Substance and Procedure in Private International Law by Richard Garnett Pdf

When the law of a foreign country is selected or pleaded by a claimant or defendant, a question arises as to whether the issue pertains to substance, in which case it may be resolved by foreign law, or procedure, in which case it will be governed by the law of forum. This book examines the distinction between substance and procedure questions in private international law, and analyses where and whether each is appropriate. To do so, it examines previous attempts to define the scope of procedure in private international law, considers alternative choice of law methods for referring matters to the law of forum, and examines the influence of the doctrine of characterization on procedure. Substance and Procedure in Private International Law also provides detailed analysis of the decisional law in which the substance-procedure distinction has been employed, creating a clear assessment of its application in various practical situations and providing valuable guidance for practitioners on how the distinction should be applied. The book also considers 'procedural' topics such as service of process and the taking of evidence abroad, in order to show how the application of forum law may further be limited by foreign laws. With a foreword by the Hon Sir Anthony Mason.

Limitations of Actions in Conversion and Detinue by Manitoba. Law Reform Commission Pdf

This project originates from the Manitoba Law Reform Commission's Limitations report, published in October 2010. In the Limitations report, the Commission identified what it saw as the primary areas of Manitoba limitations law requiring modernization, and the best ways of accomplishing that goal. The Commission recommended the abolition of various categories of claims and favoured a single, basic two-year limitation from the date of discovery, applicable to all claims unless they are otherwise dealt with in the new Act. The Commission also recommended an ultimate 15-year limitation period running from the day on which the act or omission on which the claim is based took place, beyond which no claim may be brought. This system, designed around a single basic two-year limitation period and a 15-year ultimate limitation period, will be referred to in this report as the "standard limitation regime".

The Canadian Regime by Patrick Malcolmson,Richard Myers,Gerald Baier,Tom Bateman Pdf

Now in its sixth edition, The Canadian Regime continues to provide the most accessible introduction to the institutions, processes, and principles of the Canadian political system. The book's focus on the inner logic of parliamentary government explains the rationale for Canada's relatively complex political system, which the authors encourage readers to think of as an organic entity, where change in one area inevitably ripples through the rest of the system. The new edition includes the results of Canada's 2015 federal election and looks ahead to consider changes resulting from the Liberal victory. It has been thoroughly updated and revised and introduces several new topics, such as the impact of the previous Conservative government on the conventions and practices of parliamentary government and the important influence of social media on politics. Two new co-authors, Gerald Baier and Thomas M.J. Bateman, join Patrick Malcolmson and Richard Myers to bring new expertise in the areas of federalism, judicial politics, Charter jurisprudence, political parties, and the ongoing health care debate.

Closing the Enforcement Gap by Leah Faith Vosko Pdf

The nature of employment is changing: low wage jobs are increasingly common, fewer workers belong to unions, and workplaces are being transformed through the growth of contracting-out, franchising, and extended supply chains. Closing the Enforcement Gap offers a comprehensive analysis of the enforcement of employment standards in Ontario. Adopting mixed methods, this work includes qualitative research involving in-depth interviews with workers, community advocates, and enforcement officials; extensive archival research excavating decades of ministerial records; and analysis of a previously untapped source of administrative data collected by Ontario’s Ministry of Labour. The authors reveal and trace the roots of a deepening "enforcement gap" that pervades nearly all aspects of the regime, demonstrating that the province’s Employment Standards Act (ESA) fails too many workers who rely on the floor of minimum conditions it was devised to provide. Arguably, there is nothing inevitable about the enforcement gap in Ontario or for that matter elsewhere. Through contributions from leading employment standards enforcement scholars in the US, the UK, and Australia, as well as Quebec, Closing the Enforcement Gap surveys innovative enforcement models that are emerging in a variety of jurisdictions and sets out a bold vision for strengthening employment standards enforcement. A Legal History of Adoption in Ontario. 1921-2015 by Lori Chambers Pdf

Lori Chambers' fascinating study explores the legal history of adoption in Ontario since the passage of the first statute in 1921. This volume explores a wide range of themes and issues in the history of adoption including: the reasons for the creation of statutory adoption, the increasing voice of unmarried fathers in newborn adoption, the reasons for movement away from secrecy in adoption, the evolution of step-parent adoption, the adoption of Indigenous children, and the growth of international adoption. Unlike other works on adoption, Chambers focuses explicitly on statutes, statutory debates and the interpretation of statues in court. In doing so, she concludes that adoption is an inadequate response to child welfare and on its own cannot solve problems regarding child neglect and abuse. Rather, Chambers argues that in order to reform the area of adoption we must first acknowledge that it is built upon social inequalities within and between nations.
