The Roman Law of Damage to Property by Erwin Grueber Pdf

Excerpt from The Roman Law of Damage to Property: Being a Commentary on the Title of the Digest Ad Legem Aquiliam (IX. 2) The Board of the Faculty of Law in the University of Oxford, being convinced that a more thorough knowledge of Roman law would be the best means of advancing a scientific understanding and culture of English law, has recently encouraged candidates in the Final School of Jurisprudence to exhibit a knowledge of some portion of the Digest, and has selected for that purpose the title 'Ad legem Aquiliam, ' considering that it contains, perhaps more fully than any other title in the Digest, the chief materials referring to one particular topic, viz. the Roman law of damage to property. Intending to furnish the student with the necessary help in attaining this knowledge, I had to take into account that my book is to be a text-book for students who only know the elements of Roman law, as they are explained in lectures on the Institutes, whilst I had to explain a particular topic in full detail, and in the various relations in which it is dealt with in the Digest. It is due to these circumstances that I have taken great pains to bring out my points very fully, and it even may be that I have gone too far in doing so, but I thought it best to err, if anywhere, on the side of over-fulness. Another point which was to be considered is the peculiar method in which topics of Roman law are dealt with in this country. Usually they are explained in the form of a commentary on the Roman texts, although it is at the same time recognised that a systematic exposition, which deals exhaustively with a whole topic under certain distinct headings, is preferable. Principle and Pragmatism in Roman Law by Benjamin Spagnolo,Joe Sampson Pdf

This edited collection presents an interesting and original series of essays on the roles of principle and pragmatism in Roman private law. The book traverses key areas of Roman law to examine the explanatory power of - and delineate interactions between - abstract, doctrinal principle, and pragmatic, real-world problem-solving. Essays canvassing sources of law, property, succession, contracts and delicts sketch the varied roles of theoretical narratives - whether internal to Roman doctrine or derived from external influence - and of practical, policy-based solutions in the jurists' thought. Principled reasoning in Roman juristic argument ranges from safeguarding commerce, to the priority of acts or intentions in property transactions, to notions of pietas, to Platonic conceptions of the market. Pragmatism is discernible in myriad ways, from divergence between form and substance, to extension of legal rules for economic, social or political utility, to emphasis on what parties did rather than what they said. The distinctive contribution of the book is its survey of different manifestations of principle and pragmatism across Roman private law. The essays - by eminent as well as emerging academics - will stimulate debate about the roles principle and pragmatism play in juristic argument, and will be of interest to both scholars and students of Roman law.
