Assurance was a central issue for the eminent Scottish theologian-pastor Thomas Boston long before it emerged as a focal point of the theological debate in the Marrow Controversy. In The Marrow of Certainty, Chun Tse presents the first full-length study of Boston's theology of assurance in six dimensions: trinitarian, covenantal, Christological, soteriological, ecclesiastical, and sacramental. This work not only furnishes the first-ever intellectual biography of Boston in his Scottish context and controversies, but it also cross-studies the theology of the Marrow of Modern Divinity with Boston's notes. This research argues that Boston's doctrine of assurance centres on union and communion with Christ, the architectonic principle of his theology. The book challenges the common conception that Boston's theology merely follows Calvin, the Scots Confession, the Marrow, the Westminster Standards, and Scottish federalism. Boston, most strikingly, holds in tension assurance as intrinsic to faith—itself a gift from God's sovereignty in election—while insisting on self-examination as a human responsibility. This salient mark of his doctrine of assurance originates from his assertion that Christ died for the elect alone but all—elect or not—have the warrant to receive Christ. As such, assurance is, theologically, a divine gift and, pastorally, a human endeavour. Certainty is thus both extra nos and intra nos. Boston, this study reveals, has a potent and enduring power to speak on the perennial issue of assurance, rooted in the person of Christ, whom he considers as being the covenant itself.

Seals and their Context in the Middle Ages offers an extensive overview of approaches to and the potential of sigillography, as well as introducing a wider readership to the range, interest and artistry of medieval seals. Seals were used throughout medieval society in a wide range of contexts: royal, governmental, ecclesiastical, legal, in trade and commerce and on an individual and personal level. The fourteen papers presented here, which originate from a conference held in Aberystwyth in April 2012, focus primarily on British material but there is also useful reference to continental Europe. Gifts: A Study in Comparative Law is the first broad-based study of the law governing the giving and revocation of gifts ever attempted. Gift-giving is everywhere governed by social and customary norms before it encounters the law and the giving of gifts takes place largely outside of the marketplace. As a result of these two characteristics, the law of gifts provides an optimal lens through which to examine how different legal systems engage with social practice. The law of gifts is well-developed both in the civil and the common laws. Richard Hyland's study provides an excellent view of the ways in which different civil and common law jurisdictions confront common issues. The legal systems discussed include principally, in the common law, those of Great Britain, the United States, and India, and, in the civil law, the private law systems of Belgium and France, Germany, Italy, and Spain. Professor Hyland also serves a critique of the dominant method in the field, which is a form of functionalism based on what is called the praesumptio similitudinis, namely the axiom that, once legal doctrine is stripped away, developed legal systems tend to reach similar practical results. His study demonstrates, to the contrary, that legal systems actually differ, not only in their approach and conceptual structure, but just as much in the results.

In this classic study, Alan Brudner investigates the basic structure of the common law of transactions. For decades, that structure has been the subject of intense debate between formalists, who say that transactional law is a private law for interacting parties, and functionalists, who say that it is a public law serving the collective ends of society. Against both camps, Brudner proposes a synthesis of formalism and functionalism in which private law is modified by a common good without being subservient to it. Drawing on Hegel's legal philosophy, the author exhibits this synthesis in each of transactional law's main divisions: property, contract, unjust enrichment, and tort. Each is a whole composed of private-law and public-law parts that complement each other, and the idea connecting the parts to each other is also latently present in each. Moreover, Brudner argues, a single narrative thread connects the divisions of transactional law to each other. Not a row of disconnected fields, transactional law is rather a story about the realization in law of the agent's claim to be a dignified end-master of its body, its acquisitions, and the shape of its life. Transactional law's divisions are stages in the progress toward that goal, each generating a potential developed by the next. Thus, contract law fulfils what is incompletely realized in property law, negligence law what is germinal in contract law, public insurance what is seminal in negligence law, and transactional law as a whole what is underdeveloped in public insurance. The end point is the limit of what a transactional law can contribute to a life sufficient for dignity. Reconfigured and expanded with a contribution by Jennifer Nadler, The Unity of the Common Law stands out among contemporary theories of private law in that it depicts private law as purposive without being instrumental and as autonomous without being emptily formal.
