The Law of Air, Road, and Sea Transportation by Georgios I. Zekos Pdf

International markets expand through better communication and transport technology. Transport networks are at the heart of the supply chain and are the foundation of any countrys economy. Transport is a foundation of the European integration procedure. The present framework of international carriage law is made up of a collection of conventions. The legal document establishing the contractual link between the parties involved in the contract of carriage is the bill of lading. Ocean bills of lading have an inherent value as security to banks that finance the sale of the underlying cargo or the documents themselves, and they enable their lawful holders to sell the cargo whilst in transit by transfer of the document. Containerisation brought about a revolution in the transport industry. All transport conventions set diverse liability limits and mirror dissimilar communities of interest among different transport modes. A carriers liability limitation in international carriage conventions is a consequence of international trade practice. The transport systems have become a source of environmental and social costs. The author discusses these issues and more in this important book on international markets and transportation.

Wilful Misconduct in International Transport Law by Duygu Damar Pdf

The main rationale of the conventions on international transport law is to limit the liability of the carrier. However, an aspect common to these conventions is that in cases of "wilful misconduct" the carrier is liable without any financial limitation. "Wilful misconduct" denoting a high degree of fault is an established term in English law. The Convention for the Unification of Certain Rules relating to International Carriage by Air (Warsaw Convention) of 1929 was the first international convention on transport law where the term was employed. A definition of "wilful misconduct", which can be found in later conventions regarding carriage of goods and passengers as well, was implemented in the Hague Protocol of 1955, amending the Warsaw Convention. However, the question as to exactly which degree of fault constitutes "wilful misconduct" has to date remained controversial and unanswered. This work seeks to answer this question. To this end, the historical background of the term, together with its function and role in marine insurance law, case law and international transport law, are examined from a comparative perspective.

The Impact of EU Law on the Regulation of International Air Transportation by Martin Bartlik Pdf

On 5 November 2002, the European Court of Justice delivered its 'open-skies' judgment, a landmark decision which may be the beginning of a new era in the regulation of international air law. The consequences of this judgment may not only affect the European Union and its Member States; this book shows how it could change the future regulation of international aviation worldwide. The first part of this book describes the difficulties arising from the fact that the competence for the regulation of air transportation in Europe is divided between the EU and the Member States. This division of power will also affect the conclusion of air-service agreements made with countries outside of Europe. In the second part of the book, the author examines a subject that was not part of the 'open-skies' judgment, but which he believes will become a problematic consequence: the distribution of air-traffic rights within the European Union.
