Restructuring Regulation and Financial Institutions by James R. Barth,R. Dan Brumbaugh,Glenn Yago Pdf

Policy makers around the globe will find that Restructuring Regulation and Financial Institutions offers a cogent assessment of the contemporary regulatory environment in the U.S. financial markets, and a blueprint for action in evolving global financial markets. Financial markets are among the most highly-regulated markets in the world. Nevertheless, financial crises still occur, witness the U.S. savings-and-loan fiasco of the late 1980s and early 1990s, and the Mexican and East Asian Financial implosions of 1994 and 1997. What role does regulation play in stabilizing-or-destabilizing financial markets? Restructuring Regulation and Financial Institutions answers this question with incisive analysis of financial market regulation in the United States. Each paper considers how regulation enhances or impedes the efficiency of a particular financial sector, and is followed by comments by two or three noted experts. The result of this approach is a wealth of useful information that may be applied by policy makers contemplating the restructuring of regulations and financial institutions. The contributors to this volume are distinguished economists, many of whom have careers not just in business, government, or academia, but have held influential positions in all three. Such varied backgrounds enable the contributors to offer remarkable insights based on the best of theory and practice. Never before has understanding the workings of U.S. financial market regulation been so important to the development of world financial markets. The ramifications of financial regulation in the United States extend far beyond the nation's borders. World financial markets are undergoing dramatic change, driven by the rapid development and deployment of new technology that enables information-and money-to travel farther, faster. However, a Byzantine array of regulatory structures in the international arena hinders the development of efficient global financial markets. Policy makers around the world are attempting to address the issues by emulating the financial markets of the United States.

Restructuring the American Financial System by George G. Kaufman Pdf

In light of the periodic malfunctions in important sectors of the finan cial services industry in recent years, such as commercial banking, thrift institutions, and the securities market, numerous proposals have been developed for restructuring the financial system to improve both its safety and efficiency. Among the groups analyzing the performance of the financial system and recommending changes where necessary, has been the Shadow Financial Regulatory Committee. This Committee, which is described in greater detail in Chapter 1, consists of 12 independent banking experts from the academic and practitioner worlds that meet quarterly to analyze current developments in the financial services indus try and to make recommendations for improvements that would be in the public interest. The purpose of the Committee, its members, and a listing of policy statements are included in the Appendix. All but one of the chapters in this volume represent essays by indi vidual members of the Committee on issues discussed by the Committee at recent meetings and that, for the most part, resulted in policy state ments. They basically discuss the reasons for the policy statement adopted and place the issue in perspective. Where appropriate, the rele vant section of the respective policy statement is presented at the begin ning of each chapter. Each essay, however, reflects only the views of the individual author and not necessarily those of other members of the Committee or of the Committee as a whole.

Financial Regulation by Dimitri Vittas Pdf

During the 19802, dramatic changes took place worldwide in the area of financial regulation. Governments in both developed and developing countries implemented extensive regulatory reform, relaxing or removing those economic and structural regulations that inhibit innovation and stifle competition. In their place, they introduced or strengthened prudential, organizational, and protective controls intended to promote efficiency while also safeguarding stability and fairness in the financial system. This book analyzes the theoretical and practical arguments for and against different types of regulations, and reviews postwar experience with regulatory reform. Detailed case studies discuss the experiences of Japan, Indonesia, Chile, Malaysia, Norway, the US, Germany, the UK, Canada and Italy. The book also discusses extensively a number of important policy issues: the pace and sequence of financial liberalization; the handling of banking crises; the modes of bank restructuring; the scope of prudential regulation and supervision; the role of deposit insurance; the case for and against universal banking and financial conglomerates; and the use of holding company structures. This book is intended for policymakers, advisers, and researchers who seek to understand the advantages and disadvantages of different types of financial regulations and to determine the appropriate dimensions, pace, and sequence of regulatory reform in the financial sector.

Financial Regulation at the Crossroads by Panagiotis Delimatsis,Nils Herger Pdf

This book brings outstanding expertise and provides insightful perspectives from nineteen authors with diverse backgrounds, including officials from international organizations, national regulators, and commercial banking, as well as academics in law, economics, political economy, and finance. The authors not only shed light on the causes of the financial turmoil, but also present thoughtful proposals that contribute to the future policy debate, and discuss opportunities that financial services can offer in funding activities which raise standards of living through initiatives in microfinance, renewable energy, and food distribution. The contributions to this volume tackle several of the thorniest issues of financial regulation in a post-crisis environment, such as: the mechanics of contagion within the financial system and the role of liquidity; moral hazard when large financial institutions are no longer subject to the disciplinary effects of bankruptcy; bank capital requirements; management compensation; design of bank resolution schemes; a function-centric versus institution-centric regulatory approach; subsidization and compatibility of stimulus packages with EU rules on state aid; trade finance and the role of the GATS prudential carve-out; and the role of financial services in promoting human rights or combating climate change.

But the Kuchma presidency was clouded by dark rumors of corruption and even political murder, and, by 2004, the country was in full-blown political crisis. This book looks beyond these dramatic events and aims to identify the actual play of power in Ukraine.

Bank Recovery and Resolution by Sven Schelo Pdf

Bank Recovery and Resolution Second Edition Sven Schelo Since 2008, enormous efforts have been made worldwide to draft rules to prevent a reoccurrence of the devastating financial events of that year. In the process, bank business has been laid open to intense public and government scrutiny, and regulation of banking has grown to spectacular proportions. Prominent among the measures taken is the EU Bank Recovery and Resolution Directive (BRRD), which, together with the Single Resolution Mechanism (SRM) and the Single Resolution Fund, constitutes a crucial new pillar in the European Banking Union. Practitioners searching for orientation in what can readily be perceived as a ‘jungle’ have an urgent need for a clear and systematic description and analysis of these new rules, which are sure to have a massive impact on bank business from this time on, not only in Europe but also wherever European business is to be found. The solidly grounded analysis in this important book sets the new rules under BRRD into their full context as cross-border phenomena. With its crystal-clear explanation of key provisions, procedures, and ‘triggers’, the book organises a highly complex legal system into patterns and action plans that can be applied in virtually any eventuality likely to arise in cases where bank business is of central significance. Among the topics covered are the following: – entities covered by BRRD; – exceptions under BRRD; – objective and scope of BRRD tools – bail-in, bridge bank, sale of business, asset separation; – asset quality reviews; – curing or mitigating the continuing problem of non-performing loans; – new rules as response to lack of private solutions; – banks’ requirement to provide a minimum amount of eligible liabilities; – safety buffers to protect resolution; – need to be ‘resolvable’ in a worst case; – leverage and liquidity ratios; – forced mergers; – market spillover effects of recovery planning; – group recovery planning; – effects of foreign law contracts and assets; – write-down of capital instruments; and – special problems of cross-border restructuring. The presentation is enhanced by a comparative dimension, which includes reference to United States and other national developments and a full-scale analysis of Switzerland’s regulatory response to the crisis. Given that a full seamless global system of bank recovery and resolution has not yet been found, and that major banks are global players headquartered in different jurisdictions and even different continents, this book will greatly assist in the work of practitioners who must deal with cases involving international banking under the prevailing status quo. Its usefulness to officials and academics in international banking and finance law and policy, who are working towards a global solution, is of incalculable value.
