Understanding Patent Law by Amy L. Landers Pdf

"Patent law is an important, fascinating, and rapidly changing field. This book was written for all who need to understand these recent changes, as well as for students in intellectual property courses. For those engaged in international practice, this work sheds helpful light on the key doctrines and theories underlying U.S. patent law. More examples and explanatory material have been included across the board to provide some practical application of abstract or difficult concepts. Added flow charts also assist with tests and concepts. The most significant areas of updated materials include the rapidly evolving law concerning statutory subject matter, nonobviousness, and the application of the America Invents Act. This work covers the latest U.S. Supreme Court decisions, including SAS Institute v. Iancu, Oil States Energy Services v. Greene's Energy Group, Helsinn Healthcare v. Teva Pharmaceuticals USA, and WesternGeco v. ION Geophysical Corporation. The book also covers the major decisions of the U.S. Court of Appeals for the Federal Circuit. Each chapter has been comprehensively updated to reflect those decisions that refine, explain, or modify the existing state of patent law. The Federal Circuit's Thaler opinion regarding artificial intelligence exclusion from inventorship is explained, the World Trade Organization's consideration of the treatment of intellectual property for the COVID-19 vaccines is discussed, and material that explains the European Union's Unitary Patent System has been added to provide some practical application of abstract or difficult concepts"--

Patent Law by Daniel Brean,Ned Snow Pdf

The second edition of Patent Law: Fundamentals of Doctrine and Policy provides a remarkably accessible yet robust introduction to patent law and its practical application. Written in a straightforward style, the authors focus on providing a deep understanding of doctrine and policy without "hiding the ball" in ways that can hinder student comprehension. The book will appeal to students who have scientific and technical backgrounds or prior patent experience, as well as students who simply have an interest in technology and innovation and seek a well-rounded legal education. The book teaches all the core patent statutes and doctrines in the United States patent system. The authors employ several pedagogical methods to ensure students' mastery of each topic. At the outset of each chapter and section are detailed explanations of the black letter law. When new concepts are introduced, the text provides examples and explanations along with diagrams and illustrations. Case law is edited to emphasize legal principles and avoid excessive technological complexities. Updates to the second edition include: Dozens of new case discussions to bring the legal content up to date; Revamped presentation of novelty to further emphasize AIA law over pre-AIA law; Added examples, explanations, and practice questions to reinforce understanding; Increased internal cross-referencing to highlight relationships between discussions across the text; Reordering of topic coverage to enhance comprehension; and Further editing and editorializing of cases to focus on salient points of law.

Understanding Intellectual Property Law by Donald S. Chisum,Tyler T. Ochoa,Shubha Ghosh,Mary LaFrance Pdf

There have been a number of important developments in U.S. intellectual property law since the second edition of Understanding Intellectual Property Law was published. Foremost among them was the adoption, in September 2011, of the America Invents Act, the most significant change to U.S. patent law since the 1952 Patent Act. Coverage of the new Act includes: (1) the first inventor to file system and its effects on the definition of prior art; (2) the new derivation proceedings, replacing the current system of interferences, which allows a patent owner to challenge an earlier filed patent for derivation from the subsequent patent; (3) the prior commercial use defense; (4) the new procedures for inter partes review; (5) the new procedure for post-grant review; (6) the new rules for improper patent marking: (7) changes to the treatment of tax method patents; (8) the new rules pertaining to the best mode requirement; and (9) changes to the rules of jurisdiction. The Supreme Court has been unusually active in reviewing intellectual property cases during the past four years. During that period, it has reviewed and decided 15 patent cases (including three cases on patentable subject matter), four copyright cases, and four trademark or false advertising cases. In addition, the federal Courts of Appeals have decided more than 750 patent cases, 250 copyright cases, and 400 trademark and false advertising cases during that time. Understanding Intellectual Property Law, 3rd Edition covers all of the intellectual property areas and issues likely to be addressed in an intellectual property survey course. Chapter 1 provides a comprehensive introduction.
