Dans une économie globalisée, les migrations internationales se développent et deviennent un phénomène de plus en plus complexe. 232 millions de migrants sont aujourd'hui recensés dans le monde, contre 175 millions en 2000. Cependant, les systèmes de protection sociale restent attachés à un territoire. Dans ces conditions, les travailleurs migrants peinent à répondre aux conditions exigées pour bénéficier des prestations de sécurité sociale. Assurer une continuité des droits sociaux à travers une coordination efficace des législations entre les Etats devient primordial. Le champ de l'étude se focalise ici sur l'Union européenne (UE) et les USA car ce sont des zones privilégiées d'immigration. Dans un premier temps, la comparaison des législations de sécurité sociale américaines avec celles des pays membres de l'UE permet de souligner les difficultés rencontrées en matière de coordination. En effet, seules des législations comparables peuvent être coordonnées. Dans un second temps, l'ouvrage s'attache à recenser et à analyser les instruments juridiques nationaux et internationaux de coordination des législations de sécurité sociale. Dans cette optique, quarante-deux instruments élaborés au niveau supra-national et quatre cent trente-cinq conventions bilatérales impactant septante-sept pays à travers le monde ont été étudiés. L'objectif de l'ouvrage est d'être une source d'informations et de propositions à partir de laquelle une stratégie cohérente pourra être élaborée afin de développer les droits à la protection sociale des travailleurs migrants. Une politique adaptée et crédible en matière de migration et de protection des droits sociaux se fonde nécessairement sur une connaissance approfondie du droit applicable.

This third and last open access volume in the series takes the perspective of non-EU countries on immigrant social protection. By focusing on 12 of the largest sending countries to the EU, the book tackles the issue of the multiple areas of sending state intervention towards migrant populations. Two “mirroring” chapters are dedicated to each of the 12 non-EU states analysed (Argentina, China, Ecuador, India, Lebanon, Morocco, Russia, Senegal, Serbia, Switzerland, Tunisia, Turkey). One chapter focuses on access to social benefits across five core policy areas (health care, unemployment, old-age pensions, family benefits, guaranteed minimum resources) by discussing the social protection policies that non-EU countries offer to national residents, non-national residents, and non-resident nationals. The second chapter examines the role of key actors (consulates, diaspora institutions and home country ministries and agencies) through which non-EU sending countries respond to the needs of nationals abroad. The volume additionally includes two chapters focusing on the peculiar case of the United Kingdom after the Brexit referendum. Overall, this volume contributes to ongoing debates on migration and the welfare state in Europe by showing how non-EU sending states continue to play a role in third country nationals’ ability to deal with social risks.
