The creation of the Ministry of Justice by Great Britain: Parliament: House of Commons: Constitutional Affairs Committee Pdf

The creation of the Ministry of Justice made significant changes to the Lord Chancellor's responsibilities, which may affect, in practice or public perception, the core responsibility of being the guardian of judicial independence. This report looks at the way these changes were made and finds the Government underestimated the significance of the changes it announced. The lack of sufficient consultation led to a public conflict between the senior judiciary and the previous Lord Chancellor, which could have been avoided if the lessons from the way changes to the Lord Chancellor's office were announced and effected between 2003 and 2005 had been learnt.

Crime, Law and Justice in New Zealand by Greg Newbold Pdf

Crime, Law and Justice in New Zealand examines the recent crime trends and the social, political, and legal changes in New Zealand from the end of the twentieth century to the present. Serving as the only New Zealand–specific criminal justice text, this book takes a direct look at what is unique about the country’s criminal justice system and recent crime trends. Crime rates peaked in the early 1990s and have fallen since. Newbold considers why this happened through factors such as economy, ethnic composition, changing cultural trends, and legislative developments in policing and criminal justice. He unpacks various types of crime separately—violent crime, property crime, drug crime, gang crime, organised crime, etc.—and examines each in terms of the various complex factors affecting it, using illustrative examples from recent high-profile cases. The cover photo for Crime, Law and Justice in New Zealand was taken by Jono Rotman.

The Budget and Structure of the Ministry of Justice by Great Britain: Parliament: House of Commons: Justice Committee Pdf

In the five years since the Ministry of Justice was created, it has made improvements to its structure and performance and is now a more integrated Department. However, the Ministry is still too much in thrall to the prison service: better integrated offender management would enable the Ministry to make the financial savings demanded of it but also provide a more effective service to clients, users and the wider public, and in particular to achieve its key objective to reduce re-offending. The Ministry has been subject to past criticism for poor financial management - missing the Treasury's deadline for the laying of accounts three years running, woeful inefficiency in the administration of legal aid and too much focus on policy at the expense of delivery. Following an in-depth investigation into all aspects of the Department's work, the Committee concluded that the Ministry has got a grip of the situation and is justifying the rationale for its creation. However, the MPs believe the Department could undergo further restructuring to create a single delivery body. Additionally, the current structure of the National Offender Management Service (NOMS), which continues to be driven by prison priorities, produces difficulties in reducing re-offending. The Committee also makes a number of further recommendations to improve how the Department functions

National Audit Office - Ministry of Justice and National Offender Management Service - HC 735 by Great Britain: National Audit Office Pdf

The current strategy for the prison estate in England and Wales has provided good quality accommodation, suitable for decades to come for prisoners with a wide range of security categorizations. The strategy is also a significant improvement in value for money over the short-term and reactive approaches of the early and middle 2000s. However, the strategy has resulted in the closure of several prisons that were performing well, and their performance has not yet been matched by new establishments. Some prisoners still routinely share cells, some of them in overcrowded conditions. The strategy understandably focuses on cost reduction and, by 2015-16, it will have resulted in total savings of £211 million, with further savings accruing at a rate of £70 million a year thereafter. However, decision-making has sometimes traded good quality and performance for greater savings. The Ministry of Justice and NOMS use good forecasts of prisoner numbers and have good contingency plans to help them implement changes to the estate, for example responding effectively to an unexpected spike in prisoner numbers after the riots in 2011. NOMS could free up more spare capacity if prisoners serving indeterminate sentences had more access to accredited courses the completion of which might reduce their risk of causing harm sufficiently to allow the Parole Board to release them. The report also points out that the Home Office removes over 1,000 foreign national offenders from the UK every quarter but, for a number of reasons, is currently removing fewer than in 2009

Ministry of Justice: Government Response to the Justice Committee's Second Report of Session 2013-14: Female Offenders - Cm. 8729 by Great Britain: Ministry of Justice Pdf

In this response to the Justice Committee following their inquiry into female offenders, the Ministry of Justice sets out plans to establish an open unit at HMP Styal and test this approach, set up community employment regimes across the estate to improve more women's access to jobs for their release, and create strategic hubs in order to improve closeness to home in certain regions. In addition to this, for the first time, all women will receive support through-the-gate and 12 months supervision on release as part of the Transforming rehabilitation reforms. NOMS' Stocktake of Community Services for Female Offenders shows that the spread and availability of community services specifically for women has been increasing. This sets the groundwork for the expansion of community support to women on release from short-sentences in 2014 and beyond. Efforts to divert women from custody where it is appropriate to do so also continue. The Ministry is also introducing legislation through the Offender Rehabilitation Bill to ensure that the Secretary of State enters into contracts with probation providers that identify and consider the particular needs of female offenders. To this end guidance is being issued so that probation providers fully understand the particular needs of female offenders and how to meet those needs.

