The Courts and the Colonies offers a detailed account of a protracted dispute arising within a Hutterite colony in Manitoba, when the Schmiedeleut leaders attempted to force the departure of a group that had been excommunicated but would not leave. This resulted in about a dozen lawsuits in both Canada and the United States between various Hutterite factions and colonies, and placed the issues of shunning, excommunication, legitimacy of leadership, and communal property rights before the secular courts. What is the story behind this extraordinary development in Hutterite history? How did the courts respond, and how did that outside (state) law relate to the traditional inside law of the Hutterites? Utilizing voluminous court records, Esau provides a detailed and fascinating narrative of the prolonged disputes and litigation history of Hutterite colonies at Lakeside, Oak Bluff, Rock Lake, and Huron. He considers whether the legal action was consistent with the historic non-resistance of Hutterites or whether it signaled a fundamental change in norms of Anabaptist perspectives on litigation. He examines the past history of Hutterite litigation, and how the roots of the schism related to controversy over the Schmiedeleut leadership and its alliance with the Bruderhof, a group of Christian communalists, living mainly in the Eastern United States. At stake is the nature of freedom of religion in Canada and the extent to which our pluralistic society is prepared to accommodate the existence of groups that have an illiberal legal system that may not cohere with the outside legal system of the host society. Excerpt: ...in the same capacities as in the subsequent case, whether they were similarly ranged, as regards the point in dispute, as plaintiffs and defendants in the two cases or not (I); (4) if the decision was made by a Court having co-equal jurisdiction with the Court trying the subsequent case, both as regards the pecuniary limit of its jurisdiction and as to the subject-matter of the case, to try it with conclusive effect (to); and (5) if the matter was heard and finally decided () by such Court, --the decision being one tending to and forming a necessary element of the decree, whether it was expressly set out therein or not, and being unalterable by such Court, except on review. The rule may be stated still more concisely in the following terms: --An adjudication, to be res judicata, must be "secundum allegata et probata," and, when it conforms to this principle, its objective elements, as embodied in the final concrete command, will form a conclusive bond of relation between the parties. The means or process by which it is arrived at may be erroneous; as, for instance, when the decision turns on the truth of a certain deposition or the construction of a certain law, the evidence may have been appreciated wrongly, or the law misapplied. In another case the same evidence may be weighed differently and the same law interpreted otherwise; but the individual constitution of a right and duty, derived from such materials, as ascertained by a Judge exercising final jurisdiction, will practically create and settle the precise relation as found and laid down by him. Why did Africans bring their most intimate domestic disputes to the newly created native courts in the period after 1905? And what do these disputes tell us about everyday life and social change? To answer these questions, Roberts uses all 2,062 civil disputes heard at the provincial level native courts for four districts between 1905 and 1912. He concludes that changes in social relations occurring at a time of accelerated change associated with colonial conquest and the end of slavery interacted with institutional changes, namely the creation of the new native courts, to produce discernible patterns of litigation. Moreover, these patterns of litigation point to "trouble spots" in African society, thus providing a lens into the most ordinary aspects of daily life. This book is divided into two parts: following an important theoretical and methodological introduction to the use of the court records as social history, the first three chapters examine the context in which the colonial legal came into being in 1903. The second part examines the evidence generated by court records into the struggles between former slaves and former masters in the immediate aftermath of the end of slavery, the "trouble spots" of marriage and divorce, bridewealth disputes, disputes over new forms of property in a post-slave holding era, and disputes over inheritance. These chapters concentrate on cases brought by women or dealing with women.
