The National Interest on International Law and Order by R. James Woolsey Pdf

International law and the nature of the global order is regularly examined and debated among specialists. This volume brings together in one place twenty-four articles addressing these subjects, written by some of America's leading academics, lawyers, and policymakers, and originally published in The National Interest, a leading realist journal of international affairs.Prominent jurists, lawyers, and practitioners debate the role that international law should play in the formulation of policy in the first section, and whether 'international law' really exists. Authors explore such questions as the enforceable norms of global behavior, and if American foreign policy should conform to such regulations. A second section looks at the viability and utility of international institutions in advancing U.S. interests. Included are debates over the role and purpose of the United Nations and the International Criminal Court. A third Section deals with the intersection of law enforcement and foreign policy. It explores such questions as whether primary responsibility for combating global terrorism and the international drug trade should be vested with law enforcement agencies or whether it should fall under the purview of foreign policy. The final portion of the book is devoted to the question of human rights, particularly the tripartite debate between Robin Fox, Francis Fukuyama, and William F. Schulz over the nature and origins of human rights. Among the questions considered are whether human rights are an outgrowth of natural law, or are natural imperatives at odds with protecting individual dignities and freedoms. Is there a universal standard of rights, or are human rights norms derived from majority consensus? The list of distinguished contributors to this volume include John Bolton, Robert Bork, Lee Casey, Douglas Feith, Owen Harries, Senator Jesse Helms, Alan Keyes, Irving Kristol, Joseph Nye, Jeremy Rabkin, David Rivkin, Alfred P. Rubin, and Abrahama Sofaer. This volume will be of interest to legal scholars, political scientists, and students of diplomacy and international relations.

National Interest and International Solidarity by Jean-Marc Coicaud,Nicholas J. Wheeler Pdf

Following the end of the cold war, the 1990s witnessed an intense period of geopolitical upheaval. Humanitarian intervention became an important tool for powerful nations and international coalitions trying to alter the course of unstable countries plunged into chaos. The motivations for these interventions and their implementation have generated heated policy debates ever since. This book has its origins in the intellectual and political climate of that time. The contributors analyze the arguments and counterarguments used in the debates over humanitarian intervention, then extrapolate their findings to a broader international context. In short, the book assesses the extent to which national interest and internationalist considerations enter into the rationale for actors to get involved in international crises.

International Law: Politics and Values by Louis Henkin Pdf

This volume derives from a series of lectures delivered as the `general course' at the Hague Academy of International law in July 1989. Like those lectures, this volume does not pretend to provide a complete treatise covering all international law. Rather, it offers a particular perspective on the principal subjects of traditional international law, elaborates new developments, and dares reexamine assumptions and premises. The book is built on three themes. The first addresses law as politics, and international law as the law of a political system, now comprised of more than 180 separate, independent states. The essential autonomy of states accounts for the political (as well as economic and cultural) heterogeneity in a pluralist and fragmented system, and international law as its common denominator of normative expression. A second theme explores change in international law as reflecting change in the values and purposes of the international political system. It traces the pursuit through law of the traditional ideal of the state system to secure every state's right to realize its own agenda through its own institutions, and the superimposed contemporary purpose to promote individual human rights and welfare in every society. The third theme perceives a movement in the law from `conceptualism' to `functionalism', from logical deduction out of abstract principles to pragmatic attention to practical needs and solutions to new and old human problems. Each of these themes dominates in several chapters but the other themes are not absent from any of them. Each will add a fresh perspective and contribute to understanding the nature and operation of international law in the international political system at the turn of a new century.

Controversies in Globalization by Peter M. Haas,John A. Hird Pdf

Debate style readers can be powerful teaching tools, but only if the readings really speak to one another; otherwise, the crux of the debate is lost on students. Peter M. Haas and John M. Hird's Controversies in Globalization solves this issue by inviting 17 pairs of scholars and practitioners to write specifically for the volume, directly addressing key questions in international relations through concise "yes" and "no" pieces on topics related to security, political economy, the environment, public health, democracy, demography, and social issues. At the request of reviewers, new to this edition are three chapters covering the financial crisis, maritime security, and international conflict. Chapter headnotes written by the editors effectively frame each debate and make clear what is at stake from both theoretical and practical perspectives. Concluding discussion questions in each chapter encourage critical thinking and analysis.

The Power and Purpose of International Law by Mary Ellen O'Connell Pdf

The world is poised for another important transition. The United States is dealing with the impact of the Afghan and Iraq wars, the use of torture and secret detention, Guantanamo, climate change, nuclear proliferation, weakened international institutions, and other issues related directly or indirectly to international law. The world needs an accurate account of the important role of international law and The Power and Purpose of International Law seeks to provide it. Mary Ellen O'Connell explains the purpose of international law and the power it has to achieve that purpose. International law supports order in the world and the attainment of humanity's fundamental goals of peace, prosperity, respect for human rights, and protection of the natural environment. These goals can best be realized through international law, which uniquely has the capacity to bind even a superpower of the world. By exploring the roots and history of international law, and by looking at specific events in the history of international law, this book demonstrates the why and the how of international law and its enforcement. It directly confronts the notion that international law is "powerless" and that working within the framework of international law is useless or counter-productive. As the world moves forward, it is critical that both leaders and their citizens understand the true power and purpose of international law and this book creates a valuable resource for them to aid their understanding. It uses a clear, compelling style to convey topical, informative and cutting-edge information to the reader.
