The Requirement for an Invention in Patent Law by Justine Pila Pdf

The Requirement for an Invention in Patent Law provides a critical analysis of legal conceptions of the invention in UK patent law and under the European Patent Convention. Dr Justine Pila brings to this text her extensive experience in intellectual property law. A central theme of the book is that the requirement for an invention, properly construed, sets the boundaries of the patent system in two ways. The first is by defining the categories of subject matters capable of supporting a patent, and the second is by restricting the protection conferred by a patent to individual subject matters conceived qua inventions. In serving these functions, the requirement for an invention helps to fulfil the public benefit objectives of the patent system by mediating the balance struck by patents between individual patentees and the public. This book offers an analysis of legal conceptions of the invention in UK patent law and their development from before the first patent legislation of 1623 through the patent system's recent phase of Europeanization. It includes a detailed study of the contemporary (EPC) requirement for an invention and its construction by the European Patent Office, and an analysis of the legal and policy issues which that construction raises. It also places the UK and EPC law in its interpretive context, including its international statutory context, and offers a detailed account of international law-making in the field of patents. The Requirement for an Invention in Patent Law is an indispensible reference text for students and academics of intellectual property law in general and contemporary patent law in particular, and will appeal to anyone interested in Europeanization, international patent law and harmonization, and the history of the UK patent system. Its elucidation of this complex area also makes it an excellent guide for practitioners.

A Treatise Law of Patents by George Ticknor Curtis Pdf

Excerpt from A Treatise Law of Patents: For Useful Inventions, as Enacted and Administered in the United States of America The following work, the fruit of careful studies in a department of jurisprudence of great practical importance, is presented to the Profession, not without anxiety as to its reception. This branch of the law is so peculiar, the subjects with which it is concerned are so abstruse, and so much caution is requisite in dealing with its principles and in combining them into a system, that no writer can expect wholly to satisfy the wants of his readers, who does not bring to its treatment a force of intellect and a reputation as a jurist, which entitle him to be regarded in the light of an authority. But it cannot be my hope, as it is not my desire, to escape criticism. Looking upon the law as a science of vast practical consequence to mankind, and desiring to discharge my humble debt to its Profession, I shall gratefully receive, from any competent source, any suggestions of errors or imperfections in a work designed for practical use. A Treatise on the Law of Patents for Useful Inventions as Enacted and Administered in the United States of America by George Ticknor Curtis Pdf

Reprint of the fourth and final edition of one of the earliest American treatises on the subject. The Anglo-American tradition of granting patents has often been marked by confusion over their scope and intent. Reflecting, for example, on the fundamental question of whether patents create monopolies, juridical commentators and the bench had come down firmly both in favor and against the idea. Curtis argued that it did not according to the common law. Instead, a patent was a "grant by the government to the author of a new and useful invention, of the exclusive right, for a term of years, of practising that invention" (xxi). Better known for his Federalist interpretation of the Constitution, Curtis [1812-1894] was prominent New York patent attorney and the author of works on admiralty and equity jurisprudence.
