The Telecoms Trade War by Mark Naftel,Lawrence J Spiwak Pdf

If one were to believe the politicians and pundits in the trade press, the world is in midst of a “telecoms revolution,” resulting from (the) deregulation and new competitive opportunities represented by the 1997 World Trade Organisation Agreement on Basic Telecommunications Services. This may be true. Unfortunately, however, the actions of many regulators and industry participants more accurately reveal not a telecoms “revolution” but instead a growing telecoms trade war that is dangerously close to spiralling out of hand. In this book, Naftel and Spiwak review U.S. and European competition and regulatory initiatives post-WTO and provide both a useful roadmap to today's U.S., EU and WTO telecoms regulation and an examination of various case studies to illustrate their points. In so doing, the authors discover unfortunately the sad reality that, despite the political rhetoric, regulators on both sides of the Atlantic have eschewed innovative and indeed productive solutions to create a market structure conducive to long-term competitive rivalry. Instead, the authors demonstrate that current policies reveal a growing cynicism towards the maximisation of consumer welfare that will be difficult - if not outright impossible- to remove.

High-Tech Trade Wars by Sara Schoonmaker Pdf

Focusing on the conflicts between the United States and Brazilian governments over Brazil’s efforts to develop a local computer industry, High-Tech Trade Wars examines the political struggle between governments and multinational corporations in today’s global economy. Sara Schoonmaker uses the technology industry to delve into one of the key political conflicts of our time: the construction of a free trade regime determined to open markets around the world to global capital, and attempts by Latin American, African, and other governments to resist this process. The Brazilian computer case is a prime example of a nationalist effort to promote local growth of a key high-technology industry—an effort that was eventually dismantled under the pressures of what Schoonmaker views as part of a broader process of neoliberal globalization. High-Tech Trade Wars presents a multidimensional view of the globalization process, where economic changes are shaped by political struggle and cultural discourse. It includes interviews with Brazilian industrialists and state officials involved with implementing and, eventually, dismantling Brazil’s informatics policy, and discussions of grassroots-level protests organized against neoliberal globalization during the recent WTO meetings in Seattle and Davos, Switzerland.

Telecommunications and Empire by Jill Hills Pdf

Jill Hills picks up from her pathbreaking study The Struggle for Control of Global Communication: The Formative Century to continue her examination of the political, technological, and economic forces at work in the global telecommunications market from World War II to the World Trade Organization agreement of 1997. In the late twentieth century, focus shifted from the creation and development of global communication markets to their intense regulation. The historical framework behind this control--where the market was regulated, by what institution, controlled by what power, and to whose benefit--masterfully complements Hills's analysis of power relations within the global communications arena. Hills documents attempts by governments to direct, replace, and bypass international telecommunications institutions. As she shows, the results have offered indirect control over foreign domestic markets, government management of private corporations, and government protection of its own domestic communication market. Hills reveals that the motivation behind these powerful, regulatory efforts on person-to-person communication lies in the unmatched importance of communication in the world economy. As ownership of communications infrastructure becomes more valuable, governments have scrambled to shape international guidelines. Hills provides insight into struggles between U.S. policymakers and the rest of the world, illustrating the conflict between a growing telecommunications empire and sovereign states that are free to implement policy changes. Freshly detailing the interplay between U.S. federal regulation and economic power, Hills fosters a deep understanding of contemporary systems of power in global communications.

EC Competition and Telecommunications Law by Christian Koenig,Andreas Bartosch Pdf

