The Alabama State Constitution by William H. Stewart Pdf

The Alabama State Constitution provides extensive analysis on American's longest state constitution, with an emphasis on the impact of recent court decisions declaring several of its most recently adopted provisions as in conflict with the U.S. Constitution and thus invalid. Since entering the Union in 1819, Alabama has had six constitutions. While the original constitution was regarded as one of the most progressive in the nation, its current constitution, adopted in 1901, is one of the most restrictive, especially from the perspective of the limits it imposes on local governments. The second edition updates and expands the previous edition, providing new analysis, with citations to court decisions and relevant scholarly commentary. This edition provides important accompanying explanations on newly added provisions including gay marriage, immigration, environmental protection, energy, and taxation and the court decisions interpreting them. The Oxford Commentaries on the State Constitutions of the United States is an important series that reflects a renewed international interest in constitutional history and provides expert insight into each of the 50 state constitutions. Each volume in this innovative series contains a historical overview of the state's constitutional development, a section-by-section analysis of its current constitution, and a comprehensive guide to further research. Under the expert editorship of Professor G. Alan Tarr, Director of the Center on State Constitutional Studies at Rutgers University, this series provides essential reference tools for understanding state constitutional law. Books in the series can be purchased individually or as part of a complete set, giving readers unmatched access to these important political documents.

Taming Alabama by Paul McWhorter Pruitt (Jr.) Pdf

Taming Alabama focuses on persons and groups who sought to bring about reforms in the political, legal, and social worlds of Alabama. Most of the subjects of these essays accepted the fundamental values of nineteenth and early twentieth century white southern society; and all believed, or came to believe, in the transforming power of law. As a starting point in creating the groundwork of genuine civility and progress in the state, these reformers insisted on equal treatment and due process in elections, allocation of resources, and legal proceedings. To an educator like Julia Tutwiler or a clergyman like James F. Smith, due process was a question of simple fairness or Christian principle. To lawyers like Benjamin F. Porter, Thomas Goode Jones, or Henry D. Clayton, devotion to due process was part of the true religion of the common law. To a former Populist radical like Joseph C. Manning, due process and a free ballot were requisites for the transformation of society.

Notorious Antebellum North Alabama by John O’Brien Pdf

Before the Civil War, North Alabama was infamous for lawlessness. The era saw courts filled with defendants who spanned the socioeconomic gamut--farmers, merchants and politicians. In 1811, John B. Haynes tore apart William Badger's house with his bare hands. Rodah Barnett ran a series of ill-reputed brothels in the early 1820s. In 1818, Rebecca Layman "accidentally" gave her husband sulfuric acid instead of rum. There is even a case of assault with frozen corn. Author John O'Brien relays these and more stories of the shady side of North Alabama during the antebellum period.

The Founding of Alabama by Frances Cabaniss Roberts Pdf

The most thorough history of Alabama’s Madison County region, widely available for the first time The 1956 dissertation by Frances Cabaniss Roberts is a classic text on Alabama history that continues to be cited by southern historians. Roberts was the first woman to earn a PhD from the University of Alabama’s history department. In the 1950s, she was the only full-time faculty member at what is now the University of Alabama in Huntsville, where she was appointed chair of the history department in 1966. Roberts’s dissertation, “Background and Formative Period in the Great Bend and Madison County,” remains the most thorough history of the region yet produced. While certainly a product of its era, Roberts work is visionary in its own way and offers a useful look at Alabama’s rise to statehood. Thomas Reidy, editor of this edition, has kept Roberts’s words intact except for correction of minor typographical errors and helpful additions to the notes and citations. His introduction describes both the value of Roberts’s decades of service to UAH and the importance of her dissertation over time. While highlighting the great intrinsic value of Roberts’s research and writing, Reidy also notes its significance in demonstrating how the practice of history—its methods, priorities, and values—has evolved over the intervening decades. In her examination of Madison County, Roberts spotlights exemplars of civic performance and good community behavior, giving readers one of the earliest accountings of the antebellum southern middle class. Unlike many historians of her time, Roberts displays an interest in both the “common folks” and leaders who built the region—rural and urban—and created the institutions that shaped Madison County. She examines the contributions of merchants, shopkeepers, lawyers, doctors, architects, craftsmen, planters, farmers, elected and appointed officials, board members, and entrepreneurs.
