The Control of Trusts (Classic Reprint) by John Bates Clark Pdf

Excerpt from The Control of Trusts This book advocates a third course; namely, regu lating competition. It would cut off entirely an ab normal type of it by forbidding and repressing the cut throat Operations by which the trusts Often crush their rivals. Further, it would remove the special induce ment to such measures and thus create a condition in which competition of a tolerant kind would rule business life. It gives reasons for believing that this result can be reached with no disruption of the business system. The Control of Trusts by John Bates Clark Pdf

Excerpt from The Control of Trusts: An Argument in Favour of Curbing the Power of Monopoly by a Natural Method The purpose of this little book is a modest one. It does not attempt to duplicate work which has been well done by others. It contains no history of trusts and no description of the forms that they are now taking. It refers the reader to the works of Professors Jenks, Ely and Von Halle, and to the reports of the Industrial Commission, for facts concerning these consolidations and confines itself to the one object of advocating a certain definite policy in dealing with them. It is the policy that relies wholly on competition as the regulator of prices and wages and as the general protector of the interests of the public. It welcomes centralization, but aims to destroy monopoly, and to do this by keeping the field open to all independent producers who may choose to enter it. Truths by William Randolph Hearst Pdf

Excerpt from Truths: About the Trusts The trust question is a question of which we may truly say that it will never be settled until it is settled right, and it will never be settled right except by eliminating the evils of combination and retaining the benefits and advantages of combination. All the exponents of high finance or low finance, of big business or little business who affect to desire to see business activity encouraged and business conditions settled, must make up their minds to see first the trust question settled. If all those who profess to want to see business conditions settled will earnestly and honestly endeavor to have the trust question settled, an intelligent solution of the trust problem will be speedily secured. In any rightful and, consequently, in any permanent settlement of the trust problem, we have to consider the retention of the benefits of combination quite as much as the elimination of the evils attendant upon combination. Control of the Market by Bruce Wyman,Bruce Wyman, A.M., LL.B. Pdf

Excerpt from Control of the Market: A Legal Solution of the Trust Problem I have been advocating for many years the regulation of the trusts by law, rather than the persistence in the attempt to destroy by law these aggregations Of capital. For I have come to believe in the control by the State Of all businesses which have outgrown the regulation Of competition. I do not mean by this that the State should undertake to order the conduct Of all businesses, which it is apparent would be one form Of socialism. Regulation Of this extreme sort will be con fined to those businesses which are affected with a public interest. But it seems certain that other businesses than those now within this classification will eventually be brought within it. And the thesis will be defended in these pages that all businesses which have a virtual monopoly, firmly established in the nature of things, are so affected with a public interest as to be within the class Of callings which are considered public em ployments. What branches Of industry will. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Trusts of To-Day by Gilbert Holland Montague Pdf

Excerpt from Trusts of to-Day: Facts Relating to Their Promotion, Financial Management and the Attempts at State Control Called into greater prominence the regulation of trusts by the law. Economists and legislators have suggested a multitude of statutory reme dies. The Industrial Commission, after careful investigation and criticism, recommended in its Final Report to Congress in 1902 certain specific measures. In 1903 Congress enacted, in the Elkins Law and in the Nelson Amendment to the Department of Commerce Act, two of the better recommended and less radical of these remedies. The acute realisation among investors of the real evils of trusts, and the sober criticism. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Trusts for Business Purposes (Classic Reprint) by William C. Dunn Pdf

Excerpt from Trusts for Business Purposes In all probability no part of our law is so well settled as that in reference to trusts and trustees; a rule on this subject laid down in one section of the country is usually adopted and ap plied in another. The reason for this is readily found in that the principles underlying the trust are the same throughout the country irrespective of state lines. This of course is not true of the corporation, for each state has its own acts and no state is bound by the interpretation of the corporate law of a sister state. The Law Relating to Trusts and Trustees (Classic Reprint) by Arthur Underhill Pdf

