Peremptory International Law - Jus Cogens by Robert Kolb Pdf

Robert Kolb, one of the leading international scholars of his generation, offers a seminal survey of the question of peremptory international law. The author analyses and systemises different questions, such as: the typology of peremptory norms beyond the Vienna Convention on the Law of Treaties; here he distinguishes between 'public order' jus cogens and mere 'public utility' jus cogens. Furthermore, what about relative jus cogens, such as regional jus cogens norms or conventional jus cogens norms? What about some consequences of jus cogens breaches in the law of State responsibility: are they themselves jus cogens? Thus, can individual war reparations be renounced by lump-sum agreements? What happens if different jus cogens norms are in conflict? Is there a difference between the scope of jus cogens in inter-State relations and its scope for other subjects of law, such as the UN and its Security Council? Is jus cogens necessarily predicated on the concept of a hierarchy of norms? What is the exact extent of the peremptory nature of some rules? Sometimes, only the core of a principle is peremptory, while its normative periphery is not. Also, in the use of force, the peremptory character of the provision is compatible with agreements falling under the recognised exceptions, such as collective self-defence. These and other unusual questions are discussed in the present book.

The Sources of International Law by Hugh Thirlway Pdf

This new edition of Hugh Thirlway's authoritative text provides an introduction to one of the fundamental questions of the discipline: what is, and what is not, a source of international law. Traditionally, treaties between states and state practice were seen as the primary means with which to create international law. However, more recent developments have recognized customary international law, alongside international treaties and instruments, as a key foundation upon which international law is built. This book provides an insightful inquiry into all the recognized, or asserted, sources of international law. It investigates the impact of ethical principles on the creation of international law; whether 'soft law' norms come into being through the same sources as binding international law; and whether jus cogens norms, and those involving rights and obligations erga omnes have a unique place in the creation of international legal norms. It studies the notion of 'general principles of international law' within international law's sub-disciplines, and the evolving relationship between treaty-based law and customary international law. Re-examining the traditional model, it investigates the increasing role of international jurisprudence, and looks at the nature of international organisations and non-state actors as potential new sources of international law. This revised and updated book provides a perfect introduction to the law of sources, as well as innovative perspectives on new developments, making it essential reading for anyone studying or working in international law.

AAA Handbook on International Arbitration Practice by American Arbitration Association Pdf

Assembled from Dispute Resolution Journal - the flagship publication of the American Arbitration Association - the chapters in the Handbook have all, where necessary, been revised and updated prior to publication. The book is succinct, comprehensive and a practical introduction to the use of arbitration and ADR, written by leading practitioners and scholars. The Handbook has discussions of such topics as confidentiality in arbitration, tips for beginning practitioners, cultural issues in arbitration, and the contrast of civil and common law approaches. International forum selection is discussed, including whether national or regional centers are viable options, and how to save time and money in cross-border disputes. A range of other issues are discussed, such as interim and emergency relief, the use of a preliminary hearing letter, time-management techniques, and discovery and evidence. Ethical concerns are also discussed, including a comparison of arbitrator standards of conduct in international trade and investment disputes, dealing with arbitrator conflicts, and arbitrator disclosure standards. Finally, the work addresses the topics of damages and the review and enforcement of international arbitration awards, including interpretations under the New York Convention. The chapters were selected from an extensive body of writings and, in the main, represent world-class assessments of arbitration and ADR practice. All the major facets of the field are addressed and provide the reader with comprehensive and accurate information, lucid evaluations, and an indication of future developments. They not only acquaint, but also ground the reader in the field.

China's Global Engagement by Jacques deLisle,Avery Goldstein Pdf

" Assessing China's rapidly changing role on the international stage China is again undergoing a period of significant transition. Internally, China's leaders are addressing challenges to the economy and other domestic issues after three decades of dramatic growth and reforms. President Xi Jinping and other leaders also are refashioning foreign policy to better fit what they see as China's place in the world. This has included a more proactive approach to trade and related international economic affairs, a more vigorous approach to security matters, and a more focused engagement on international cultural and educational affairs. In this volume, China specialists from around the world explore key issues raised by a changing China’s interaction with a changing world. They chronicle China’s emergence as a more capable actor whose engagement is reshaping international affairs in many dimensions. These include: global currency and trading systems; patterns of cooperation and competition in technological innovation; economic and political trends in the developing world; the American-led security order in the Asia-Pacific region; the practice of international military and humanitarian intervention; the use of naval power; the role of international law in persistent territorial and maritime disputes in the East and South China Seas; the international human rights regime; the circulation of Chinese talent trained abroad; a more globalized film industry; and programs to reshape global cultural awareness about China through educational initiatives. Across these diverse areas, China’s capacity—and desire—to influence events and outcomes have risen markedly. The results so far are mixed, and the future trajectory remains uncertain. But across the wide range of issues addressed in this book, China has become a major and likely an enduring participant. "