This new volume updates the groundbreaking analysis of its first edition in 2002, when the EC common regulatory framework for electronic communications networks and services had just entered into force. So much has changed in the intervening years that that this new edition bears little resemblance to its predecessor, with every chapter either extensively altered or entirely new. It remains, however, the most detailed and comprehensive overview available of the application of the EC Treaty’s competition rules in the markets for telecommunications and audiovisual media, and of the applicable regulatory framework. In thirteen chapters, each contributed by one or more noted legal authorities in the field, the second edition of EC Competition and Telecommunications Law covers the full range of EC telecommunications law across all major areas of both institutional and substantive law, both on the international and EC levels, including the following: State aid; the merger control regulation; justification for sector-specific regulation in EC competition law; network access; authorizations and privileges; and mobile telephony. Relevant EC media and communications law and relevant aspects of EC competition law are dealt with in detail. While some chapters focus on competition law, others deal primarily with sector-specific regulation. There is practical guidance throughout on procedural matters, alongside analysis of the substantive provisions. Well-known in its first edition, this thoroughly revised and updated version continue to be vital reading for practitioners, in particular those specializing in European competition law and for company and in-house lawyers who are seeking advice on how European law affects their business. As a detailed analysis of the basic legislative and regulatory framework of European telecommunications law, it will be an invaluable reference work for lawyers, judges, regulators, and policymakers in all the EC Member States, as well as for students and teachers of European law.

The World Trade Organization and Trade in Services by Kern Alexander,Mads Tønnesson Andenæs Pdf

The World Trade Organisation plays the primary role in regulating international trade in goods, services and intellectual property. Traditionally, international trade law and regulation has been analysed primarily from the trade-in-goods perspective. Services are becoming an important competence for the WTO. The institutional, legal and regulatory influence of the General Agreement on Trade in Services (GATS) on domestic economic policymaking is attracting increasing attention in the academic and policymaking literature. The growing importance of services trade to the global economy makes the application of the GATS to trade in services an important concern of international economic policy. The GATS contains important innovations that build on the former GATT and existing WTO/GATT trade regime for goods. This book fills a void in the academic and policymaking literature by examining how the GATS governs international trade in services and its growing impact on the regulatory practice of WTO member states. It offers a unique discussion of the major is-sues confronting WTO member states by analysing the GATS and related international trade issues from a variety of perspectives that include law, political economy, regulation, and business. Moreover, the role of the WTO in promoting liberalised trade and economic development has come under serious strain because of the breakdown of the Doha Development Round negotiations. The book analyses the issues in the Doha services debate with some suggested policy approaches that might help build a more durable GATS framework. The book is a welcomed addition to the WTO literature and will serve as a point of reference for academics, policymakers andpractitioners.

Wto - Trade In Services by Rüdiger Wolfrum,Peter-Tobias Stoll,Clemens Feinäugle Pdf

With the establishment of the WTO, trade in services became part of the world trade order. Volume 6 is dedicated to these rather recent developments. It covers the core agreement, the General Agreement on Trade in Services (GATS) with annexes, as well as the additional instruments , which have been adopted later on to govern the liberalization in specific sectors. Those are the Understanding on Commitments in Financial Services, the Second Protocol on Financial Services, the Third Protocol on the Movement of Natural Persons, the Fourth Protocol on Basic Telecommunications and the Fifth Protocol, which contains further rules for financial services. This volume will be a valuable reference tool for the WTO community as a whole, as well as for professionals and researchers, who deal with one of the sectors concerned, e.g. financial services and telecommunications. Furthermore, it is highly relevant in view of those sectors, which are the subject of ongoing liberalization efforts or earmarked for future negotiations, namely accounting, legal services, transport, tourism, environmental services, legal and educational services.

Trade Wars are Class Wars by Matthew C. Klein,Michael Pettis Pdf

"This is a very important book."--Martin Wolf, Financial TimesA provocative look at how today's trade conflicts are caused by governments promoting the interests of elites at the expense of workers Longlisted for the 2020 Financial Times & McKinsey Business Book of the Year Award "Worth reading for [the authors'] insights into the history of trade and finance."--George Melloan, Wall Street Journal Trade disputes are usually understood as conflicts between countries with competing national interests, but as Matthew C. Klein and Michael Pettis show, they are often the unexpected result of domestic political choices to serve the interests of the rich at the expense of workers and ordinary retirees. Klein and Pettis trace the origins of today's trade wars to decisions made by politicians and business leaders in China, Europe, and the United States over the past thirty years. Across the world, the rich have prospered while workers can no longer afford to buy what they produce, have lost their jobs, or have been forced into higher levels of debt. In this thought-provoking challenge to mainstream views, the authors provide a cohesive narrative that shows how the class wars of rising inequality are a threat to the global economy and international peace--and what we can do about it.
