Some Principles of the Real Property (Land Titles) Acts of Western Canada (Classic Reprint) by Harold Spencer Pdf

Excerpt from Some Principles of the Real Property (Land Titles) Acts of Western Canada Some time ago the author wrote out a criticism of a decision on the Acts and submitted it to a friend for his Opinion whether it was worth sending to one of the law magazines for publication. The Opinion received was that the article was too good for the purpose contemplated and was accompanied by a recommendation to attempt a book along the lines followed in the article. Hence these pages. One of the few cases containing any general enunciation of the principles underlying the Torrens Acts is Gibbs V. Messer, A. C. The 'case describes the main object of those Acts as being the limitation of examination of title to a single document, the registered owner's certificate of title. This statement can be developed and added to. It is with the same intention of confining the investigations of purchasers and the like to one document that a certificate of title is made conclusive evidence of a registered owner's estate or interest in his property and an unregistered instrument is rendered incapable of passing any estate or interest in land as against a purchaser or the like transacting with a registered owner in reliance on his certificate of title - the register even though actual notice of the instrument may have been received; unless to ignore the existence of the instrument would be tantamount to fraud. In short, the fundamental principle of the Acts is that everybody dealing with a regis tered owner of land is released from all Obligation to go behind the owner's certificate of title in order to test its validity or to go outside of the certificate in order to ascertain who, besides the registered owner, are interested in the pro perty and the nature and extent of the interests held. The Law of Mortgages of Real Estate by John Delatre Falconbridge Pdf

Excerpt from The Law of Mortgages of Real Estate: Including Mortgages Under the Land Titles System This book is in part a product of the lectures which I have given at Osgoode Hall since the year 1909, when the Law Society Of Upper Canada appointed me lecturer in equity in succession to the late Mr. Alfred E. Marsh, k.c. Some of the features of the book are due to the fact that it is intended for the use of students as well as practitioners. I have had the advantage of using, in addition to Mr. Marsh's notes, the material contained in the Treatise on the Law of Mortgages of Real Estate, published in 1899, by Mr. Edwin Bell, the present secretary of the Law Society, and the late Mr. Herbert L. Dunn. I have, however, departed so Widely from the arrangement adopted by the authors of that work and have to such an extent rewritten and added to their material that it has seemed proper, Mr. Bell being a consent ing party, that the present book Should appear under my name. The book contains references to the leading decisions in all the common law provinces. The Ontario statutory provisions relating to the subject have been quoted as a rule Without abbreviation, and references have been given to the English statutes, if any, from which they are derived, so as to afford to a practitioner in another province the means of readily comparing the Ontario and English statutes with those of his own province and of judging to what extent the numerous Ontario and English decisions are applicable to his Own pro vince. It is hoped therefore that the book will be a useful guide to the law of all the provinces other than Quebec. The Ontario Registry Act is fully discussed so far as it affects the question of priorities and the law of mortgages. A Letter on the Bill for Quieting Titles to Real Estate in Upper Canada, Addressed to the Hon. John A. Macdonald, Attorney-General for Upper Canada (Classic Reprint) by Oliver Mowat Pdf

Excerpt from A Letter on the Bill for Quieting Titles to Real Estate in Upper Canada, Addressed to the Hon. John A. Macdonald, Attorney-General for Upper Canada I am very glad to know that the Bill for Quieting Titles is to be carried through Parliament this Session as a Government measure. As I have taken great interest in the subject to which this Bill relates, and have given to it considerable attention, it has occurred to me that I may perhaps facilitate your work a little by stating my view of the evils which the Bill was designed to meet, and of the method by which the Bill proposes to remove them. When I first introduced the Bill you were good enough to express your iapproval of its principle and Object, and to go over its clauses with me very carefully and to sug gest to some of them amendments which I had great pleasure in adopting.
