The Railway and Canal Traffic ACT, 1888 (Classic Reprint) by W. A. Hunter Pdf

Excerpt from The Railway and Canal Traffic Act, 1888 Owing to the delay that has occurred in the publication Of the Rules Of Procedure under the Railway and Canal Traffic Act I have decided to publish a treatise on the Act, in two parts. Part I. Gives information with respect to the Classification Of Goods and Revision Of Maximum Rates, and is, in fact, a commentary on the 24th section Of the Act. Part II. Deals with the whole of the Act excepting section 24. It will be published shortly. The Obj ect Of Part I. Is to put railway companies and traders in full possession Of the existing law under the Companies' Special Acts, and to provide a convenient means of comparing the present with the proposed rates. The observations made by the inter-state Commerce Commission of the United States on the principles of classification of goods and reasonableness Of rates will be found useful. A Treatise on the Law Relating to Rates and Traffic on Railways and Canals by A. Kaye Butterworth Pdf

Excerpt from A Treatise on the Law Relating to Rates and Traffic on Railways and Canals: With Special Reference to the Railway and Canal Traffic Act, 1888 and the Practice of the Railway and Canal Commission, With an Appendix of Statutes, Rules, Etc The present volume deals only with that branch of the law applicable to railway and canal companies, which is affected by the Act of last session, viz., the law relating to Rates and Traffic - in other words, the law relating to the facilities which those companies are bound to afford for the transmission of goods, and the charges which they are authorised to demand in return from the public. That Act effects three important changes. (1.) It provides for the revision of the statutory charging powers of all railway and canal companies, and endeavours by this means to bring about a simplification of rates, and to set at rest the vexed question of terminals. (2.) It amends, modifies, and explains the existing law. (3.) It establishes a new and permanent tribunal for the determination of differences between railway and canal companies and the public. The main objects of the present volume are to make clear the nature and extent of these changes, and to present a statement of the existing law in a form at once useful to the practitioner or railway official, and intelligible to the general reader. It has been thought that these objects are likely to be best attained by dividing the book into chapters according to the heads of the subject-matter, pointing out in each chapter the effect of the Act upon the particular head under discussion. At the same time the author has endeavoured to preserve the advantages of a chronological arrangement of statutes by printing the unrepealed provisions of the earlier Acts, and the full text of the Act of 1888, in an Appendix, with short notes and full references to the text. The Law Relating to Traffic on Railways and Canals, Vol. 1 of 3 (Classic Reprint) by Edward Boyle Pdf

Excerpt from The Law Relating to Traffic on Railways and Canals, Vol. 1 of 3 Much litigation has been avoided by the operation of the concili ation section of the Railway and Canal Traffic Act, 1888, under which parties aggrieved by the action of a railway or canal company may make complaint to the Board of Trade, whose duty it then becomes to call upon the railway company for an explanation, and endeavour to settle amicably the differences between the complainant and the railway company. The principal cause of the comparative absence of litigation lies in the fact that a law Of railway traffic is being gradually evolved, reasonably considerate of the rights of both parties, and adapted to the actual circumstances Of the traffic. In the early days of railways this was very far from being the case. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. A Treatise on the Railway Canal Traffic Act, 1854 by George Brown Pdf

Excerpt from A Treatise on the Railway Canal Traffic Act, 1854: And on the Law of Carriers as Affected Thereby; With an Appendix, Containing Copious Reports of the Principal Cases Decided on the Act The want experienced by many railway oflicials, of a knowledge of the principles and grounds upon which the Court of Common Pleas has hitherto acted in car rying out the important Act usually known as Mr. Cardwell's Act, induced me to undertake the present work. It became necessary to introduce chapters on other topics connected with the duties of Carriers, in order properly to elucidate the bearing of the sta tute upon the Law of Carriers, so that not a few of the main points inthat law will be found noted. The object has been, not to make a large book, but to con dense as much matter as possible into a small com pass. The principles laid down by the Judges have been carefully laid down in Chapters IV., V., and VI., and such observations have been founded on them as may serve to indicate the probable course of the Court in future cases. In order to enable the reader to see the whole circumstances and effect of the decisions - copious reports of the leading cases have been given in the appendix.
