The Public Domain: Enclosing the Commons of the Mind Illustrated Edition by James Boyle Pdf

In this enlightening book James Boyle describes what he calls the range wars of the information age--today's heated battles over intellectual property. Boyle argues that just as every informed citizen needs to know at least something about the environment or civil rights, every citizen should also understand intellectual property law. Why? Because intellectual property rights mark out the ground rules of the information society, and today's policies are unbalanced, unsupported by evidence, and often detrimental to cultural access, free speech, digital creativity, and scientific innovation.Boyle identifies as a major problem the widespread failure to understand the importance of the public domain--the realm of material that everyone is free to use and share without permission or fee. The public domain is as vital to innovation and culture as the realm of material protected by intellectual property rights, he asserts, and he calls for a movement akin to the environmental movement to preserve it. With a clear analysis of issues ranging from Jefferson's philosophy of innovation to musical sampling, synthetic biology and Internet file sharing, this timely book brings a positive new perspective to important cultural and legal debates. If we continue to enclose the "commons of the mind," Boyle argues, we will all be the poorer.

Punk Ethnography by Michael E. Veal,E. Tammy Kim Pdf

This ground-breaking case study examines record production as ethnographic work. Since its founding in 2003, Seattle-based record label Sublime Frequencies has produced world music recordings that have been received as radical, sometimes problematic critiques of the practices of sound ethnography. Founded by punk rocker brothers Alan and Richard Bishop, along with filmmaker Hisham Mayet, the label’s releases encompass collagist sound travelogues; individual artist compilations; national, regional and genre surveys; and DVDs—all designed in a distinctive graphic style recalling the DIY aesthetic of punk and indie rock. Sublime Frequencies’ producers position themselves as heirs to canonical ethnographic labels such as Folkways, Nonesuch, and Musique du Monde, but their aesthetic and philosophical roots in punk, indie rock, and experimental music effectively distinguish their work from more conventional ethnographic norms. Situated at the intersection of ethnomusicology, sound studies, cultural anthropology, and popular music studies, the essays in this volume explore the issues surrounding the label—including appropriation and intellectual property—while providing critical commentary and charting the impact of the label through listener interviews.

Meaning in the Media by Alan Durant Pdf

Meaning in the Media addresses the issue of how we should respond to competing claims about meaning put forward in confrontations between people or organisations in highly charged circumstances such as bitter public controversies and expensive legal disputes. Alan Durant draws attention to the pervasiveness and significance of such meaning-related disputes in the media, investigating how their 'meaning' dimension is best described and explained. Through his analysis of deception, distortion, bias, false advertising, offensiveness and other kinds of communicative behaviour that trigger interpretive disputes, Durant shows that we can understand both meaning and media better if we focus in new ways on moments in discourse when the apparently continuous flow of understanding and agreement breaks down. This lively and contemporary volume will be invaluable to students and teachers of linguistics, media studies, journalism and law.

The Hallelujah Effect by Babette Babich Pdf

This book studies the working efficacy of Leonard Cohen's song Hallelujah in the context of today's network culture. Especially as recorded on YouTube, k.d. lang's interpretation(s) of Cohen's Hallelujah, embody acoustically and visually/viscerally, what Nietzsche named the 'spirit of music'. Today, the working of music is magnified and transformed by recording dynamics and mediated via Facebook exchanges, blog postings and video sites. Given the sexual/religious core of Cohen's Hallelujah, this study poses a phenomenological reading of the objectification of both men and women, raising the question of desire, including gender issues and both homosexual and heterosexual desire. A review of critical thinking about musical performance as 'currency' and consumed commodity takes up Adorno's reading of Benjamin's analysis of the work of art in the age of mechanical reproduction as applied to music/radio/sound and the persistent role of 'recording consciousness'. Ultimately, the question of what Nietzsche called the becoming-human-of-dissonance is explored in terms of both ancient tragedy and Beethoven's striking deployment of dissonance as Nietzsche analyses both as playing with suffering, discontent, and pain itself, a playing for the sake not of language or sense but musically, as joy.

Bound by Law? by Keith Aoki,James Boyle,Jennifer Jenkins Pdf

"A documentary is being filmed. A cell phone rings, playing the "Rocky" theme song. The filmmaker is told she must pay $10,000 to clear the rights to the song. Can this be true? "Eyes on the Prize," the great civil rights documentary, was pulled from circulation because the filmmakers' rights to music and footage had expired. What's going on here? It's the collision of documentary filmmaking and intellectual property law, and it's the inspiration for this new comic book. Follow its heroine Akiko as she films her documentary, and navigates the twists and turns of intellectual property. Why do we have copyrights? What is "fair use"? Bound By Law reaches beyond documentary film to provide a commentary on the most pressing issues facing law, art, property and an increasingly digital world of remixed culture"--

Understanding Mega Free Trade Agreements by Jean-Baptiste Velut,Louise Dalingwater,Vanessa Boullet,Valérie Peyronel Pdf

The rise of cross-regional trade agreements is a defining trend of the current international trade system as shown by the signing of the Trans-Pacific Partnership (TPP) in 2015, the negotiations for the Transatlantic Trade and Investment Partnership (TTIP) between the USA and the EU as well as the Regional Comprehensive Economic Partnership (RCEP) between countries in Asia and Oceania. These differ from previous agreements in their economic significance and large geographic scale, and the wide scope of trade-related issues. The current rise of nationalist and isolationist ideologies across Europe and the USA has raised questions on the future of cross-regional trade deals and made the need to understand their implications for economic and political governance ever more urgent. Two main forms of governance that are central to this volume are the democratic tensions over new generation trade deals on the one hand, and their geopolitical ramifications on the other, which have come into collision to herald the advent of a highly uncertain period of world politics. Many of the questions tackled in this volume, surrounding the democratic governance of trade agreements – whether long-held debates on the inclusion of workers’ voices, controversies on intrusive "behind the border" provisions undermining national sovereignty and local autonomy or new questions on digital rights – are crucial to understand the ebbing popular support for far-reaching trade agreements. This book will be a useful learning tool for students and scholars in a wide range of fields, including Globalisation, Global Governance, International Political Economy, International Trade and Investment and International Law, and should also be of interest to EU trade negotiators, international policymakers and business associations.