Ministry of Justice financial management by Great Britain: Parliament: House of Commons: Committee of Public Accounts Pdf

The Ministry of Justice delivers its services through a wide range of arm's length bodies and agencies, including the courts, prisons and probation services. The Ministry's Spending Review settlement requires a 23% reduction to its resource budget over the next four years. The Ministry has a range of financial management processes in place but lacks a consistent approach across its business, and to date it has not integrated financial management into its policy and operational workings. The Ministry needs to implement its Spending Review settlement on the basis of a full understanding of the cost and value of its services, so that financial cuts are best targeted to minimise the impact on frontline services. The Ministry and its arm's length bodies currently lack the detailed information they would need to do this. A comprehensive understanding of the costs and value of services must be a priority. For its arm's length bodies, having a clear direction, the details of which are formally agreed by both parties, is essential as is strong leadership and a shared sense of purpose. The Ministry now needs to oversee the performance of its arm's length bodies, such as framework documents, operational reviews, and accountability meetings. Fee recovery and fines collection have to be priority areas for improvement and the need to improve recovery rates where it does not currently recover the full cost of services provided. On fines collection, there was little sign of the sustained improvement promised when the Committee last took evidence in 2006.

Ministry of Justice and National Offender Management Service: Managing the Prison Service - HC 1001 by Great Britain: Parliament: House of Commons: Committee of Public Accounts,Margaret Hodge Pdf

The National Offender Management Service (the Agency) is responsible for the prison system in England and Wales which holds around 84,000 prisoners. The prison estate consists of some 130 prisons of varying layout, geographical location, age and state of repair. The main factor behind the Agency's estate strategy, of closing small costly prisons and building new accommodation that is cheaper to run, is the need to make recurring savings. Under the strategy, the Agency had by the end of 2013, closed 13 prisons and built two new prisons. The estate strategy's objectives are to reduce resource costs; create durable, good standard accommodation and provide an estate that better meets offenders' needs, allowing more of them to work and be kept closer to their homes. Against these objectives, the Agency has built new, good quality, accommodation to time and within budget; is on track to achieve cost reductions of £70 million a year; and is starting to match better the geographical spread of prisons to the prison population. Key factors behind this good performance are that senior staff in the Agency have experience and knowledge and have remained in post throughout this period of change. However, the performance of the two new prisons, HMP Oakwood and HMP Thameside, has been poor and disappointing since they opened. They do not give sufficient priority to meeting offenders' rehabilitation needs, nor do they provide enough quality purposeful activity for prisoners. The Agency has also closed some prisons that were performing well.

This is the latest in a series of reports to the Joint Committee on Human Rights setting out the Government's position on the implementation of adverse human rights judgments from the European Court of Human Rights (ECtHR) and the domestic courts. It covers the period 1 August 2012 to 31 July 2013. The main focus of this paper is on two particular types of human rights judgments: judgments of the ECtHR in Strasbourg against the United Kingdom under the European Convention on Human Rights (ECHR); and declarations of incompatibility by United Kingdom courts under section 4 of the Human Rights Act 1998. A feature of these judgments is that their implementation may require changes to legislation,4 policy or practice, or a combination thereof

The Deacon's Ministry of Charity and Justice by William T. Ditewig Pdf

The deacon's exercise of charity and justice extends the loving hand of God's constant love and mercy to all who are in need. The Vatican's Congregation for Catholic Education has called this work "the ministry most characteristic of the deacon." In The Deacon's Ministry of Charity and Justice, Deacon William Ditewig focuses on this ministry as a constitutive element of the nature of the Church itself--always flowing from the ministries of Word and Sacrament and leading back to them, never apart from them. Along with a rich exploration of the scriptural, historical, and theological foundation of the deacon's practice of charity and justice, Deacon Ditewig--one of today's foremost experts on the permanent diaconate--develops specific and concrete principles for exercising these ministries faithfully, authentically, and effectively. The Deacon's Ministry series explores the three fundamental diaconal ministries identified in the teaching of Vatican II: those of the liturgy, of the word, and of charity to the people of God (Lumen Gentium 29). This series, written by three highly regarded permanent deacons, offers a rich combination of theology, spirituality, and practical and effective guidance. Deacons and those in diaconal formation, their families, the bishops and priests they work with, and the people they serve will welcome it.
