenges within public procurement, yet they may regularly occur in tandem and have mutually added fuel to the fire impact. A good example of collusion and corruption is the alleged chain effect of the Fish rot scandal in Namibia. They are optimally perceived, therefore, as concomitant threats to the integrity of public procurement. Efficient public procurement is key to enhancing state portfolio in infrastructure, health, education and other public services, making it central to state efforts to enhance living-standards. Efficient public procurement has a nexus with good governance. However, state procurement in developing states is often plagued by high rates of corruption and waste. The public procurement process is governed by public procurement laws and regulations in all states and differs from one state to another. In South Africa, public procurement is enshrined in Section 217 and 33 of the constitution of the country. COMESA has developed a model strategy for public procurement reform to standardise procurement and tendering process which are done within the stock market.

"Public procurement law governs the acquisition of the goods and services that a state needs to fulfil its public functions. This area of law has seen tremendous development globally in recent years, and Africa is no exception. In many African countries there have been sweeping reforms in the regulatory regimes that govern public procurement. This trend shows no signs of slowing down.On the African continent, public procurement law is closely tied to pressing policy issues: from development plans to donor aid and international lending, to anti-corruption agendas and capacity challenges, to public finance management, enforceable remedies under the rule of law, and human rights. This book investigates a number of these themes to foster an understanding of public procurement law in the context of contemporary Africa."--Back cover.

Reforming the African Public Sector. Retrospect and Prospects by R.A. Ayee Pdf

Reforming the African Public Sector: Retrospect and Prospectsis an in-depth and wide-ranging review of the available literature on African public sector reforms. It illustrates several differing country experiences to buttress the main observations and conclusions. It adopts a structural/institutional approach which underpins most of the reform efforts on the continent. To contextualize reform of the public sector and understand its processes, dynamics and intricacies, the book examines the state and state capacity building in Africa, especially when there can be no state without an efficient public sector. In addition, the book addresses a number of theories such as the new institutional economics, public choice and new public management, which have in one way or another influenced most of the initiatives implemented under public sector reform in Africa. There is also a survey of the three phases of public sector reform which have emerged and the balance sheet of reform strategies, namely, decentralization, privatization, deregulation, agencification, co-production and public-private partnerships. It concludes by identifying possible alternative approaches such as developing a vigorous public sector ethos and sustained capacity building to promote and enhance the renewal and reconstruction of the African public sector within the context of the New Partnerships for Africa's Development (NEPAD), good governance and the Millennium Development Goals (MDGs).

The Challenges of Public Procurement Reforms by Annalisa Castelli,Gustavo Piga,Stéphane Saussier,Tünde Tátrai Pdf

Public procurement affects a substantial share of world trade flows, amounting to 1000 billion euros per year. In the EU, the public purchase of works, goods and services has been estimated to account on average for 16 percent of GDP. The novelty of this book is that it focuses on the new European Union Directives approved in 2014 by the EU Parliament. The book consists of original contributions related to four specific themes of interest to the procurers’ day-to-day role in modern public purchasing organizations – both economists and lawyers – allowing for relevant exchanges of views and “real time” interaction. The four sections which characterize the book are Life-cycle Costing in Public Procurement; Calculating Costs and Savings of Public Procurement; Corruption and Probity in Public Procurement and Public Procurement and International Trade Agreements: CETA, TTIP and beyond. These themes have been chosen for their current relevance in relation to the new European Public Procurement Directives and beyond. The original format features, as is the case with the first three volumes, an introductory exchange between leading academics and practitioners, from differing disciplines. It offers a series of sequential interactions between economists, lawyers and technical experts who supplement one another, so as to enrich the liveliness of the debate and improve the mutual understanding between the various professions. This essential guide will be of interest to policymakers, academics, students and researchers, as well as practitioners working in the field of EU public procurement.
