The Family Relation, as Affected by Slavery by Charles K. Whipple Pdf

Excerpt from The Family Relation, as Affected by Slavery This volume has been ever since regarded as the best authority upon the subject of which it treats, and its accuracy and impartiality, so far as we know, have never been questioned. But in the lapse of so many years, changes and additions have been made to these laws; and to meet the want thence arising, Judge Stroud has published a second edition of his "Sketch of the Laws relating to Slavery," - "with some alterations considerable additions," in the autumn of the present year, 1856. This book therefore will show us, precisely and accurately, what Slavery is, as now established by law, and what authority every slaveholder is legally authorized to exercise. Such differences as exist between the statutes of the different States are carefully specified in the book; but a substantial resemblance exists between all the slave codes, sufficient fully to authorize the following general statement of What American Slavery is as established by Law. I. The master may determine the kind, and degree, and time of labor to which the slave shall be subjected. II. The master may supply the slave with such food and clothing only, both as to quantity and quality, as he may think proper or find convenient. III. The master may, at his discretion, inflict any punishment upon the person of his slave. IV. All the power of the master over his slave, may be exercised not by himself only in person, but by any one whom he may depute as his agent. V. Slaves have no legal rights of property in things, real or personal, but whatever they may acquire, belongs in point of law, to their masters. VI. The slave, being a personal chattel, is at all times liable to be sold absolutely, or mortgaged, or leased, at the will of his master. VII. He may also be sold by process of law for the satisfaction of the debts of a living, or the debts and bequests of a deceased master, at the suit of creditors or legatees. Southern Slavery and the Law, 1619-1860 by Thomas D. Morris Pdf

This volume is the first comprehensive history of the evolving relationship between American slavery and the law from colonial times to the Civil War. As Thomas Morris clearly shows, racial slavery came to the English colonies as an institution without strict legal definitions or guidelines. Specifically, he demonstrates that there was no coherent body of law that dealt solely with slaves. Instead, more general legal rules concerning inheritance, mortgages, and transfers of property coexisted with laws pertaining only to slaves. According to Morris, southern lawmakers and judges struggled to reconcile a social order based on slavery with existing English common law (or, in Louisiana, with continental civil law.) Because much was left to local interpretation, laws varied between and even within states. In addition, legal doctrine often differed from local practice. And, as Morris reveals, in the decades leading up to the Civil War, tensions mounted between the legal culture of racial slavery and the competing demands of capitalism and evangelical Christianity.

Key to Uncle Tom's Cabin by Harriet Stowe Pdf

Beecher Stowe received a fair amount of criticism about her so-called "misrepresentation" of slavery with her publication of Uncle Tom's Cabin in 1852. She published this volume the following year, in which she sought to prove the veracity of her portrayal of the institution by laying out her source materials, including eyewitness accounts. As with the novel, Beecher Stowe received tremendous support from many Northerners and abolitionists for this publication and drew heavy criticism from advocates of slavery, especially in the Southern states

The Regulations of Robbers by Christina Accomando Pdf

In The Regulations of Robbers, Christina Accomando examines legal, political, and literary discourses of slavery and resistance through the works of judges, lawmakers, and former slaves. She builds on the words of Harriet Jacobs - I regarded such laws as the regulations of robbers, who had no rights that I was bound to respect - and advocates a methodology of multiple perspectives, exposing the false neutrality of legal discourse and turning attention to stories that have been suppressed. Accomando analyzes Sojourner Truth (who initiated lawsuits and petitioned Congress) and Harriet Jacobs (who shaped her autobiography into legal critique) as legal actors who challenged nineteenth-century legal constructions of African Americans. She argues that laws governing slave behavior, racial identity, miscegenation, rape, reproduction, literacy, and property defined. African Americans as nonhumans, with dangerous sexuality and nonexistent subjectivity. She traces how nineteenth-century constructions of race and gender continue to inform modern policy discussions. Accomando's analysis of slavery and resistance reveals the entrenched racism in U.S. law and also points to concrete opportun
