Homophobia by Shirleene Robinson Pdf

Homophobia is a prejudice with effects that extend far beyond the gay and lesbian community. While its physical, emotional and social effects have been charted to some extent, the development of homophobia in Australia has yet to be fully explored. Homophobia: An Australian History is the first book to consider homophobia in a distinctively Australian context. In this collection, thirteen well-known scholars examine the embedded homophobic attitudes that Australian gay and lesbian activists have fought to change. The book traces the evolution of homophobia, from its expression in Australia's past as a colonial settler society, through to manifestations in present day society. The compilation of this text is timely, given the 2007 release of the Same Sex: Same Entitlements report of the Human Rights and Equal Opportunity Commission. The release of this report, which focused on institutionalised and legal homophobia, has raised public awareness of these issues and sparked broader debates about homosexual rights. The thirtieth anniversary of Sydney's Gay and Lesbian Mardi Gras earlier this year also offers an ideal opportunity to reflect on the past gains and future goals of the gay and lesbian rights movement. The collected chapters in this book argue that homophobia developed in conjunction with the growth of a modern homosexual identity in the second half of the nineteenth century. To various extents, the legal and medical professions and other social institutions have perpetuated homophobic attitudes. Homophobia: An Australian History raises awareness of the devastating impact these attitudes can have on individuals and on society.Addendum: At the commencement of Page IX, Dr Ruth Ford's name and academic position was omitted. Dr Ford's biographical entry under Notes on Contributors should read: Dr Ruth Ford is a lecturer in Australian history at La Trobe University. She has published extensively on Australian lesbian, queer and gender history. She is currently attempting to combine motherhood with researching, writing and teaching. Her publications include articles in Labour History, Gender and History (UK) and Australian Historical Studies, as well as book chapters in 'Madness' in Australia: histories, heritage and the asylum, edited by Catharine Coleborne and Dolly MacKinnon, Gender and War: Australians at war in the twentieth century, edited by Joy Damousi and Marilyn Lake and Sex, Power and Justice: historical perspectives on the law in Australia, 1788-1990, edited by Diane Kirkby.

Free Hands and Minds by Susan Bartie Pdf

Peter Brett (1918–1975), Alice Erh-Soon Tay (1934–2004) and Geoffrey Sawer (1910–1996) are key, yet largely overlooked, members of Australia's first community of legal scholars. This book is a critical study of how their ideas and endeavours contributed to Australia's discipline of law and the first Australian legal theories. It examines how three marginal figures – a Jewish man (Brett), a Chinese woman (Tay), and a war orphan (Sawer) – rose to prominence during a transformative period for Australian legal education and scholarship. Drawing on in-depth interviews with former colleagues and students, extensive archival research, and an appraisal of their contributions to scholarship and teaching, this book explores the three professors' international networks and broader social and historical milieux. Their pivotal leadership roles in law departments at the University of Melbourne, University of Sydney, and the Australian National University are also critically assessed. Ranging from local experiences and the concerns of a nascent Australian legal academy to the complex transnational phenomena of legal scholarship and theory, Free Hands and Minds makes a compelling case for contextualising law and legal culture within society. At a time of renewed crisis in legal education and research in the common law world, it also offers a vivid, nuanced and critical account of the enduring liberal foundations of Australia's discipline of law.

Free Speech As Civic Structure by Ronald J. Krotoszynski, Jr.,John S Stone Chairholder of Law and Director of Faculty Research Ronald J Krotoszynski Jr Pdf

This book examines and explains the limited relevance of constitutional text to the scope and vibrancy of free speech rights within a particular national legal system. The author argues that, across jurisdictions, text or its absence will serve merely as a starting point for judicial efforts to protect speech activity.

Rethinking Self-Defence by T Markus Funk Pdf

Self-defence – the 'ancient right' – has never been more relevant than in the present era of widespread calls for criminal justice reform. The book substantially advances the patinaed discussion by introducing for the first time a comprehensive value-centric approach to thinking about the defence's deeper rationale. It tackles core issues such as the relative importance of the State's claimed monopoly on force, procedural justice and the need to shore up the justice system's legitimacy and creditworthiness, everyone's presumptive 'right to life,' and the importance of ensuring equal standing between citizens. And, in so doing, the book breaks ground by addressing public perceptions of 'just' and 'right' outcomes, as well as the emphasis legal systems place (and should place) on State power.

The Law of Deliberative Democracy by Ron Levy,Graeme Orr Pdf

Laws have colonised most of the corners of political practice, and now substantially determine the process and even the product of democracy. Yet analysis of these laws of politics has been hobbled by a limited set of theories about politics. Largely absent is the perspective of deliberative democracy – a rising theme in political studies that seeks a more rational, cooperative, informed, and truly democratic politics. Legal and political scholarship often view each other in reductive terms. This book breaks through such caricatures to provide the first full-length examination of whether and how the law of politics can match deliberative democratic ideals. Essential reading for those interested in either law or politics, the book presents a challenging critique of laws governing electoral politics in the English-speaking world. Judges often act as spoilers, vetoing or naively reshaping schemes meant to enhance deliberation. This pattern testifies to deliberation’s weak penetration into legal consciousness. It is also a fault of deliberative democracy scholarship itself, which says little about how deliberation connects with the actual practice of law. Superficially, the law of politics and deliberative democracy appear starkly incompatible. Yet, after laying out this critique, The Law of Deliberative Democracy considers prospects for reform. The book contends that the conflict between law and public deliberation is not inevitable: it results from judicial and legislative choices. An extended, original analysis demonstrates how lawyers and deliberativists can engage with each other to bridge their two solitudes.
