The European Union in International Organisations and Global Governance by Christine Kaddous Pdf

The European Union is a key participant in international organisations with its involvement taking different forms, ranging from full membership to mere observer. Moreover, there is also not only one status of observer, but different ones depending on the constituent charters of the organisations. This book provides a comprehensive overview of the participation of the EU in five international organisations: the UN, the ILO, the WTO, the WHO and the WIPO. It identifies its role and influence in diverse areas of global governance, such as foreign policy, peace, human rights, social rights, trade, health and intellectual property. EU and international experts, diplomats and scholars have contributed to this book to give an overview of the different aspects linked to the participation of the EU in these organisations and to the coordination that takes place internally with its Member States. They also examine the EU's actual influence in the various areas and its contribution to global governance. The combination of these two dimensions allows the work to identify the strengths and weaknesses of the participation of the EU in these five international organisations. The book provides valuable insights for scholars, policymakers and is useful for representatives of other international organisations and civil society actors.

The EU's Role in Global Governance by Bart Van Vooren,Steven Blockmans,Jan Wouters Pdf

For years the European Union has been looked on as a potential model for cosmopolitan governance, and enjoyed considerable influence on the global stage. The EU has a uniquely strong and legally binding mission statement to pursue international relations on a multilateral basis, founded on the progressive development of international law. The political vision was for the EU to export its values of the rule of law and sophisticated governance mechanisms to the international sphere. Globalization and the financial crisis have starkly illustrated the limits of this vision, and the EU's dependence on global forces partially beyond the control of traditional provinces of law. This book takes stock of the EU's role in global governance. It asks: to what extent can and does the EU shape and influence the on-going re-ordering of legal processes, principles, and institutions of global governance, in line with its optimistic mission statement? With this ambitious remit it covers the legal-institutional and substantive aspects of global security, trade, environmental, financial, and social governance. Across these topics 23 contributors have taken the central question of the extent of the EU's influence on global governance, providing a broad view across the key areas as well as a detailed analysis of each. Through comparison and direct engagement with each other, the different chapters provide a distinctive contribution to legal scholarship on global governance, from a European perspective.

Global Governance through Trade by Jan Wouters,Axel Marx ,Dylan Geraets,Bregt Natens Pdf

A 'new generation' of EU trade policies aims to advance public goods - such as promoting sustainable development, protecting human rights and enhancing governance in third states. The pursuit of these objectives raises important questions regarding coherence, effectiveness, legitimacy and extraterritoriality. In Global Governance through Trade leading scholars from different disciplines address these topical questions. The book contains a comprehensive analysis of the concept of governing through trade and investigates how the EU ‘exports’ regulation through conditional market access regulation, bilateral trade agreements and unilateral trade policy. Several case studies complement the general analysis and provide an in-depth assessment of the European Union's new trade policies. This multidisciplinary book will be an enlightening read for a wide-ranging audience encompassing academics, policymakers, policy analysts and students of, amongst others, trade law and policy, global governance, sustainable development, human rights and labor standards.

Networks of Global Governance by Francesco Petrini Pdf

Including several contributions from an international group of historians and experts of international relations, this book analyses the relationship between the United Nations and European integration. The book, which covers from 1945 to the present, is organised into three sections, each dedicated to a different phase of the integration process, during which EU-UN relations had a different character. The essays of the first section deal with the 1950s and 1960s and show the active part played by UN bodies in shaping the integration process. In the second part, covering the 1970s and 1980s, it is the European Community which is shown to have had a visible impact on the life and the decision-making process of several UN bodies. Finally, the third part of the book, on the post-Cold War years, describes a more complex situation, characterised by new geopolitical responsibilities of the European Union, but also by its deep internal transformations due to several treaty revisions and the enlargement to Eastern Europe. Thus, dynamics similar to those described in the first section return, with UN bodies shaping some of the internal rules of the EU, but these coexist with strengthened European activity in the United Nations, in some cases leading to real partnerships.

The European Union and the United Nations in Global Governance by Madeleine O. Hosli Pdf

Written by a leading expert in the field, this book analyses the complex relations between the European Union (EU) as a regional organization and the United Nations (UN) as an international, global governance institution. The book explores how collaboration between the EU and the UN has evolved and how the two entities collaborate both structurally and in day-to-day work. It shows how the EU acts within institutions such as the United Nations General Assembly and how UN agencies, funds and entities, such as UNHRC, UNICEF and UN Women, interact with the EU and its member states. Through its analysis, the book demonstrates how, despite recent criticism, patterns of multilateralism and cooperation between regional and international institutions can be central to stable patterns of rules-based regional and global governance.

National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law by Anneli Albi,Samo Bardutzky Pdf

This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.
