Federal Habeas Corpus by Charles Doyle Pdf

Federal habeas corpus is a procedure under which a federal court may review the legality of an individual's incarceration. It is most often the stage of the criminal appellate process that follows direct appeal and any available state collateral review. The law in the area is an intricate weave of statute and case law. Current federal law operates under the premise that with rare exceptions prisoners challenging the legality of the procedures by which they were tried or sentenced get "one bite of the apple." Relief for state prisoners is only available if the state courts have ignored or rejected their valid claims, and there are strict time limits within which they may petition the federal courts for relief. Moreover, a prisoner relying upon a novel interpretation of law must succeed on direct appeal; federal habeas review may not be used to establish or claim the benefits of a "new rule." Expedited federal habeas procedures are available in the case of state death row inmates if the state has provided an approved level of appointed counsel. The Supreme Court has held that Congress enjoys considerable authority to limit, but not to extinguish, access to the writ. This report is available in an abridged version as CRS Report RS22432, "Federal Habeas Corpus: An Abridged Sketch," by Charles Doyle.

On Your Own North Carolina Small Claims Court by Mary A. Nixon Pdf

If you are interested in representing yourself or your business in Small Claims Court in North Carolina in order to collect your debts or settle disputes, ON YOUR OWN - NORTH CAROLINA SMALL CLAIMS COURT is the book for you! Employing an attorney to represent you or your business may or may not make economic sense. The debt you are seeking to recover may be less than the fee charged by an attorney. While it may be economically desirable for an attorney to represent you or your business in Small Claims Court in some situations, you may find it more advantageous to represent yourself or your business ON YOUR OWN. An individual or business with a small claim may wish to pursue the indebtedness without an attorney, but may not possess sufficient knowledge about the way the court operates to feel competent to do so. If the debt is too small to justify employing an attorney or if the case never gets to court because the plaintiff does not have an adequate amount of knowledge of his or her interests, the debt goes unpaid. The plaintiff loses either way, because the debt is still not paid. By reading and studying this book, you will gain knowledge to assist you in maintaining more control over your bottom line. Larger net profits are important for any business enterprise. The materials contained on the pages of this book will show you how to better manage your company's small claim debt collection efforts by effectively using the Small Claims Court. You should be able to significantly increase your odds of collecting your judgment in Small Claims Court -- a court specifically designed by state law for the litigant with multiple small claims. ON YOUR OWN - NORTH CAROLINA SMALL CLAIMS COURT is a book that offers basic guidance to the individual who has never been to Small Claims Court, yet provides material that should be of assistance to the individual who has represented himself or his business on a regular basis. I cannot overemphasize methodical study and understanding of the law. If this book is read with care and understood, it will be helpful to you in the collection of small claims and the settlement of disputes. Mary Anne Nixon Attorney at Law

Habeas for the Twenty-First Century by Nancy J. King,Joseph L. Hoffmann Pdf

For centuries, the writ of habeas corpus has served as an important safeguard against miscarriages of justice, and today it remains at the center of some of the most contentious issues of our time—among them terrorism, immigration, crime, and the death penalty. Yet, in recent decades, habeas has been seriously abused. In this book, Nancy J. King and Joseph L. Hoffmann argue that habeas should be exercised with greater prudence. Through historical, empirical, and legal analysis, as well as illustrative case studies, the authors examine the current use of the writ in the United States and offer sound reform proposals to help ensure its ongoing vitality in today’s justice system. Comprehensive and thoroughly grounded in a modern understanding of habeas corpus, this informative book will be an insightful read for legal scholars and anyone interested in the importance of habeas corpus for American government.

Diversity of Enforcement Titles in the EU by Vesna Rijavec,Wendy Kennett,Tomaž Keresteš,Tjaša Ivanc Pdf

This book examines the diversity of enforcement titles in cross-border debt collection, focusing on the types, structure, contents and effects of enforcement titles. It offers a comprehensive overview of judgments, court settlements and authentic instruments from a variety of EU Member States. It primarily employs the comparative legal method to draw conclusions on commonalities and differences, as well as prospects for future approximation of laws. The premise of the research is rooted in the finding that national authorities of EU Member States continue to treat enforcement titles from other Member States with reservations and mistrust despite being committed to the principle of mutual trust. The book identifies the issues of mistrust stemming from the diversity of enforcement titles. The research is based on a rich database of national reports compiled during the course of several large-scale EU Justice Projects. Divided into five parts, the book offers first some general considerations and presents attempts at a systemisation of enforcement titles. The following parts are then devoted to more specialised approaches toward the different types of enforcement titles. However, the connecting line between all parts of the book are the considerations of cross-border enforcement in the EU (and in a limited manner with third States). Herein, research also addresses critical factors regarding the free movement of judgments in the EU, including those of lis pendens and related actions. This book provides a valuable contribution to the Theory of European Civil Procedure. Since it is based on a comparative approach and employs both empirical and doctrinal viewpoints, it should also greatly benefit practitioners involved in cross-border dispute resolution. Overall, the findings should be of interest to a broad audience, including policymakers, judges, practitioners and scholars.

Enforcement of Foreign Arbitral Awards in Russia by William R. Spiegelberger Pdf

Enforcement of Foreign Arbitral Awards in Russia presents issues peculiar to the Russian legal system and legal culture generally. The culmination of perhaps years of arbitration, enforcement of arbitral awards is a crucial element of arbitration and a subject best not taken lightly or left to the last minute. The Enforcement of Foreign Arbitral Awards in Russia parses the judgments of Russian courts, with a particular focus on the decision-making processes of Russian judges as reflected in their judgments. The Enforcement of Foreign Arbitral Awards in Russia addresses several questions, such as: • Which Russian courts enforce awards and what are they like? • What laws, treaties, and rules apply? • How do the courts reach their decisions? • Do those courts sometimes reach anomalous conclusions? • What should an applicant for enforcement watch out for? • What are the common pitfalls? With the help of Enforcement of Foreign Arbitral Awards in Russia non-Russian readers will be able to ask intelligent questions, earlier rather than later, of the local counsel who will be making an application for enforcement in the Russian courts.
