Advances in Experimental Philosophy of Law by Karolina Prochownik,Stefan Magen Pdf

Only recently have philosophers and psychologists begun to consider empirical research methods to inform questions and debates in legal philosophy. With the field ripe for further experimental inquiry, this collection explores the most topical empirical developments and anticipates future research directions. Bringing together legal scholars, psychologists, and philosophers, chapters address questions such as: Do people share a stable set of intuitions about what the law is? What are common perceptions about causation, intentionality, and culpability, and are they consistent with the corresponding legal concepts? To what extent can experimental research methods advance theoretical debates in legal philosophy about the nature of law? With fascinating implications for legal philosophy, ethics, and moral psychology, Advances in Experimental Philosophy of Law sets the agenda for the emerging field of experimental jurisprudence and will be of interest to both researchers and practitioners alike.

Legal Validity and Soft Law by Pauline Westerman,Jaap Hage,Stephan Kirste,Anne Ruth Mackor Pdf

This book features essays that investigate the nature of legal validity from the point of view of different traditions and disciplines. Validity is a fascinating and elusive characteristic of law that in itself deserves to be explored, but further investigation is made more acute and necessary by the production, nowadays, of soft law products of regulation, such as declarations, self-regulatory codes, and standardization norms. These types of rules may not exhibit the characteristics of formal law, and may lack full formal validity but yet may have a very real impact on people's lives. The essays focus on the structural properties of hard and soft legal phenomena and the basis of their validity. Some propose to redefine validity: to allow for multiple concepts instead of one and/or to allow for a gradual concept of validity. Others seek to analyze the new situation by linking it to familiar historical debates and well-established theories of law. In addition, coverage looks at the functions of validity itself. The discussion considers both international law as well as domestic law arrangements. What does it mean to say that something is valid? Should we discard validity as the determining aspect of law? If so, what does this mean for our concept of law? Should we differentiate between kinds of validity? Or, can we say that rules can be "more" or "less" valid? After reading this book, practitioners, scholars and students will have a nuanced understanding of these questions and more. Writing Lives Together by Felicity James,Julian North Pdf

A diary entry, begun by a wife and finished by a husband; a map of London, its streets bearing the names of forgotten lives; biographies of siblings, and of spouses; a poem which gives life to long-dead voices from the archives. All these feature in this volume as examples of ‘writing lives together’: British life writing which has been collaboratively authored and/or joins together the lives of multiple subjects. The contributions to this book range over published and unpublished material from the late eighteenth to the late nineteenth centuries, including biography, auto/biographical memoirs, letters, diaries, sermons, maps and directories. The book closes with essays by contemporary, practising biographers, Daisy Hay and Laurel Brake, who explain their decisions to move away from the single subject in writing the lives of figures from the Romantic and Victorian periods. We conclude with the reflections and work of a contemporary poet, Kathleen Bell, writing on James Watt (1736–1819) and his family, in a ghostly collaboration with the archives. Taken as a whole, the collection offers distinctive new readings of collaboration in theory and practice, reflecting on the many ways in which lives might be written together: across gender boundaries, across time, across genre. This book was originally published as a special issue of Life Writing.
