The aim of the book is to provide an account of the law of New Zealand relating to the sale of land. Such a contract is governed by the general law of contract, as is any other contract whatever its subject matter. The author has endeavoured to state the law in this book within a reasonable compass while including some discussion of the major subject areas which commonly arise. This is a matter of balance and individual judgment and others may disagree with the decisions I have made. Some areas of contract law, though applicable, arise infrequently in the present context and the law which applies is both no different from that applicable to any other form of contract and is fully discussed elsewhere in the New Zealand literature. On that basis, this book does not discuss areas such as illegality or mistake. Other matters, though also of general application, arise more frequently; in those cases, though there is full discussion elsewhere, the author thought it desirable to set out, albeit briefly, the principal tenets of the area. This accounts for the treatment of such matters as agency, misrepresentation, contract formation, and aspects of remedies. Other matters, such as title or settlement, are particular to this form of contact and require full discussion.
