A central question in the debate on justice in immigration is whether immigrants have a right to stay; this book argues that liberal-democratic receiving states should also grant migrants a right not to stay. This claim runs against the presumption that migrants always desire to move on a permanent basis and intend to forge a completely new life in the country of destination. From this perspective, temporary migration is always a second-best option for migrants, engendered by the closed and often punitive migration policies of receiving countries. This book's innovative focus on the right not to stay is prompted instead by the realization that increasing numbers of migrants throughout the world conceive and plan their migratory experience as circumscribed in time and instrumental to goals and projects that they will pursue once back in their country of origin. These temporary migration projects are worthy of being accommodated by the receiving states as much as the migratory plans of those who resolve or aim to immigrate on a permanent basis. Accommodating them entails setting up the appropriate welfare measures and programs in the host country and, through bi-lateral agreements, in the country of return. This is especially important in view of the fact that very often the migrants who engage in temporary migration projects find themselves in a condition of high vulnerability and risk. The "right not to stay" advocated in this book is a positive and substantive right to see one's project of temporary migration-and-return protected and accommodated by institutions.

Commentators have been quick to observe that any such proposal will face intense opposition. Few issues have so divided the country in recent years as immigration. Immigrants and the Right to Stay brings the debate into the realm of public reason. Political theorist Joseph Carens argues that although states have a right to control their borders, the right to deport those who violate immigration laws is not absolute. With time, immigrants develop a moral claim to stay. Emphasizing the moral importance of social membership, and drawing on principles widely recognized in liberal democracies, Carens calls for a rolling amnesty that gives unauthorized migrants a path to regularize their status once they have been settled for a significant period of time. After Carens makes his case, six experts from across the political spectrum respond. Some protest that he goes too far; others say he does not go far enough in protecting the rights of migrants. Several raise competing moral claims and others help us understand how the immigration problem became so large. In 2007, 144 UN member states voted to adopt a Declaration on the Rights of Indigenous Peoples. Australia, Canada, New Zealand and the US were the only members to vote against it. Each eventually changed its position. This book explains why and examines what the Declaration could mean for sovereignty, citizenship and democracy in liberal societies such as these. It takes Canadian Chief Justice Lamer’s remark that ‘we are all here to stay’ to mean that indigenous peoples are ‘here to stay’ as indigenous. The book examines indigenous and state critiques of the Declaration but argues that, ultimately, it is an instrument of significant transformative potential showing how state sovereignty need not be a power that is exercised over and above indigenous peoples. Nor is it reasonably a power that displaces indigenous nations’ authority over their own affairs. The Declaration shows how and why, and this book argues that in doing so, it supports more inclusive ways of thinking about how citizenship and democracy may work better. The book draws on the Declaration to imagine what non-colonial political relationships could look like in liberal societies.
