Environmental Contracts:Comparative Approaches to Regulatory Innovation in the United States and Europe by Eric W. Orts,Kurt Deketelaere Pdf

Environmental regulation has come of age in recent decades as the blunt methods of command-and-control have been subjected to trenchant criticism from both economists and lawyers in the United States and Europe. As a result of this intellectual development, as well as continuing and increasing severity of environmental problems, there is a need for fresh thinking about regulatory methods that are rational from both economic and legal points of view. This book focuses on the viability of one particular regulatory innovation--the use of agreements or contracts for environmental regulation--as it has been practised in the United States and Europe. The various contributions explore the general idea that certain kinds of environmental problems may best be addressed through contracts among interested parties, including representatives of various levels of government, business, local community and employment representatives, and public interest groups. The parties get together to discuss a particular problem and then agree to an agreement or contract designed to address key issues and interests. At least in some situations, this approach may yield greater flexibility, stronger commitment, and more creative outcomes than traditional command-and-control regulation. Experiments in the use of environmental contracts have begun on both sides of the Atlantic, a fact which makes the comparative study offered here especially timely and valuable.

Superfund's Future by Katherine Probst Pdf

Reauthorization of the Superfund law continues to be a major source of controversy among political leaders and environmental activists. Some seek a major overhaul of the statute, arguing that considerable cleanup still needs to be done. Others oppose major changes, asserting that cleanup is almost complete. One of the most contentious issues in the debate is whether the taxes that once stocked the Superfund Trust Fund need to be reinstated. The answer depends in large part on how much money EPA will need to implement the Superfund program. To inform this discussion, the U.S. Congress asked Resources for the Future (RFF) to estimate the program's future costs. The results of this research are included in Superfund's Future, a book that will become an essential reference for all participants in the debate about one of the nation's most controversial environmental programs.

Taming Regulation by Robert T. Nakamura,Thomas W. Church Pdf

Despite three decades of vigorous efforts at deregulation across the government, regulation remains ubiquitous. It also continues to be unpopular because it forces individuals and businesses to do things—frequently costly and unpleasant things—that they don't want to do. If regulatory programs are to survive and remain effective, the challenge posed by their endemic unpopularity and political vulnerability must be met. Unlike much of the existing literature on regulation, Taming Regulation begins with the assumption that the government's capacity to utilize regulation as a policy tool is vital. The book examines the questions of how to make the inherently coercive aspects of regulation more politically acceptable in the present antiregulatory environment and how the legal and administrative challenges of reform in ongoing regulatory programs might best be approached. The authors explore these issues through a case study of administrative reform in the Superfund program. Chartered with an ambitious mission to clean up the nation's hazardous waste sites, Superfund was from its inception a uniquely aggressive and unpopular program. Yet despite the election in 1994 of a Republican Congress committed to fundamental changes in environmental regulation, the Superfund program weathered the storm and remains intact today. The authors credit this political and programmatic success to a series of artfully designed and orchestrated internal reforms that softened Superfund's implementation, thus increasing its political support while retaining its potent coercive tools. Taming Regulation provides a cautionary discussion of both the necessity and the difficulty of regulatory reform. It is essential reading for students of regulation and environmental policy, for practitioners contemplating reform of ongoing regulatory programs, and for those interested in the checkered history of Superfund.

National Environmental Policies by Martin Jänicke,Helmut Weidner Pdf

This book is a collection of systematically prepared case studies describing the environmental policy ofthirteen countriesin terms ofcapacity-building. Capacity for environmental policy and management, as the concept is used in this volume, has been defined broadly as a society's "ability (...) to devise and implement solutions to environmental issues as part of a wider effort to achieve sustainable development" (OECD). Since the late 1960s capacity-building in environmental policy and management can be observed across the world. It may have made insufficient progress as yet from an environmentalist point of view, but it has produced some remarkable results, and not only in the industrialised world. In the first chapter we present the conceptual framework that underlies the national case studies. In the course ofour research project the authors ofthe book met together twice to discuss this framework in the light of the national experi ences and to harmonise their approaches. In this way we have tried to offer more than a collection of individual and incoherent case studies, focusing only on specific environmental problems, institutions, actors, or instruments. The idea behind this book is to give a systematic, comparative overview ofthe fundamental conditions under which environmental policies is practised in selected countries.

A Better Planet by Daniel C. Esty Pdf

A practical, bipartisan call to action from the world’s leading thinkers on the environment and sustainability Sustainability has emerged as a global priority over the past several years. The 2015 Paris Agreement on climate change and the adoption of the seventeen Sustainable Development Goals through the United Nations have highlighted the need to address critical challenges such as the buildup of greenhouse gases in the atmosphere, water shortages, and air pollution. But in the United States, partisan divides, regional disputes, and deep disagreements over core principles have made it nearly impossible to chart a course toward a sustainable future. This timely new book, edited by celebrated scholar Daniel C. Esty, offers fresh thinking and forward-looking solutions from environmental thought leaders across the political spectrum. The book’s forty essays cover such subjects as ecology, environmental justice, Big Data, public health, and climate change, all with an emphasis on sustainability. The book focuses on moving toward sustainability through actionable, bipartisan approaches based on rigorous analytical research.
