Samuel Langhorne Clemens (November 30, 1835 - April 21, 1910), known by his pen name Mark Twain, was an American writer, humorist, entrepreneur, publisher, and lecturer. He was lauded as the "greatest humorist the United States has produced," and William Faulkner called him "the father of American literature". His novels include The Adventures of Tom Sawyer (1876) and its sequel, the Adventures of Huckleberry Finn (1884), the latter often called "The Great American Novel". Twain was raised in Hannibal, Missouri, which later provided the setting for Tom Sawyer and Huckleberry Finn. He served an apprenticeship with a printer and then worked as a typesetter, contributing articles to the newspaper of his older brother Orion Clemens.

His Majesty, the Emperor of China, being of the opinion that in making concessions to the citizens or subjects of foreign Powers of the privilege of residing on certain tracts of land, or resorting to certain waters of that Empire for the purposes of trade, he has by no means relinquished his right of eminent domain or dominion over the said land and waters, hereby agrees that no such concession or grant shall be construed to give to any Power or party which may be at war with or hostile to the United States the right to attack the citizens of the United States or their property within the said lands or waters; and the United States, for themselves, hereby agree to abstain from offensively attacking the citizens or subjects of any Power or party or their property with which they may be at war on any such tract of land or waters of the said Empire; ARTICLE I. 중국의 황제 폐하께서는 외국 열강의 시민이나 신민에게 무역을 목적으로 특정 영토에 거주하거나 제국의 특정 수역에 의존하는 특권을 양보한다는 견해를 갖고 있습니다. 상기 토지와 수역에 대한 자신의 저명한 영토 또는 지배권을 결코 포기하지 않았으며, 이에 따라 그러한 양보 또는 허가가 미국과 전쟁 중이거나 적대적일 수 있는 강국 또는 당사자에게 제공하는 것으로 해석되지 않는다는 데 동의합니다. 상기 토지 또는 수역 내에서 미국 시민 또는 그들의 재산을 공격할 권리, 그리고 미국은 이에 따라 제국의 영토나 수역에서 전쟁을 벌일 수 있는 강국이나 당사자 또는 재산의 시민이나 신민을 공격적으로 공격하지 않는 데 동의합니다. 제1조(ARTICLE I). The United States of America and His Majesty the Emperor of China, believing that the safety and prosperity of commerce will thereby best be promoted, agree that any privilege or immunity in respect to trade or navigation within the Chinese dominions which may not have been stipulated for by treaty, shall be subject to the discretion of the Chinese Government, and may be regulated by it accordingly, but not in a manner or spirit incompatible with the treaty stipulations of the parties. The Emperor of China shall have the right to appoint consuls at ports of the United States, who shall enjoy the same privileges and immunities as those which are enjoyed by public law and treaty in the United States by the Consuls of Great Britain and Russia, or either of them. Mark Twain (Samuel Langhorne Clemens, 1835–1910) has had an intriguing relationship with China that is not as widely known as it should be. Although he never visited the country, he played a significant role in speaking for the Chinese people both at home and abroad. After his death, his Chinese adventures did not come to an end, for his body of works continued to travel through China in translation throughout the twentieth century. Were Twain alive today, he would be elated to know that he is widely studied and admired there, and that Adventures of Huckleberry Finn alone has gone through no less than ninety different Chinese translations, traversing China, Taiwan, and Hong Kong. Chinese–American relations are often viewed through the prism of power rivalry and civilization clash. But China and America’s shared history is much more than a catalog of conflicts. Using culture rather than politics or economics as a reference point, Xu Guoqi highlights significant yet neglected cultural exchanges in which China and America have contributed to each other’s national development, building the foundation of what Zhou Enlai called a relationship of “equality and mutual benefit.” Xu begins with the story of Anson Burlingame, Abraham Lincoln’s ambassador to China, and the 120 Chinese students he played a crucial role in bringing to America, inaugurating a program of Chinese international study that continues today. Such educational crosscurrents moved both ways, as is evident in Xu’s profile of the remarkable Ge Kunhua, the Chinese poet who helped spearhead Chinese language teaching in Boston in the 1870s. Xu examines the contributions of two American scholars to Chinese political and educational reform in the twentieth century: the law professor Frank Goodnow, who took part in making the Yuan Shikai government’s constitution; and the philosopher John Dewey, who helped promote Chinese modernization as a visiting scholar at Peking University and elsewhere. Xu also shows that it was Americans who first introduced to China the modern Olympic movement, and that China has used sports ever since to showcase its rise as a global power. These surprising shared traditions between two nations, Xu argues, provide the best roadmap for the future of Sino–American relations.

Excerpt from Foreign Rights and Interests in China The purpose of this volume is to provide a statement of the rights of foreigners and the interests of foreign States in China as they are to be found stated in treaties with or relating to China or in other documents of an official or quasi-official character. Viewed from the other side, the account will exhibit the limitations under which the Chinese Government is compelled to act not only with regard to matters of international obligation but as to matters which, in countries more fortunately circumstanced, are of purely domestic concern. Whether the purpose of the volume has been satisfactorily achieved, the reader will determine, but that there is a pressing need for a work that will furnish an explanation and definite statement of the rights and interests which the Treaty Powers and their nationals have obtained in China, few will question. Anyone who has been in China, or has had business interests with that country, or has sought to gain an understanding of the conflict of national interests in the Far East, will testify to the urgency of this need. This is not to say, however, that there are not already books which deal with many of these topics. There are such treatises, and among them, especially deserving mention, aTe: H. B. Morse's The Trade and Administration of China, 2d ed., published in 1913, and his three volumes on Foreign Relations of the Chinese Empire, 1884-1911; V. K. Wellington Koo's The Status of Aliens in China, published in 1912; T. R. Jemigan's China in Law and Commerce, published in 1905; T. W. Overlach's Foreign Financial Control in China, published in 1919; and M. T. Z. Tyau's The Legal Obligations Arising out of Treaty Relations between China and Other States, published in 1917. From these volumes the author has derived the greatest aid. It will appear, however, that he has explained many matters Which are not discussed by these earlier writers, and, of course, there has been opportunity to deal with the important developments of the last few years. This book focuses on Chinese cases on the CISG decided by Chinese courts of all levels, mainly from 1990 to 2005. During this period, the number of cases grew gradually. This book deals with the cases in the early days of the development of the CISG in China. These cases reflect how People’s Court of all levels started to deal with various issues arising from the CISG and will help understand whether and how the People’s Courts change their approaches to the interpretation and application of the CISG in the future.
