We the People by Erwin Chemerinsky Pdf

"This work will become the defining text on progressive constitutionalism — a parallel to Thomas Picketty’s contribution but for all who care deeply about constitutional law. Beautifully written and powerfully argued, this is a masterpiece." --Lawrence Lessig, Harvard Law School, and author of Free Culture Worried about what a super conservative majority on the Supreme Court means for the future of civil liberties? From gun control to reproductive health, a conservative court will reshape the lives of all Americans for decades to come. The time to develop and defend a progressive vision of the U.S. Constitution that protects the rights of all people is now. University of California Berkeley Dean and respected legal scholar Erwin Chemerinsky expertly exposes how conservatives are using the Constitution to advance their own agenda that favors business over consumers and employees, and government power over individual rights. But exposure is not enough. Progressives have spent too much of the last forty-five years trying to preserve the legacy of the Warren Court’s most important rulings and reacting to the Republican-dominated Supreme Courts by criticizing their erosion of rights—but have not yet developed a progressive vision for the Constitution itself. Yet, if we just look to the promise of the Preamble—liberty and justice for all—and take seriously its vision, a progressive reading of the Constitution can lead us forward as we continue our fight ensuring democratic rule, effective government, justice, liberty, and equality. Includes the Complete Constitution and Amendments of the United States of America

The Idea of Being Indians and the Making of India by George Varuggheese Pdf

The book The Idea of Being Indians and the Making of India is a must read for all Indians. It informs them why India is a colony of its middle class who keeps the 80 percent of the population out of the benefits of all economic planning and development. The answer is that the struggle for India's freedom was waged by its middle-class leaders only to drive the British out of power and not to get rid of the feudal-fascist governance structures of administration, judiciary, and police, which were "crushing" us, according to Nehru's admission in his book The Discovery of India. These "crushing" structures, our leaders themselves took over and had the taste of the power and pelf that flowed, and their feast still continues while the nation gets the human development ranking at 136 among 187 nations, according the latest Human Development Report released by the UNDP in March 2013. The book narrates in lucid language that the noble and highly egalitarian missions of the Indian Republic, contained in the Preamble to the Constitution of India, could not be translated into experiential comforts for people of this country only because they were not compatible with the feudal-fascist revenue-collection-oriented structures inherited from the British. The book argues that when leaders who, after making a set of highly republican and democratically oriented development objectives for their country, adopt them as the Preamble to the Constitution of India instead of creating relevant democratic republican governance structures to implement, they deliberately pick up the regressive feudal-fascist governance structures used by the colonial government for their selfish ends. It is tantamount not only to a political scam but to a spiritual one. The author gives a twelve-point sarvodaya good governance model' as remedy to these strategic errors of our founding fathers and for making a resurgent India with the help of the mission statements of the Indian Republic enshrined in the Preamble to the Constitution of India. The author argues that the mission statements in the Preamble to the Constitution of India contain the idea of being Indians of a healthy, prosperous, and peaceful society at total or 100 percent population level. The making of India of such a society is in the hands of the people of India, especially the youth.

Mission by Noel Pearson Pdf

Mission traces a life of politics, ideas and inspiring words. Whether he is recalling his boyhood in Hope Vale, Queensland, making the case for Indigenous recognition, or evoking a reconciled, multicultural Australia, Noel Pearson confirms he is one of Australia’s most powerful and influential thinkers – and an extraordinary writer. Mission selects the best of Pearson’s work to date. There are indelible portraits of political leaders seen close up – Keating, Rudd, Whitlam, Turnbull and more. There is Pearson’s brilliant exploration of a Voice to Parliament, which led eventually to the Uluru Statement from the Heart. And there are acute analyses – of passive welfare; of the fate of the Labor Party; of identity politics, good and bad; and of education and the role of a great teacher. The volume also contains a remarkable new extended title essay, in which Pearson reflects on his life and work so far. Mission is honest, provocative and utterly original. Noel Pearson is a lawyer, activist and founder of the Cape York Institute. He is author of Up From the Mission, Our Right to Take Responsibility, Mission, two Quarterly Essays and many essays, articles and speeches.

The Australian Constitution and National Identity by Anna Olijnyk,Alexander Reilly Pdf

What does Australia’s Constitution say about national identity? A conventional answer might be ‘not much’. Yet recent constitutional controversies raise issues about the recognition of First Peoples, the place of migrants and dual citizens, the right to free speech, the nature of our democracy, and our continuing connection to the British monarchy. These are constitutional questions, but they are also questions about who we are as a nation. This edited collection brings together legal, historical, and political science scholarship. These diverse perspectives reveal a wealth of connections between the Australian Constitution and Australia’s national identity.

Social and Political Foundations of Constitutions by Denis James Galligan Pdf

"This volume analyses the social and political forces that influence constitutions and the process of constitution making. It combines theoretical perspectives on the social and political foundations of constitutions with a range of detailed case studies of constitution making in nineteen different countries. In the first part of the volume, leading scholars analyse and develop a range of theoretical perspectives, including constitutions as coordination devices, mission statements, contracts, products of domestic power play, transnational documents, and as reflection of the will of the people. In the second part of the volume, these theories are examined through in-depth case studies of the social and political foundations of constitutions in countries such as Egypt, Nigeria, Japan, Romania, Bulgaria, New Zealand, Israel, Argentina, and others. The result is a multidimensional study of constitutions as social phenomena and their interaction with other social phenomena. The approach combines social science analysis of the nature of constitutions with case studies of selected constitutions"--

Framing the Solid South by Paul E. Herron Pdf

The South was not always the South. In the eighteenth and early nineteenth centuries, those below the Potomac River, for all their cultural and economic similarities, did not hold a separate political identity. How this changed, and how the South came to be a political entity that coheres to this day, emerges clearly in this book—the first comprehensive account of the Civil War Era and late nineteenth century state constitutional conventions that forever transformed southern politics. From 1860 to the turn of the twentieth century, southerners in eleven states gathered forty-four times to revise their constitutions. Framing the Solid South traces the consolidation of the southern states through these conventions in three waves of development: Secession, Reconstruction, and Redemption. Secession conventions, Paul Herron finds, did much more than dissolve the Union; they acted in concert to raise armies, write law, elect delegates to write a Confederate Constitution, ratify that constitution, and rewrite state constitutions. During Reconstruction, the national government forced the southern states to write and rewrite constitutions to permit re-entry into the Union—recognizing federal supremacy, granting voting rights to African Americans, enshrining a right to public education, and opening the political system to broader participation. Black southerners were essential participants in democratizing the region and reconsidering the nature of federalism in light of the devastation brought by proponents of states’ rights and sovereignty. Many of the changes by the postwar conventions, Herron shows, were undermined if not outright abolished in the following period, as “Redeemers” enshrined a system of weak states, the rule of a white elite, and the suppression of black rights. Southern constitution makers in all three waves were connected to each other and to previous conventions unlike any others in American history. These connections affected the content of the fundamental law and political development in the region. Southern politics, to an unusual degree, has been a product of the process Herron traces. What his book tells us about these constitutional conventions and the documents they produced is key to understanding southern history and the South today.