Excerpt from The Law Relating to Trusts and Trustees In this Work the author has endeavoured to follow out the thought expressed by these great lawyers by extracting and formulating the principles of the law of Private Trusts in the form of a Code. By way of illustration all the important modern decisions, and such of the more ancient ones as are retained in the Revised Reports, are cited; so that the reader is enabled to see, at a glance, what the author conceives to be the law the principle) governing any particular point; he is then further presented with a series of decided cases which prove, illustrate, and explain the application of that principle; and further, in the foot notes, he is referred to other authorities if he desires to make an exhaustive search. Concentration and Control by Charles R. Van Hise Pdf

Excerpt from Concentration and Control: A Solution of the Trust Problem in the United States This book is one of opportunism. Its aim is to present an outline picture of the situation regarding concentration of industry in the United States, and to suggest a way to gain its economic advantages and at the same time to guard the interests of the public. The book is written because this is the most pressing problem now before the people and before Congress and state legislatures. No other problem is likely to have so large discussion in the political campaign now waging. If this book has the good fate to assist in the rule of enlightenment, reason, fair play, mutual consideration, and toleration, and thus advance the solution of the problem, the author will have been repaid many fold for his labor in its preparation. The scope of the treatment does not include the public utilities. They are only considered in so far as their development and control throw light upon the other industries. The reader who is familiar with trust literature will recognize the influence of Ely's "Monopolies and Trusts," Jenks's "The Trust Problem," von Halle's "Trusts or Industrial Combinations of the United States," Ripley's "Trusts, Pools, and Corporations," Montague's "Trusts of To-day," Nolan's Combinations, Trusts, and Monopolies," Collier's "Trusts," Wyman's "Control of the Market," and Macrosty's "Trust Movement in British Industry." Aside from these standard works, the most important sources of information in presenting a picture of the situation as it is at the present time are the special reports on manufactures in 1905 by the Census Office, reports of the Commissioner of Corporations upon Standard Oil, tobacco, steel, beef, lumber, and water powers, and the hearings and reports before the committees of the Sixty-second Congress. Select Cases and Other Authorities on the Law of Trusts (Classic Reprint) by Austin Wakeman Scott Pdf

Excerpt from Select Cases and Other Authorities on the Law of Trusts IN 1882 Professor James Barr Ames published the first edi tion of his collection of Cases on Trusts; in 1893 he published a second edition. This book is far more than a mere collee tion of cases. In its analysis of the subject and in its exten sive annotations it has been a notable contribution to legal scholarship. It has frequently been the guide of courts and of legal writers. It has determined the scope of the course on Trusts as it is taught today in the law schools of the United States. More than a quarter of a century, however, has elapsed since the appearance of the second edition of Professor Ames's book. There has been a considerable development of the sub ject in this time. Certain changes in emphasis and in arrange ment have become necessary. The subjects of resulting and constructive trusts, which were not treated in the second edi tion of Ames's Cases, and the subject of charitable trusts, which was not treated in either edition, are of great importance. In these subjects, and indeed in all the subjects treated herein, there has been during the last twenty-five years a wealth of new material from which to draw. The editor cannot adequately express the great debt that he owes to Professor Ames under whom he had the privilege of studying for three years. Only those who have had the same privilege can realize the extent of that debt. The matter con tained in Ames's Cases and also the invaluable ms. Notes which Professor Ames was accustomed to take with him to the class room have been put at the editor's disposal. The editor has reprinted many notes contained in Ames's Cases, as corrected and supplemented by his ms. Annotations, chiefly those notes which are of historical interest, or which relate to controverted points. The source of these notes is duly indicated. It is impossible to indicate the extent to which many of the other notes are due to suggestions derived from Professor Ames. The Trust Problem (Classic Reprint) by Edward Dana Durand Pdf

Excerpt from The Trust Problem The recent rapid growth of trusts has so focussed public attention that the importance Of pools is Often overlooked. The number of pools has been, and still remains, far greater than the number of trusts. They probably affect a larger volume of business. Many of the arguments as to the effects Of combinations, their advantages and disadvantages, which apply to trusts, do not apply to pools.
