Excerpt from The Excellent Priviledge of Liberty and Property: Being a Reprint and Fac-Simile of the First American Edition of Magna Charta, Printed in 1687 Under the Direction of William Penn The little volume which contained the first American issue of the Charter is entitled The Excellent Priviledge of Liberty and Property: being the Birth-right of the Free-bom Subjects of England. Besides extensive extracts fi'om the Charter and Coke's Comments thereon, it contains the confirmation of the charters of the liberties of England and of the Forest, made in the twenty-fifth year of Edward I.; a statute made in Edward's thirty-fourth year, commonly called De Tallagr'o non coucedendo an abstract of the Royal Charter Of Pennsylvania; and the Charter of liberties granted by William Penn to the fiee men of his province. It was printed by William Bradford, who, in 168 5, had introduced the art of printing into the Middle Colo nies of North America; but it was undoubtedly prepared for the press by William Penn, then in England; for David Lloyd, in 1728, quoted the book as the work of Penn in A Defence of the Legislative Constitutions of the Province of Pennsyl vania. Moreover, Mr. Hildebum, in his Press of Pennsyl vania, has pointed out that Lloyd was then (1728) attomey general of the Province; and, as the latter had been on fi'icndly terms with Penn, as early as 1687, his unchallenged statement is conclusive. Liberty, one of the most consequential words in our language, is one of the most treasured concepts in American thought—and one of the most intensely debated. Its meaning is constantly shifting, changing not only from one culture to another but also, over time, within the same culture. No two definitions of liberty seem alike. In this subtle and illuminating work Michael Kammen traces the evolving concept of liberty throughout American history and provides a solid framework for understanding the meaning of the term today. He shows that by the early seventeenth century a tension between liberty and authority was well recognized. Throughout the eighteenth century and especially during the American Revolution a bond between liberty and property was asserted. By the end of the eighteenth century this concept of liberty was so well established that it remained dominant throughout the nineteenth. By the early twentieth century, as the notion of social justice gained prominence, liberty and justice were paired frequently, and by midcentury the two had become allied to general American values. Since the 1960s the union of liberty and equality has been the prevailing notion and achieving them has proved a major objective. In a lively and learned manner Kammen also shows that Americans have subscribed to different definitions of liberty concurrently. Above all, there has been a steady expansion of what is embraced by the concept of liberty. This expansion has created difficulties in public discourse, causing groups to misunderstand one another. On the other hand, interpretations of liberty have broadened to include such concepts as constraints on authority, a right to privacy, and the protection of personal freedoms. In a new preface for this Banner Books edition, Kammen responds to evaluations of earlier editions and places his views within the context of more recent studies.

Analyzing the rise and subsequent fall of international piracy from the perspective of colonial hinterlands, Mark G. Hanna explores the often overt support of sea marauders in maritime communities from the inception of England's burgeoning empire in the 1570s to its administrative consolidation by the 1740s. Although traditionally depicted as swashbuckling adventurers on the high seas, pirates played a crucial role on land. Far from a hindrance to trade, their enterprises contributed to commercial development and to the economic infrastructure of port towns. English piracy and unregulated privateering flourished in the Pacific, the Caribbean, and the Indian Ocean because of merchant elites' active support in the North American colonies. Sea marauders represented a real as well as a symbolic challenge to legal and commercial policies formulated by distant and ineffectual administrative bodies that undermined the financial prosperity and defense of the colonies.
