Sir Henry Maine died in 1888 and since then his ideas have been used by lawyers, historians, sociologists and many others. This is the first book to concentrate upon what he said about the law itself, and, as such, it explores the pioneering work Maine did in explaining law not by reference to abstract analysis but by placing it firmly in its social and historical context. Instead of concentrating on concepts such as sovereignty he looked at the realities of law as it was practised by professionals and experienced by laymen. The result was a controversial achievement stressing the reforming duties of jurists and citizens at times of social change. His was a life which contained but few incidents. He was never connected with great affairs, save in India and at the India Office, and the great affairs with which he was connected were not of a kind to attract the attention of even well-informed readers who are not specially interested either in the country to which he gave so much of his thoughts, or in legal history and jurisprudence. His only adequate monument is to be found in his works. A life of him of the regulation size could no doubt be compiled according to the regulation fashion; that is, by stringing together great numbers of his letters to various official personages at home or in India when he was serving at Calcutta or Simla; but they would not be of any general interest, and he was far from being much given to writing letters, either for the pleasure of doing so or for the purpose of keeping up relations with private friends. Define and Rule focuses on the turn in late nineteenth-century colonial statecraft when Britain abandoned the attempt to eradicate difference between conqueror and conquered and introduced a new idea of governance, as the definition and management of difference. Mahmood Mamdani explores how lines were drawn between settler and native as distinct political identities, and between natives according to tribe. Out of that colonial experience issued a modern language of pluralism and difference. A mid-nineteenth-century crisis of empire attracted the attention of British intellectuals and led to a reconception of the colonial mission, and to reforms in India, British Malaya, and the Dutch East Indies. The new politics, inspired by Sir Henry Maine, established that natives were bound by geography and custom, rather than history and law, and made this the basis of administrative practice. Maine’s theories were later translated into “native administration” in the African colonies. Mamdani takes the case of Sudan to demonstrate how colonial law established tribal identity as the basis for determining access to land and political power, and follows this law’s legacy to contemporary Darfur. He considers the intellectual and political dimensions of African movements toward decolonization by focusing on two key figures: the Nigerian historian Yusuf Bala Usman, who argued for an alternative to colonial historiography, and Tanzania’s first president, Mwalimu Julius Nyerere, who realized that colonialism’s political logic was legal and administrative, not military, and could be dismantled through nonviolent reforms.

Robert Louis Stevenson's departure from Europe in 1887 coincided with a vocational crisis prompted by his father's death. Impatient with his established identity as a writer, Stevenson was eager to explore different ways of writing, at the same time that living in the Pacific stimulated a range of latent intellectual and political interests. Roslyn Jolly examines the crucial period from 1887 to 1894, focusing on the self-transformation wrought in Stevenson's Pacific travel-writing and political texts. Jolly shows how Stevenson's desire to understand unfamiliar Polynesian and Micronesian cultures, and to record and intervene in the politics of Samoa, gave him opportunities to use his legal education, pursue his interest in historiography, and experiment with anthropology and journalism. Thus as his geographical and cultural horizons expanded, Stevenson's professional sphere enlarged as well, stretching the category of authorship in which his successes as a novelist had placed him. Rather than enhancing his stature as a popular writer, however, Stevenson's experiments with new styles and genres, and the Pacific subject matter of his later works, were resisted by his readers. Jolly's analysis of contemporary responses to Stevenson's writing, gleaned from an extensive collection of reviews, many of which are not readily available, provides fascinating insights into the interests, obsessions, and resistances of Victorian readers. As Stevenson sought to escape the vocational straightjacket that confined him, his readers just as strenuously expressed their loyalty to outmoded images of Stevenson the author, and their distrust of the new guises in which he presented himself.

This Pivot explores the uses of the Mughal past in the historical fiction of colonial India. Through detailed reconsiderations of canonical works by Rudyard Kipling, Flora Annie Steel and Romesh Chunder Dutt, the author argues for a more complex and integral understanding of the part played by the Mughal imaginary in colonial and early Indian nationalist projections of sovereignty. Evoking the rich historical and transnational contexts of these literary narratives, the study demonstrates the ways in which, at successive moments of crisis and contestation in the later Raj, the British Indian state continued to be troubled by its early and profound investments in models of despotism first located by colonial administrators in the figure of the Mughal emperor. At the heart of these political fictions lay the issue of territoriality and the founding problem of a British claim to sole proprietorship of Indian land – a form of Orientalist exceptionalism that at once underpinned and could never fully be integrated with the colonial rule of law. Alongside its recovery of a wealth of popular and often overlooked colonial historiography, The Return of the Mughal emphasises the relevance of theories of political theology – from Carl Schmitt and Ernst Kantorowicz to Talal Asad and Giorgio Agamben – to our understanding of the fictional and jurisprudential histories of colonialism.
