Free Speech And Why It Matters by Andrew Doyle Pdf

'A fantastically timely book written by one of the smartest thinkers in Britain' Piers Morgan 'Impassioned, scholarly and succinct' The Times Free speech is the bedrock of all our liberties, and yet in recent years it has come to be mistrusted. A new form of social justice activism, which perceives language as potentially violent, has prompted a national debate on where the limitations of acceptable speech should be drawn. Governments throughout Europe have enacted 'hate speech' legislation to curb the dissemination of objectionable ideas, Silicon Valley tech giants are collaborating to ensure that they control the limitations of public discourse, and campaigners in the US are calling for revisions to the First Amendment. However well-intentioned, these trends represent a threat to the freedoms that our ancestors fought and died to secure. In this incisive and fascinating book, Andrew Doyle addresses head-on the most common concerns of free speech sceptics, and offers a timely and robust defence of this most foundational of principles.

Freedom of Speech by Patricia L. Dooley Pdf

This book examines how freedom of speech is reflected in pop culture by looking at numerous examples of films, websites, television shows, and songs that have touched on—and impacted—this issue. It is easy to overlook the importance of freedom of speech in our modern world, where it often seems "anything goes." In actuality, freedom of speech issues are still highly relevant in the 21st century, even if our cultural and social contexts now allow many forms of expression that were unacceptable in previous eras. This book focuses on how freedom of speech is reflected in pop culture by looking at the films, websites, television shows, and songs that have touched on—and impacted—this issue. It examines specific examples of freedom of speech issues within everything from print media to music, theater, photography, film, television, sports, video games, and social media and demonstrates that pop culture sometimes contributes to the expansion of freedom of speech.

The Oxford Handbook of Freedom of Speech by Adrienne Stone,Frederick Schauer Pdf

Freedom of speech is central to the liberal democratic tradition. It touches on every aspect of our social and political system and receives explicit and implicit protection in every modern democratic constitution. It is frequently referred to in public discourse and has inspired a wealth of legal and philosophical literature. The liberty to speak freely is often questioned; what is the relationship between this freedom and other rights and values, how far does this freedom extend, and how is it applied to contemporary challenges? The Oxford Handbook on Freedom of Speech seeks to answer these and other pressing questions. It provides a critical analysis of the foundations, rationales, and ideas that underpin freedom of speech as a political idea, and as a principle of positive constitutional law. In doing so, it examines freedom of speech in a variety of national and supra-national settings from an international perspective. Compiled by a team of renowned experts in the field, this handbook features original essays by leading scholars and theorists exploring the history, legal framework and controversies surrounding this tennet of the democratic constitution.

Freedom of Artistic Expression by Paul Kearns Pdf

This book presents a unique and comprehensive examination of the human and moral rights of artists. In what is arguably the first exhaustive book-length account of artists' rights, Paul Kearns explores the problems associated with censorship, both from philosophical and legal perspectives, and focuses on the various ways in which the morality of art is legally regulated in different jurisdictions. In relation to human rights, English, French and American law, the law of the European Convention on Human Rights, European Union law and public international law are all closely scrutinised to discover the extent to which they offer protection for artistic freedom. The author also examines domestic and international law in respect of artists' moral rights, the law of copyright and related laws. In short, the book provides an original, and sometimes controversial, analysis of persistent concerns regarding the legal regulation of the arts universally, doctrinally and theoretically, and seeks to offer an holistic treatment which will appeal to art lawyers, artists and those interested in the future of the arts.

The Art of Veiled Speech by Han Baltussen,Peter J. Davis Pdf

Throughout Western history, there have been those who felt compelled to share a dissenting opinion on public matters, while still hoping to avoid the social, political, and even criminal consequences for exercising free speech. In this collection of fourteen original essays, editors Han Baltussen and Peter J. Davis trace the roots of censorship far beyond its supposed origins in early modern history. Beginning with the ancient Greek concept of parrhêsia, and its Roman equivalent libertas, the contributors to The Art of Veiled Speech examine lesser-known texts from historical periods, some famous for setting the benchmark for free speech, such as fifth-century Athens and republican Rome, and others for censorship, such as early imperial and late antique Rome. Medieval attempts to suppress heresy, the Spanish Inquisition, and the writings of Thomas Hobbes during the Reformation are among the examples chosen to illustrate an explicit link of cultural censorship across time, casting new light on a range of issues: Which circumstances and limits on free speech were in play? What did it mean for someone to "speak up" or "speak truth to authority"? Drawing on poetry, history, drama, and moral and political philosophy the volume demonstrates the many ways that writers over the last 2500 years have used wordplay, innuendo, and other forms of veiled speech to conceal their subversive views, anticipating censorship and making efforts to get around it. The Art of Veiled Speech offers new insights into the ingenious methods of self-censorship to express controversial views, revealing that the human voice cannot be easily silenced. Davis, Andrew Hartwig, Gesine Manuwald, Bronwen Neil, Lara O'Sullivan, Jon Parkin, John Penwill, François Soyer, Marcus Wilson, Ioannis Ziogas.

Free Speech: A Very Short Introduction by Nigel Warburton Pdf

'I disapprove of what you say, but I will defend to the death your right to say it' This slogan, attributed to Voltaire, is frequently quoted by defenders of free speech. Yet it is rare to find anyone prepared to defend all expression in every circumstance, especially if the views expressed incite violence. So where do the limits lie? What is the real value of free speech? Here, Nigel Warburton offers a concise guide to important questions facing modern society about the value and limits of free speech: Where should a civilized society draw the line? Should we be free to offend other people's religion? Are there good grounds for censoring pornography? Has the Internet changed everything? This Very Short Introduction is a thought-provoking, accessible, and up-to-date examination of the liberal assumption that free speech is worth preserving at any cost. ABOUT THE SERIES: The Very Short Introductions series from Oxford University Press contains hundreds of titles in almost every subject area. These pocket-sized books are the perfect way to get ahead in a new subject quickly. Our expert authors combine facts, analysis, perspective, new ideas, and enthusiasm to make interesting and challenging topics highly readable.

Free Speech Beyond Words by Mark V. Tushnet,Alan K. Chen,Joseph Blocher Pdf

A look at First Amendment coverage of music, non-representational art, and nonsense The Supreme Court has unanimously held that Jackson Pollock’s paintings, Arnold Schöenberg’s music, and Lewis Carroll’s poem “Jabberwocky” are “unquestionably shielded” by the First Amendment. Nonrepresentational art, instrumental music, and nonsense: all receive constitutional coverage under an amendment protecting “the freedom of speech,” even though none involves what we typically think of as speech—the use of words to convey meaning. As a legal matter, the Court’s conclusion is clearly correct, but its premises are murky, and they raise difficult questions about the possibilities and limitations of law and expression. Nonrepresentational art, instrumental music, and nonsense do not employ language in any traditional sense, and sometimes do not even involve the transmission of articulable ideas. How, then, can they be treated as “speech” for constitutional purposes? What does the difficulty of that question suggest for First Amendment law and theory? And can law resolve such inquiries without relying on aesthetics, ethics, and philosophy? Comprehensive and compelling, this book represents a sustained effort to account, constitutionally, for these modes of “speech.” While it is firmly centered in debates about First Amendment issues, it addresses them in a novel way, using subject matter that is uniquely well suited to the task, and whose constitutional salience has been under-explored. Drawing on existing legal doctrine, aesthetics, and analytical philosophy, three celebrated law scholars show us how and why speech beyond words should be fundamental to our understanding of the First Amendment.
