Equitable Compensation and Disgorgement of Profit by Simone Degeling,Jason NE Varuhas Pdf

This collection of essays interrogates significant issues at the forefront of scholarship and legal practice in the field of money remedies in equity. Chapters address the contentious and developing field of equitable compensation, including: the nature of equitable compensation; the relevant causation inquiry for equitable compensation; whether notions of contribution apply to multiple agents; accessorial liability; the role of discretion in limiting equitable compensation; which wrongs yield equitable compensation; and the extent to which compensation in equity differs from money remedies at common law. Other chapters examine the remedy of disgorgement of profit, and specifically the theoretical basis of that remedy, its application in the context of fiduciary obligations, and third-party issues. A number of chapters also examine the interrelationship between loss- and gain-based money relief. In addressing these issues the book includes both doctrinal and theoretical perspectives, and brings together leading equity scholars and judges from across the common law world.

A History of Canadian Legal Thought by R.C.B. Risk Pdf

This volume in the Osgoode Society's distinguished series on the history of Canadian law is a collection of the principal essays of Professor Emeritus R.C.B. Risk, one of the pioneers of Canadian legal history and for many years regarded as its foremost authority on the history of Canadian legal thought. Frank Scott, Bora Laskin, W.P.M. Kennedy, John Willis and Edward Blake are among the better known figures whose thinking and writing about law are featured in this collection. But this compilation of the most important essays by a pioneer in Canadian legal history brings to light many other lesser known figures as well, whose writings covered a wide range of topics, from estoppel to the British North America Act to the purpose of legal education. Written over more than two decades, and covering the immediate post-Confederation period to the 1960s, these essays reveal a distinctive Canadian tradition of thinking about the nature and functions of law, one which Risk clearly takes pride in and urges us to celebrate.

Joining the Clubs by J. Andrew Ross Pdf

How did a small Canadian regional league come to dominate a North American continental sport? Joining the Clubs: The Business of the National Hockey League to 1945 tells the fascinating story of the game off the ice, offering a play-by-play of cooperation and competition among owners, players, arenas, and spectators that produced a major league business enterprise. Ross explores the ways in which the NHL organized itself to maintain long-term stability, deal with its labor force, and adapt its product and structure to the demands of local, regional, and international markets. He argues that sports leagues like the NHL pursued a strategy that responded both to standard commercial incentives and also to consumer demands that the product provide cultural meaning. Leagues successfully used the cartel form—an ostensibly illegal association of businesses that cooperated to monopolize the market for professional hockey—along with a focus on locally branded clubs, to manage competition and attract spectators to the sport. In addition, the NHL had another special challenge: unlike other major leagues, it was a binational league that had to sell and manage its sport in two different countries. Joining the Clubs pays close attention to these national differences, as well as to the context of a historical period characterized by war and peace, by rapid economic growth and dire recession, and by the momentous technological and social changes of the modern age.
