Excerpt from A Study of the Question of Boundaries: Between the Republics of Peru and Ecuador At the request of His Excellency, Sr. D. Felipe de Osma, Envoy Extraordinary and Minister Plenipotentiary of Peru at this Court (Madrid), that I examine and report upon the question of boundaries between the Republics of Peru and Ecuador, submitted to the arbitration of His Majesty, the King of Spain, I have prepared this work, dividing it into two parts: General Part, antecedents and history of the case, and Special Part, a consideration of the diverse questions embraced therein. The purpose of the General Part is to facilitate the reader in his study of the problem and offer a guide to all the data and events, in their chronological order, that must be considered to enable him to form a general idea of the affair, and to perceive the historical connection of the different facts set forth and the relation of certain of the questions to each other. That part begins with an exposition of the former Spanish colonial regime or governmental system in America, which, being constantly alluded to, it is well fully to understand before entering upon the domain of its application. Then follows an historical review of the insurrectionary movement and of the formation of the Spanish-American States, which it is important to present with the greatest clearness because of the confusion with which those events usually recall themselves - occurring, as they did, simultaneously, in so many localities - and also because they were the origin of the so-called "Spanish-American public law," the basis upon which the question must be resolved. I prefer to relate them at the outset, to the end that there shall afterwards be no interruption in the examination of the various aspects of the problem, and because it will permit, besides, their appreciation in conjunction with each other unprejudiced by any criteria whatever. Disputes between Ecuador and Peru are nearly 200 years old and revolve around the question of Ecuador’s territory extending beyond the Andes and into the Amazonian basin – or not. Based on diverse interpretations of the Real Cedulas (Royal Proclamations) Spain used to define its colonial territories in the Americas, they became the source of the longest-running international armed conflict in the Western Hemisphere. Moreover, for most of their modern times, they have been democracies. Thus, their wars put in doubt the common contention that ‘democracies never go to war with each other’. The objective of this study is to provide the background required for an understanding of the boundary dispute between Ecuador and Peru, a hardy perennial among inter-American controversies. It is not designed to propound any particular thesis, much less to take sides in the dispute. Evaluation of the significance of the positions adopted by the parties over the years have been included. Primary attention has been focused on the period after the entry into effect of the Rio Protocol of 1942 which attempted to fix the boundary between the rival states and which was guaranteed by Argentina, Brazil, Chile and the United States. Very little has previously been published on the efforts of the guarantors to work out the problems which arose in the execution of the protocol. These problems proved so intractable that the demarcation of the boundary has not yet been completed, leaving the guarantors with a residual responsibility which they may yet be called upon to discharge. In addition to the survey of the post-1942 period, it was considered desirable to include information regarding the origins of the dispute and earlier attempts at solutions. Much of this material will be appearing for the first time in English.
