The Protection of the Underwater Cultural Heritage by Roberta Garabello,Tullio Scovazzi Pdf

The 2001 UNESCO Convention on the Protection of the Underwater Cultural Heritage represents a major step forward in the field of international law. New archaeological rules as well as a comprehensive co-operation system among the States concerned are set up by the new Convention. Despite the negative attitude assumed by few States at the moment of voting for the text of the Convention, this new international instrument is welcome by the great majority of States. This volume focuses on the main aspects of the Convention. It is divided in two parts, to describe the situation before and after the adoption (and the forthcoming into force) of the Convention. In the first part the contradictions resulting from the regime established under the 1982 United Nations Convention on the Law of the Sea are analysed together with the undesirable results of the application of the rules of admiralty (law of salvage and law of finds) to the underwater cultural heritage. In the second part the negotiation process is described, both in its general aspects (the myths surrounding the draft) and in its specific results (the drafting of each single provision).

Liability for Damage to the Marine Environment by Colin M. de la Rue Pdf

Despite widely-accepted international systems of liability for pollution damage to the marine environment, uniformity is far from being achieved. This book is based on the papers delivered at the CMI seminar on liability for pollution damage. The purpose of the seminar was to take stock of the legal position worldwide as a prelude to discussions on unification of laws relating to the admissibility and assessment of claims. Among the main issues addressed are - oil pollution prevention and response, the effectiveness of present compensation methods, the importance of recent protocols to the compensation conventions, the ramifications of OPA 90, the underwriting of oil pollution risks and the need for an international convention on hazardous and noxious substances. These issues are covered by a broad range of international experts.

Building Industries at Sea - ‘Blue Growth’ and the New Maritime Economy by Kate Johnson,Ian Masters,Gordon Dalton Pdf

Throughout the world there is evidence of mounting interest in marine resources and new maritime industries to create jobs, economic growth and to help in the provision of energy and food security. Expanding populations, insecurity of traditional sources of supply and the effects of climate change add urgency to a perceived need to address and overcome the serious challenges of working in the maritime environment. Four promising areas of activity for ‘Blue Growth’ have been identified at European Union policy level including Aquaculture; Renewable Energy (offshore wind, wave and tide); Seabed Mining; and Blue Biotechnology. Work has started to raise the technological and investment readiness levels (TRLs and IRLs) of these prospective industries drawing on the experience of established maritime industries such as Offshore Oil and Gas; Shipping; Fisheries and Tourism. An accord has to be struck between policy makers and regulators on the one hand, anxious to direct research and business incentives in effective and efficient directions, and developers, investors and businesses on the other, anxious to reduce the risks of such potentially profitable but innovative investments. The EU H2020 MARIBE (Marine Investment for the Blue Economy) funded project was designed to identify the key technical and non-technical challenges facing maritime industries and to place them into the social and economic context of the coastal and ocean economy. MARIBE went on to examine with companies, real projects for the combination of marine industry sectors into multi-use platforms (MUPs). The purpose of this book is to publish the detailed analysis of each prospective and established maritime business sector. Sector experts working to a common template explain what these industries are, how they work, their prospects to create wealth and employment, and where they currently stand in terms of innovation, trends and their lifecycle. The book goes on to describe progress with the changing regulatory and planning regimes in the European Sea Basins including the Caribbean where there are significant European interests. The book includes:• Experienced chapter authors from a truly multidisciplinary team of sector specialisms• First extensive study to compare and contrast traditional Blue Economy with Blue Growth• Complementary to EU and National policies for multi-use of maritime space

Pollution at Sea by Baris Soyer,Andrew Tettenborn Pdf

A sharp, informed and thoroughly practical guide to contemporary and developing issues relating to sea pollution, prepared by leading academics and practitioners with everyday hands-on experience. Pollution at Sea focuses on a number of the vital private law issues – compensation, insurance, contract and tort – thrown up by contemporary developments in the law of pollution. The book also intends to offer a critical analysis on emerging public law concepts, such as the legal position of seafarers from the perspective of criminal law in cases of pollution and the impact of port state control as a pollution control mechanism. Pollution at Sea is divided into three parts: 1. Private Law Liability Regimes 2. Rights and Liabilities of Particular Parties 3. The Impact of Public Law on the Actors Concerned In part 1; various liability regimes are dissected, including those which have been under the spotlight in recent years. This section has particular international appeal, and many of the regimes discussed are based at least in part on international conventions, agreements or practices. In part 2; the impact of pollution at sea on third parties is considered, with respect to the legal position of parties that might be perused either by the victims of pollution incidents or in some cases by the parties liable by way of a recourse action. Finally in part 3; recent relevant developments, particularly in the realm of public law are covered.

Human Factors in the Maritime Domain by Michelle Grech,Tim Horberry,Thomas Koester Pdf

The piecemeal fashion in which human factors research has been conducted in the maritime domain makes information retrieval available only by scanning through numerous research journals and conference papers. Bringing together human factors information from this and other domains, Human Factors in the Maritime Domain integrates a common body of knowledge into one single volume. The book provides the vital background information necessary to acquire a core knowledge base and a much-needed overview of human factors within the maritime domain. It starts by putting the topic into an historical and theoretical context, moves onto more specific and detailed topics and contemporary thinking in human factors, then reviews new maritime technology. The authors take a holistic approach based on a model of the socio-technical system of work in the maritime domain. They synthesize available knowledge and research, then present in an easily acceptable framework with example, illustrations, and case studies whenever possible, making the text rigorous, useful, and enjoyable. The three authors draw on a range of diverse backgrounds including working as a maritime surveyor, transport consultant, human factors lecturer, and mechanical engineer. They have undertaken maritime research in Denmark, Australia, Malta, and the UK. They have published several other human factor books on related topics. This combination of human factors knowledge, maritime wisdom, and substantial publication experience results in a book that is effective and practical.
