Just as music without silence collapses into cacophony, so speech without silence signifies nothing: silences are the invisible, inaudible cement that hold the entire edifice together. Though scholars across diverse disciplines have analyzed silence in terms of its contexts, sources, and functions, these insights have barely begun to make inroads in biblical studies. Utilizing conceptual tools from narratology and reader-response criticism, this study is an initial exploration of largely uncharted territory – the various ways that narrative intersections of speech and silences function together rhetorically in Luke’s Gospel. Considering speech and silence to be mutually constituted in intricate and inextricable ways, Dinkler demonstrates that attention to both characters’ silences and the narrator’s silences helps to illuminate plot, characterization, theme, and readerly experience in Luke’s Gospel. Focusing on both speech and silence reveals that the Lukan narrator seeks to shape readers into ideal witnesses who use speech and silence in particular ways; Luke can be read as an early Christian proclamation – not only of the gospel message – but also of the proper ways to use speech and silence in light of that message. Thus, we find that speech and silence are significant matters of concern within the Lukan story and that speech and silence are significant tools used in its telling.

This is the first book to offer an extensive cosmopolitan, cross-cultural insight into the perennial controversy over the use of improperly obtained evidence in criminal trials. It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely. Colonel Robin Evelegh retired from the British Army in 1977, having commanded his infantry battalion on separate tours at the Springfield Road police station in Belfast in 1972 and 1973. it struck him forcibly at the time that the Government's overall campaign to restore a peacetime level of order in Northern Ireland seemed doomed to failure, although most of the conditions that could be thought necessary for success- skilled and sensitive politicians, devoted civil servants and a disciplined army and police force- were present. This failure, it became clear, arose from faults in the constitutional framework for controlling the campaign against insurrection, and from shortcomings in the laws which laid down the operational rules for the Security forces to suppress terrorism and disorder. The constitutional faults meant that the government's campaign could not be managed effectively, and the shortcomings in the laws meant that a heavy political price had to be paid for draconian legal powers that were almost irrelevant, while the security forces were crippled by the lack of quite minor laws which would have made them effective, and which carried only a modest political penalty. The reasons for these uncertainties and inadequacies are complex. Colonel Evelegh analyses them ruthlessly, and makes their consequences clear - powerfully illustrating his thesis from personal experience in Northern Ireland, from the past, and from counter-insurgency campaigns of recent times. His remedies are argued in detail.
