Cyber Law is a comprehensive guide for navigating all legal aspects of the Internet. This book is a crucial asset for online businesses and entrepreneurs. "Whether you're doing business online as a company or a consumer, you need to understand your rights. Trout successfully places legal complexities into digital perspective with his latest book." -- Chris Pirillo - Founder of Lockergnome "CyberLaw is a must-read for anyone doing business-or just chatting or socializing - on the Internet. Without us realizing it, more and more laws are being passed each year, laws and restrictions that significantly increase the likelihood that you're skirting, or even breaking some laws when you post that restaurant review, write about the bad date you had last week, or complain about a previous employer. Your choices are easy: read CyberLaw or suffer the potential consequences." -- Dave Taylor, Entrepreneur and Strategic Business Consultant, Intuitive.com "Brett Trout has the bottom-line, honest, insightful, straightfowardest, most clear-headed take on intellectual property issues you could want. He's your way out of the maze." -- John Shirley, scriptwriter and author Now at the New York Public Library! "This book is a quick read and serves as an introduction to the basic issues involved in Internet marketing. Cyber Law's details provide valuable clues..." --Martha L. Cecil-Few The Colorado Lawyer "One of the biggest misconceptions ... involves fair use. People mistakenly think they can freely use the work of others in their blogs or YouTube videos, for example." Commonwealth Caribbean Business Law by Natalie Persadie,Rajendra Ramlogan Pdf

Commonwealth Caribbean Business Law breaks away from the traditional English approach of treating business law primarily as the law of contract and agency. The book takes a panoramic view of the foundation of various legal systems with a subsequent examination of different areas of legal liability that may affect business activities. These areas include contract law, agency, tort law, criminal law, and internet law as significant challenges confronting the business sector. The book primarily targets the development of business law in several Caribbean Commonwealth jurisdictions but also, where appropriate, embraces the jurisprudence of other Commonwealth nations such as the United Kingdom, Canada and Australia. With respect to internet law, the proliferation of judicial pronouncements emerging from the United States provided the platform for the only non-Commonwealth treatment of a topic. The approach of the book is to use excerpts from judgments so as to allow students, particularly the non-legal student, to understand legal principles as espoused by the judiciary without the filtering bias of authors.

Facebook and the (EU) Law by Philippe Jougleux Pdf

The past two decades have seen a radical change in the online landscape with the emergence of GAFAM (Google, Amazon, Facebook, Apple and Microsoft). Facebook, specifically, has acquired a unique monopoly position among social media, and is part of the digital lives of billions of users. A mutual influence between Facebook and the legal framework has gradually emerged, as EU legislators and judges are on the one hand forced to accept the reality of new, widespread behaviors and practices and on the other have constructed a legal framework that imposes limits and rules on the use of the social network. This book offers a unique perspective on this relationship, exploring the various activities and services proposed by Facebook and discussing the attendant legal issues. Accordingly, questions concerning the GDPR, its principles, rights and obligations are in the center of the discussions. However, the book does not limit its scope to data protection: Facebook has also greatly contributed to a liberalization and democratization of speech. In accordance, the classic principles of media law must be revisited, adapted or suitably enforced on the platform. Intellectual property law governs what is owned and by whom, no matter whether raw data or informational goods are concerned. Frameworks on hate speech and fake news are the result of coregulation principles of governance, whereas defamation jurisprudence continues to evolve, considering the consequences of merely “liking” certain content. The economic model of advertising is also governed by strict rules. Above all, Facebook is currently caught in a dilemma of substantial interest for society as a whole: is it a neutral online intermediary, i.e., merely a passive player on the Internet, or is it transforming against its will into an editorial service? In conclusion, the book has a dual purpose. First, it proposes a global and practical approach to the EU legal framework on Facebook. Second, it explores the current limits and the ongoing transformation of EU Internet law as it steadily adapts to life in the new digital world.

Intellectual Property and Private International Law by Josef Drexl,Annette Kur Pdf

The relationship between intellectual property and private international law is a fascinating and multi-faceted one. Both fields are inherently international, but it is the exponential increase in conflicts involving trans-border elements, in a world characterised by global trade and borderless communication structures, that has, in modern times, drawn the two disciplines close. The essays contained in this book, first presented at a Symposium in Munich, set out possible visions for a future system of international and regional jurisdiction and applicable law that is better adapted to the increasingly supranational character of IP rights. A second feature of the book is its treatment of 'harmonisation' of choice-of-law issues. Framed by these two elements - international jurisdiction on the one hand and perspectives for harmonised choice of law rules in an international context on the other - specific European themes are also addressed; jurisdiction, the establishment of a European judiciary in the patent field, the relationship between regional (European) systems and an international jurisdiction convention, and the recent proposal for a Regulation on applicable law in non-contractual relationships (Rome II).
